You betcha. In fact, we're much stricter on nation flags than we are on forum posts, because they're not open for challenge and debate. If you want to make a political point, don't use your flag -- use the forum, where other people have a right of reply.
Just upload it here as an attachment.
And Carinthe, do you have a copy of the FAQ stored somewhere? What you quoted was an old version. The stuff about flags has been moved to the flag upload page.

I was refering to my own deletion, because I one day too might become evil, if mass ejection of puppets is against the rules. I have about 75 puppets hanging around. Please stay on topic ;)

It referes to the etiquette (http://www.nationstates.net/cgi-bin/index.cgi/28659/page=faq#etiquette), where I got my quote from.
Create Your National Flag
You can create an image on your computer and upload it as your nation's flag.
Your flag must be:
in JPEG (.jpg) format
about 107x71 pixels in size
no larger than 10KB
appropriate. This means conforming to site etiquette (http://www.nationstates.net/cgi-bin/index.cgi/28659/page=faq#etiquette) and being suitably flag-like. Images likely to cause widespread offense (e.g. nudity, swastikas) are prohibited, and your nation may be deleted if you post them.

Correct.
"Offensive" is a subjective term. The NationStates Terms and Conditions disallow any of the following:
obscene
illegal
threatening
malicious
defamatory
spam
In this case, saying "Guns don't kill people, Dangerous minorities do" qualifies as "defamatory". It may also qualify as "malicious" and (in some locations) "illegal".
