1. In order to coduct photoreconnaisance flyovers, I would have to post something detailing the flyover, right?

2. Would inciting rebellion in a nation be considered an act of war?

1: yes, though it could easily be a telegram rather than a full post on the forums.

2: depends if you were caught.. would be a matter for the nations involved to decide.
