No, it does not. You may not have realized it, but you have called for me to be shot.

You need to think about the consequences of your words before you write of say them.

In my country (Canada) this is an invitation to hate and violence, and a criminal offense.

In Canada, shooting homosexuals is a crime; shooting anyone is a crime. Calling for violence and hatred of a group is also an offence. A sense of humour is completely optional in Canada. Either way, it is offensive and I side with Ska on this.

I will now take my leave and Ska, you want have wanted to include a "MODS ONLY" tag. Oh well. :)

I'm not a mod so of course I can't say this for sure, as much as I hate the post I think it is an opinion that can be stated in the forum. It's not RPing and there is no reason no one can express their opinion.

An "opinion" that states so-and-so minority should be shot certainly falls under the "Threats" rules.

Go ahead and say you think all blacks, jews or christians should be shot. Does it still sound like an "opinion"? To me it doesn't. It sounds like a call to genocide.

FWIW: most courts have found that for speech alone to be considered a threat, the statement in question must be so "unequivocal, unconditional, immediate, and specific as to the person threatened as to convey a gravity of purpose, imminent prospect of execution" (US v. Kelner)

"i still say they should all be shot anyways" is clearly a statement of opinion. Not only does the opening phrase delineate this ("I still say" equates to "I think" or "In my opinion"), but the following sentiment ("they should be shot") is far too general to be viewed as a threat. It does not establish any intent of the author to actually engage in harming others

It is however a gravely offensive sentiment, indicating the author of the statement as not only insensitive and boorish but also intolerant and possibly mentally ill. Deeper examination of this author's previous messages lends further credence to these observations.

Canadian law does indeed have more restrictions on "hate speech" than US law. However, the above statement would not likely satisfy the criteria established under Canadian law for this to constitute either "hate speech" or a threat.

All that said, you have a solution at hand: rather than trying to fan flames of righteous indignation over yet another rude bigot, you could just report the post as abuse (that little triangular button below the post, the one with the exclamation point) and be done with it. Save yourself the agony and pain of trying to argue with a hateful idiot, you know?

PS. Besides, someone who is so vehemently homophobic, who also obsesses about violence and guns, is most likely a victim of his own repressed homosexual desires. The laughable attempts of such pitiable men to appear "tough" and "macho" are often masks intended to hide their true homosexual nature, which they perceive as "soft" and "feminine," and thus overcompensate for their "gay" or "effeminate" qualities by acting out as aggressively overbearing jerks.

1) I don't care one whit about Canadian law. It's irrelevant.
2) I'm getting really sick of people confusing Moderation with General.
3) Sometimes, requests aren't handled immediately. We do have lives outside of NS.
4) "Berzerkirs" banned for two days. His comment was beyond what is acceptable, but not exactly a threat (which would have resulted in termination).

5. Please DON'T, because it goes to every mod and admin on Jolt, including those for other games, and they may well get a bit narked. Read this to see why it's (currently) pointless.
