Alright, The Phoenix Milita (TPM) used my picture in a design without asking my permission to use my image beforehand.

Now, neither Doom, nor I has given permission for TPM to use my image, as you can see in that thread.

Thus, unless I am mistaken TPM's is thus guilty of plagiarism.

I took the following note by Doomingland, not as consent but as implicit permission, and had the intention of removing the image instantly if there were any objections, which is exactly what I did.

TPM: According to your writeup that launcher should be able to mount to the rails on the DR-83 as it is.

And not to point fingers, but Aurum Domus did the exact same thing the page before, and that did not illicit a post in moderation or even a response from you.
I also asked twice, and was not told no, that fact combined with Doomingsland's response gave me the impression that i could go ahead.

Okay, so person acts without permission but takes it down when yelled at. While the initial act may not have been appropriate, where's the beef? More importantly, why should we be involved?

Either way, I'm not exactly... impressed with how it was handled. First recourse is to ask politely, not post "EPIC FAIL" and promptly start flaming people. This appears to be a simple misunderstanding--it's not asking too much of everyone to treat it as such and move on with their lives, I hope?

Now technically this may be plagiarism or it may be a great big misunderstanding. However, the fact is that TPM deleted the offending image after someone called him on it, and so right now there is in fact no plagiarism, accidental or intentional, going on.

I'm also not seeing that TPM was claiming the weapon for his own. "This is a tank produced by my national industries that just happens to look identical to yours" is plagiarism. "This is what your gun would look like with a grenade launcher attached" ... not so much. If TPM had gone on to sell that weapon on his storefront, unattributed and without permission, then you'd have a case.

TPM, you may wish to be more careful about getting explicit permission to modify people's images in the future.

Overall, though, this is the sort of very minor thing you don't really need a Moderator to solve. We're here to DEAT porn-spammers, not hold your hands.
