Immigrant Groups Lose Citizenship Lawsuit (MT)

“Today, the High Imperial Court has ruled against the claim jointly field suit by groups of citizen activist groups, groups of citizenship longing immigrant groups, and groups of illegal immigrants who seek to be given legal authority and legal status in the Empire.

The suit was filed due to the strict Imperial laws which make it impossible for immigrants to become citizens, unless if they enlist in the auxiliary forces of the armed forces.

This strict stance has caused a great of heated debate due to the social, political, and legal repercussions if all immigrants could immediately apply for citizenships. As well, there has been much opposition by the highly conservative elements of the nobility, current citizens, and super majority dominated parts of Parliament.

On the other spectrum of this the High Imperial Court ruled, with a decision of 17 to 4, that to change the citizenship laws would be against the fundamental bases of the society, the laws of the Empire, to be in direct opposition of the Constitution, and that the power to change those laws only belong directly to the Emperor and to the spectrum of Parliament.

They have also decreed that no court would have the power to rule otherwise and any citizenship reforms would have to be performed by other parts of government and that immigrants can not file citizenship claims through the courts either.

It was a quiet day in the office. News of the ruling hit the small law firm hard, it was a big case, one which took up quite alot of resources and money, something they didn't have alot of. Bill Casey walked past the secretary, Jennifer and straight to a door labled "Sean Leary, Attorney at Law". He knocked on the door and waited for a reply, a weary voice told him to enter. He walked in and saw the thrity five year old defense attorney slumped in his chair, tie undone and an empty shot glass on the desk.
"They just added the twist in the knife, Sean, Casey said first, "They ruled that the courts cannot overturn the ruling."
"That's absurd! It's a travisty of the legal system!" Leary exclaimed as he crooked his head up. It was a tough legal battle and he was drained and hit the bottle again. "We have to appeal this, we've worked for months with the groups...we've come to far to let them down" he added.
"I know, we'll see what we can do" Casey sunk down into the couch off to the side and sighed.

Yet, we fear that Emperor might directly act on the issue against us in which case we will never be able to get it through because the courts swear allegiance to them, the Parliament is full of supreme loyalists to the Emperor, and a super majority of the people of the Empire will no longer given any support to us.

The office was in an uproar, several advocacy groups had forwarded considerable monies as well as varuious other forms of assistance. They were back in business. Leary waltzed into work the next day, rejuvinated and prepared to give it his all. Bill Caset, Jennifer Harway, and Frank Devrot sat in their conference room. Devrot was his private investigator and was once a member of the police and knew all their tactics which proved invaluable in court. They were a good team but the system was working against them and had unlimited resources. He set down his briefcase and breathed heavily.
"Alright, we still have the trial transcripts as well as the paperwork on file. There has to be a loop hole somewhere in the trial. The whole thing stunk from the beginning. We're going to file for an appeal today" Leary began.
"They'll reject it for sure" Casey added.
"Yes they will, but then we'll file another and another. The paperwork will bog them down, allowing us to concenrtate on other aspects." Leary paced the conference room which was small, but well furnished to give it a resemblence of professionalism. However, their team was hardly professional. Leary was several times held in contempt in the court room for his fiery cross examinations. He was known to grill a prosecution witnessess to a crisp. It earned him respect amoungst his peers but disdain from the court system, judges, legal clerks and such.
"So, what's the plan?" Devrot asked as he leaned back.
"You're going to pay a visit to some of the illegal immigrants and get their stories. Bill will file the appeals and I'll dig for some new dirt and meet with the legal counsel for the state" Leary continued to brief them.

Devrot climbed into his BMW and winced in pain. He was in his mid forties and suffering from back problems. But, he was a tough man and turned the ignition and drove off. His destination was the GCACR Headquarters. They hoped that the group would have some more information, any extra bit would help their case. This was adangerous waters they were getting into, meddling with the Imperial Courts, they were powerfula nd connected. The older man lite a cigarette as he weaved in and out of lanes. Finally, after a lengthy drive he made it to their headquarters, stepped out of the car, a sharp pain shot through his spine, he grunted and continued to press on towards the building.

Leary and Jennifer scanned through the transcripts, searching for any mistake the state made, it was harder said than done. It was obvious there was a bias against immigrants in the nation, fueled by misunderstanding and fear. They were doomed to fail from the start. The High Court ruled unfairly against the groups, their points were valid and Leary took the defeat personally and vowed to give it his all, even more this time than last.
"I can't find anything" Jennifer finally said as she rested her head in her hands.
"We got to keep reading, I'll make some more coffee" Leary replied, equally tired.

Meanwhile, Casey walked into the High Courts in an attempt to send in a appeal. It was a suicide mission but it was worth a shot to dog them at every turn.

At the high court the paralegal recognized the lawyer whom had aided the immigrants and in turn decided to give him a warning and said,” Good sir, you must now that to play with these courts is a dangerous thing, but to the main situation I wish to tell there is a loop hole in the ruling which allows you to challenge their judgment by filling at a district, the court that is directly below this one in rank and is in this city as well, which can allow for you to get another chance to appeal to this court directly and bring your case to them again.”

This latest expression of anti-immigrant bias has raised some eyebrows here in Kahanistan. Certainly immigrants who are coming to such a place as the Scandivnan Empire are the most desperate sort, most in need of social services, education, and public utilities.

For the Scandivnan government to turn away these people in their hour of need is a most despicable and callous act of cruelty. These people are in need of a place to call home and your government spits in their faces.

It is also quite disturbing that the Scandivnan judiciary has apparently relinquished much of its power to help these poor souls to the legislature, which is completely under the Emperor's thumb.

Rather than deport these unfortunates back to the even worse conditions they fled from, I might suggest that they would be happier in Kahanistan; due to a recent war there are many jobs in the area of home construction, general infrastructure expansion, and other forms of unskilled labor.

Immigrants to a nation will nevr be able to contribute as much to society as natives, and in the long run they will probably even be draining on your economy. Immigration can lead to racial and cultural crime, thus weakening the infrastructure of your nation.
If you feel you must let immigrants enter your country, you should force them to serve a six-year tour in the auxiliary forces before granting them a four-year visa, which fordbids them to marry a native in your nation. The visa should only be able to be renewed by serving again in the auxiliary forces.

Casey stood there, his eyes unwavering at the futile warning. He wanted to retort but decided it would be pointless. He thanked the paralegal for the information, gritted his teeth all the while and walked right out of the building. He phoned Leary and informed him of the story, Leary was happy but infuriated at the brazen threatening.

Casey's next move was to the District building. He arrived a half hour later and stepped inside the building, a briefcase in tow. with the appeal.

The two guards startled Casey who paused for a moment then presented the documents they demanded.
"All my papers are in order" he said sarcastically. This reminded him of the Nazi's and WWII.

Leary and Jennifer continued to pour over the trial transcripts, the case was unfairly put against them. The Imperial Courts were known for such things, now they had to fight their way back up through the court levels. Leary was on the phone and Jennifer began the paper battle of filing motions, requests, and such.
"The red tape seems especially thick today" she said as she set the reciever down and leaned back in her chair.
"It's just going to get tougher" Leary replied.

As the red tape increased the Empire had just made another move in which Parliment declared it legal to automatically deport immigrants who commited crimes if enough proof had been presented. As well, the arrests of illegal immigrants had grown expontieally.

The guards looked at the papers and everything was in order and one of them said," Sorry for the inconvenice, but we use this to prevent to many people from entering ever since it has become some what of a fad amongst the 'fans' of the criminals on trial to come in and in many cases attempt to cease the court session by force."
