My Lords and Ladies, a Mistake has been made

This will get a little strange, I try to add a bit of RPing Element to Everything I do.

My Kings, Queens, Emperors and Empresses, I come before you with a major problem, one that I hope to be ratified.

Recently my Main Nation, Lessr Tsurani was deleated for posting a link that had a porn pop up. Unfourtunatly for me, My Internet I had at the time of finding the picture, had a pop up blocker on. Now, this stoped me veiwing the very thing I was deleated for.

Now, the thread in question was called The Bade Thread, in which I found a picture I rather liked of the Olson twins, which, after seeing some of the others, was NOT against site rules. That thread can be found Here:
http://forums.jolt.co.uk/showthread.php?t=391792&page=1&pp=15 And contains many other pictures much the same. The Reason I was deleated was because of the Porn Pop up, which, as already said, I did not even know of the existance off.

The fact my nation was deleated actually bothers me, because I had large plans for it, the least of which introducing someone who has never written a page in his life, and who hates reading, to nationstates. Now, I know that without me to help him, he will leave. Also, there are a large number of RP's I am in, and the fact I have never done anything before. As a matter of fact this is the First time I have done anything wrong, besides a tiny bit of godmodding when I first started out, but the mods never mentioned anything.

So now, my nation, one year old sometime within the twentith and thirtith of this month, was deleated, without warning, because I have a certine softwere on my computer that stops the stuff that I was not ment to show showing on my computer, so I had no way of knowing.

I apologize for the delay; I had forgotten about this case.

For the record, I am the Moderator who handled this case.

"Lessr Tsurani" was deleted for linking to a site that had what I described as a "porn pop-up". The term "pop-up", however, is not exactly correct as the porn ad didn't appear in a separate browser window. Rather, it appeared within the same window as the linked image. Upon further investigation, it has been determined that the offending ad is really a Javascript ad.

Now, we can't afford to have players post links to pornography and later claim "But I block everything! I didn't know it was there!" Thus, any NationStates player who wishes to link to something from NationStates is required to check in advance for the presence of any pornographic pop-up ads, java ads, or javascript ads before posting a link on NationStates. By posting a link, you certify that there is no porn on the other side of the link and that you have checked it for yourself beforehand.

Thus, the appeal is denied. "Lessr Tsurani" will not be resurrected.

On a related note, the general content of www (dot) joked (dot) com is not considered acceptable for NationStates and links to it are verboten.

And what mistake did Cog make? Saying "popup" instead of "in-window java ad"?

Hair-splitting semantic nonsense. The site contained porn ads and contained inappropriate comment. Go troll for conspiracy theories elsewhere.

Well that sucks. A simple mistake can curse a man/woman. Do you not realise that in this fast world, some people don't have time to check the popups of every single link?

Still, I like you guys, so I respect your decision. At least your not as strict as the Ultimate Dominion mods now... OOC speaking on there gets you booted right away...

I think that LT should have had the chance to appeal, before being deleted... sounds harsh to me...

Its kinda harsh, could have let her off with a warning and told her to never do it again...

NS has a zero-tolerance policy for pornographic links and images. Letting the player create new nations seems rather lenient to me. They could just ban everyone who's ever been deleted for breaking rules.

She was currrently not aware of those pop-ups, so I do not find that reason for outright deletion.

However, should she do it again then a deletion would be in order in my eyes.

The mods have no way to discern what a person does or doesn't know, and have to treat rules violations in a fair and even-handed way, even if it's not nice. They can't trust a player's word.

Then they shouldn't have time to post links either. It's all part of the posting process!

True.
If you post a link to another site onto NS, you need to make sure that there is no such chance of having an inappropriate pop-up on that link. That's the risk that you take in posting in the first place. Posting in a rush is never a good thing.

You had a previous warning for deliberately attempting to break forum window formatting when we were still on the old forum system. You had a previous warning for pyramid spam. After the pyramid spam thing, there was a note tagged to your nation stating that you should be deleted on your next offense, regardless of how trivial. ...and then you went and spammed/hijacked this (http://forums2.jolt.co.uk/showthread.php?t=379231) topic.

I admit that the explanation sounds plausible. If you have Javascript turned off, you wouldn't notice the porn ad. I did seriously consider granting the appeal. Unfortunately, we Mods have to consider how other posters are going to respond to this. There are troublemakers who if given an inch will take a mile. If we allow a player to get away with this once, other players may decide that they can cause trouble by posting links to porn and get away with it by claming "I didn't know it was there!"

We Mods cannot see what is going on behind the computer screen on the other side of the internet connection nor what is going on inside your head. Nevertheless, Moderation (in practice) requires that we try to estimate these things based on the evidence available. Unfortunately, when it comes to these estimations, we sometimes have to assume the worst about you. Just like we can't take your word for it that "Those UN member nations belong to my kids and my spouse and we all share the same computer" we also cannot take your word for it when you say "I didn't know the porn was there!"

I will also note that this isn't the first time a nation has been deleted for posting a link to a site with a porn ad, nor the first time that such a nation has appealed claiming that it was an accident and they didn't know it was there (though I don't have links to previous cases immediately available). So, my decision is nothing new.

Ultimately, this was a judgment call, and a tough call at that. There were reasons to grant the appeal and reasons to deny the appeal. I finally chose to deny the appeal.

The decision stands.

And yet somebody would have a motive for creating more than one UN nation, whereas I really can't see the motive for posting porn. It doesn't give you any advantages and just gets you in trouble.

Nor is there any advantage for posting spam links, creating multiple non-UN nations for the sole purpose of annoying the moderation staff (think Eireann Shamrock), or pushing every possible limit just to see how much crap can be allowed (as in Japacia). Nor is there an obvious motive for posting Marathon-esque abuse of other players. Nor is there an obvious motive for posting countless "random politician Sucks" in topics that have nothing to do with politics.

Nonetheless, people still do it on a regular basis, and they sometimes get deleted for it. Motive is irrelevant.

I have google pop-up blocker, I also have Norton's pop-up blocker running. When i post a link I have no clue if it contains porn or not, so I think this deletion is a bit too hasty.
