Private enterprise is (apparently) permanently illegal if you choose that capitalism is on the way out (very strong) in your preliminary questionairre. This really has got to be changed, as many nations wish to have primary, secondary, and tertiary industries that are legal. Laws change, and so should NS. I'm not sure if this is feasible, programming wise, but it seems like it should be, and many NS players would be delighted with this change. And that's the way it is.
I'm not sure that it's "permanently illegal". I can't remember if I chose that option at the outset of the game, but it sounds like something I would have done - and I've had the issue which allows you to legalise it a few times.
