Rights of the Host Nation

Leistung reserves the right to expel members of a foreign diplomatic mission for any reason. In the unlikely event that this should this occur, embassy staff will be deported immediately back to their nation of origin. See below for information about felonies.

Embassy zones are not considered territories of the Federal Republic of Leistung, or the city of Falkenberg, and as such, they cannot be entered by police officers or federal marshals without permission from the embassy nation’s government. The only exception to this rule is when the staff is suspected to be in violation of laws governing embassies or has committed a felony while in Falkenberg.

All embassies are constructed free of charge by the government of Leistung, and any and all modifications are also provided for free. Costs incurred by the embassy staff (for water, energy, garbage, etc.) are covered by the Leistungi Ministry of Foreign Affairs and will not come out of the pocket of the embassy nation’s government.

Rights of the Embassy Staff and Diplomatic Immunity

No staff member working full-time in a foreign embassy can be charged with a misdemeanor while in Falkenberg. This being said, should a staff member be suspected of a felony during their stay in the city, the embassy nation’s State Department (or similar department/ministry) will be contacted, and may be asked to remove diplomatic barriers so that the person or persons may be tried in a Leistungi court. If the nation in question does not accept, the individual will be returned to their home nation, and the Leistungi ambassador to said nation will be recalled.

Parking tickets incurred by vehicles with diplomatic license plates will be forwarded to the embassy nation’s government and should be paid promptly or the individual diplomat will be charged out of his or her own bank account. As a parking violation is a misdemeanor, the home nation's State Department may intervene and ask for the Leistungi government to waive parking fees as they arise. Staff members may be subject to random drug tests and searches for contraband during the first three days of their stay in Falkenberg (this is mandatory)—refusal to comply with these tests and searches will result in expulsion from the city.

In the unlikely event of a war with a nation maintaining an embassy in Falkenberg, the embassy staff will be expelled from the country via chartered plane based out of Falkenberg International Airport, unless they have committed espionage against the Federal Republic, in which case they will be incarcerated as prisoners of war. Likewise, if a staff member commits espionage against Leistung, he or she will be held in a Leistung prison until he or she can be tried fairly in the staff member's home nation fairly. By agreeing to establish an embassy in Falkenberg, the nation in question waives the right to sue Leistung for unforeseeable damages to embassy staff, their personal belongings, or the embassy building itself.

Locations of Embassies

All embassies will be placed on Hermanallee or Republik-Platz in the center of Falkenberg. Hermanallee, named for the vital Herman River in Leistung, offers a beautiful view of the Südlich Mountains to the north and the scenic Herman River to the east. If for whatever reason this is not to the satisfaction of the embassy nation, the location of the embassy can be altered.

Denomination of Foreign Diplomacy

Whilst the Greater Economic Union is interested in establishing an embassy in Leistung, there are a few sovereignty-related questions which we would like to resolve before moving ahead.

First, we would request that the Leistungi government clarify whether or not embassy officials will enjoy full diplomatic immunity while in Leistung; certain phrases have caused some concern over the issue. While the Union is not in the habit of appointing common criminals to ambassadorial positions, we must inquire, should a Manthian diplomat be charged (wrongly or rightly) with a felony, whether the official will enjoy the benefits of diplomatic immunity as suggested under the "Rights of Embassy Staff..." header or will be retained and charged in Leistung as suggested under the "Rights of the Host Nation" header.

Similar questions have been raised about the provision regarding parking tickets, and the Denomination would like to clarify whether the payment of parking tickets is merely a strong request (and indeed under Union diplomatic guidelines embassy personnel are expected to voluntarily pay parking tickets) or a legal requirement and infringement upon diplomatic immunity.

Second, the Denomination has registered some concerns regarding the extraterritoriality of an embassy. Of particular concern is the clause regarding physical searches of the embassy itself on "suspicion" that any staff member may be in violation of a Leistungi law, and we would like to request re-clarification on whether the Leistungi government intends to convey that it would reserve the right to such searches even lacking permission from the embassy. A more minor concern is the prohibition on certain items in Falkenberg, and we would like further clarification on the technical question of whether it is intended to say that such items are simply not to be brought into the city of Falkenberg or brought to the embassy through Leistungi territory, or whether, in the hypothetical scenario that such items were on embassy grounds, the Leistungi government would take unilateral action to remove them. While we understand the distinction is technical we do believe there are implications as regards the legal view of extraterritoriality and thank you for any light you can shed on the matter.

Finally we would like to clarify the minor question of the drug tests mentioned in your document, and ask whether this is intended to apply to personnel with diplomatic immunity and if so, whether you truly would intend to welcome a new Manthian ambassador to Leistung with a drug shakedown?

The Denomination apologizes for the length of these questions and for any sections which may be viewed as quibbling; while we are confident in the general goodwill of the Government of Leistung, it is always important to ensure the legal support for international diplomacy is firm.

We would like to thank our counterparts in Leistung for clearly and promptly resolving the Denomination's questions.

That said, unfortunately the Denomination does not feel it can establish an embassy under the clarified restrictions. Specifically, we are concerned that a single staffer being suspected of a felony would compromise the security of the entire embassy, and in addition the Denomination is concerned over the lack of diplomatic immunity in the following cases: random drug testing, random drug searches, espionage.

It is our regret that the above concerns prevent the Greater Economic Union from establishing an official embassy in Leistung. However, the Denomination would nevertheless like to invite Leistung to establish its own embassy in Alexandria (where diplomats will enjoy the full benefits of traditional diplomatic immunity), and despite the lack of a full embassy the Denomination would like to establish a consulate in Falkenberg (and eventually in other major Leistungi cities) to handle the more minor aspects of international relations.
