The Constitution of the Promethian Republic of Faxanavia and Her Associated Territories
Preamble
In such times as these, when a people's will guides a nation on a new path, it becomes necessary to re-assert our existence and belief to the world. As such, we, the people of the Promethian Republic of Faxanavia do recognize, affirm, and allow this constitution in the name of life, liberty, freedom, and the pursuit of goodness and justice.
Article I: On the Subject of Sovereignty and Division
We, the people of the Promethian Republic of Faxanavia do affirm the following:
-That the Promethian Republic of Faxanavia does declare itself to be a sovereign state, controlled by none save her own people and their elected officiates.
-As such, we the people of the Promethian Republic of Faxanavia do dedicate ourselves to the protection of out sovereignty by any means possible, and recognize that no nation shall hold control over the Promethian Republic of Faxanavia.
-Furthermore, the Promethian Republic of Faxanavia does recognize itself divided into 6 states, and as such recognizes these political divisional lines. These states shall have a general elected government, to be addressed in Article III. Furthermore, each of these 6 states shall be divided into 10 districts, as selected by the general state governmental body, as addressed in article III.
-Furthermore, the Promethian Republic affirms its belief in the pursuit of life, liberty, freedom, goodness, and justice.
Article II: On the Subject of Federal Government
We, the people of the Promethian Republic of Faxanavia do affirm the following:
-The federal governmental body of the Promethian Republic shall be assembled of 2 individual branches, which shall be affirmed individual powers. Furthermore, neither shall be granted greater power then the other.
-The first branch shall be that of the Prime Minister, his associated lower Ministers, and his advisers. The Prime Minister shall be an official elected by the people each 6 years by a majority vote of all persons over the age of 18 within the Promethian Republic of Faxanavia. The Prime Minister shall be recognized to have the responsibility to be the Commander in Chief of the Armed Forces, the highest foreign delegate within the land. Furthermore, the Prime Minister shall have right of veto on any and all laws which have been passed within the Senate. In such case, the law may only be passed by a vote of 2/3 of the senate.
-The second branch shall be that of the Senate, which shall be composed of elected representatives from each of the individual districts of the Promethian Republic of Faxanavia. Each representative shall be elected by majority vote of all persons over the age of 18 within each district. Each district shall elect two representatives, and as such the Senate shall be composed of 120 members. The Senate shall be recognized to have the responsibility of bringing forth laws which it believes to be pertinent to the embetterment of the people. Any single member of the Senate shall be allowed the right to bring forth a bill, and it shall be voted upon by the Senate, and if a majority of the Senate approves it, it shall be taken to the offices of the Prime Minister, who shall concur to it or shall veto it. In case of a veto, the Senate shall vote again on a bill, and it must pass by a 2/3 majority to be recognized as law.
-The Senate shall elect an arch-senator, and he shall be elected by a vote of the majority of the Senate. The duties of the arch-senator shall be to overlook proceedings of the Senate so as to affirm that all shall proceed fairly and justly. The arch-senator shall not vote unless in case of a tie within the Senate, in which case his vote shall be decisive.
-There shall be the following offices under the Prime Minister: the ministry of Defense, the ministry of Commerce, the ministry of Social Welfare, the ministry of Health, the ministry of Education, the ministry of Public Services, and the ministry of Environmental Services. Each ministry shall have an elected Minister as its head officiate. This Minister shall be selected from amongst the general populace by the Prime Minister, and shall be placed in the position only by a majority vote by the Senate. Each ministry shall be tasked with individual duties, provided for them by the Prime Minister based upon the necessity for which they are needed.
-The Prime Minister shall select a cabinet of trusted officials and persons of standing within the national community to serve as his advisers. These advisers shall be required to be free to be consulted by the Prime Minister at any time on any subject of state.
-Furthermore, the Promethian Republic affirms its belief in the pursuit of life, liberty, freedom, goodness, and justice.
Article III: On the Subject of State Government
We, the people of the Promethian Republic of Faxanavia do affirm the following:
-The State governmental body of the Promethian Republic of Faxanavia shall be composed of two branches which shall be granted individual powers. Furthermore, neither branch shall be more powerful then the other.
-The first branch shall be the State's governor, who shall be elected by a majority of the persons within the population of the state who are over the age of 18. He shall hold this office for 4 years of time, at which point another election shall be held. The Governor's duties shall be the management of the funds of his state and the right to veto any law passed within the state's senate.
-The second branch shall be the State's senate, which shall be elected from the 10 districts within the state. The people of the population of each district over the age of 18 shall vote for 2 senators within the Senate every 2 years. The Senate shall have the duty of the passing of laws it deems for the embetterment of the people. Any bill which is brought before the Senate may be deemed a law when a majority of the Senate approves it. If a bill receives approval by the Senate but is vetoed by the Governor, it must pass by 2/3 approval of all members of the Senate.
-Furthermore, the Promethian Republic affirms its belief in the pursuit of life, liberty, freedom, goodness, and justice.
Article IV: On the Subject of the Judicial System
We, the people of the Promethian Republic of Faxanavia do affirm the following:
-There shall be established a high court, which shall be referred to as the "high court". This court shall be charged with the enforcement of all laws layed down in this Constitution, and shall consist of 11 High Justices, who shall deliberate on all cases brought before them and shall be considered the final authority on matters of law within the land. They shall be selected by the Prime Minister, and brought before the Senate, who shall deliberate and shall choose to elect them only if by a 2/3 margin.
-There shall be established lower courts, and their placement shall be chosen by the Senate. These courts shall have jurisdiction over all crimes within the area over which they preside, and shall rule justly and fairly to the best of their ability. Judges of these courts shall be appointed by the people of the area over which they preside.
-Furthermore, the Promethian Republic affirms its belief in the pursuit of life, liberty, freedom, goodness, and justice.
Article V: On the Subject of the Rights of the People
We, the people of the Promethian Republic of Faxanavia do affirm the following:
-That the the people of the Promethian Republic of Faxanavia shall be granted the following unalienable and undeniable rights, and that these rights shall be not abridged by or to any person or peoples while they are resident within the Promethian Republic of Faxanavia:
1. The people shall be granted the most noble freedoms of the right of open, unlimited speech and freedom to choose which deity they may choose to worship, even if be that none at all. Furthermore, the rights of freedom of speech shall not be abridged within the media of the nation, nor shall the right to freedom of peaceful assembly or peaceful protest be abridged.
2. There shall be no military draft upon the people in any peacetime, nor shall any persons or people be required to house a soldier or soldiers of the armed forces within their residences without their given consent.
3. The people shall be secure in their worldly possessions, self, papers and effects from unreasonable search and seizures. Furthermore, no warrant for search and seizure may be issued save upon probable cause for such actions to be taken and the approval of a judge of the courts of the Promethian Republic of Faxanavia.
4. No person of people shall be held for any capital crime unless upon the order of a grand jury, save for in cases of military persons who have committed such crimes. Furthermore, no person or people shall be subjected to prosecution for the same crime twice, nor be forced to testify in a manner which would incriminate him or herself. Furthermore,no person or people shall be subject to an abridgment of their rights and liberties, nor shall have their worldly possessions seized without warrant, as per section 3.
5. All persons or peoples subject to prosecution where in the value in controversy is greater then $50 shall be ensured the right to a speedy, fair trial, and shall be tried before a jury of their peers within the state or district in which the alleged crime has been committed. Furthermore, all persons under prosecution shall be guaranteed the right to legal counsel, and shall have no freedoms abridged while under prosecution, nor shall be declared innocent until proven guilty in the eyes of a jury of his peers. Furthermore, excessive bail shall not be posted, nor shall any person under prosecution be subjected to cruel and/or unusual punishment.
6. No rights herein shall be abridged by this constitution in any way, and all rights and powers not given to the nation by the constitution and not limited by state law shall be granted to the people and states respectively.
7. The Constitution shall be the definitive and final authority on all matters and subjects of laws and there shall be no higher authority in the land.
8. The Senate shall have the right to amend the constitution only upon an agreement of 3/4 of the Senate and a ratification by the Prime Minister.
-Furthermore, the Promethian Republic affirms its belief in the pursuit of life, liberty, freedom, goodness, and justice.
We, the undersigned, on behalf of the people of the Promethian Republic of Faxanavia and her associated states and territories, and in the name of life, liberty, freedom, goodness, and justice, do recognize and ratify this constitution, on this day April 15th in the year of our lord 2008, now and forever.
