International Extradition Treaty

The Kedalfax office of foreign affairs, in association with The Digital Network, is proud to announce the completion of the International Extradition Treaty. The treaty is an agreement made in an attempt to further justice, even across international boundries.

If your nation agrees to the terms of the treaty, it may sign. It is open to UN and non-UN members alike.

Sorry I didn't say this in the last post, but I got to scoffs and figured that the rest wasn't worth reading. Look, this treaty is not for everyone. In case I haven't made this clear, you are not affected by it unless you sign it. It's not like one of those UN resolutions that 49% of the nations vote against, but you still have to follow. This is entirely voluntary. There is no need to sanction anybody. However, I had not even heard of you until now, so I really don't care.

The Government of Mondoth is interested in this treaty, however we do have some reservations to be addressed before we sign.
First, Mondothian law includes several 'Refugee Acts' that give provisions for giving foreign nationals, who in some cases might be considered criminals by their home nation, immediate citizenship with all rights and priveldgies thereof. We are wish to know whether this treaty would require us to extradite a erson granted citizenship under one of these Refugee Acts.
We also wish to know if we would be required to extradite persons to nations we are currently at war with. And Finally, we wish to know whether we would be required to extradite foreign defectors to our nation, in or out of war.

Part 1: Yes, I am pretty sure it would, but only if the refugee committed the crime in another member language.
Part 2: As I look this over, I notice that I had not mentioned that. I think that you would, but I also think that would be a good ammendment. Remember that you can't vote on an ammendment without being a member.
Part 3: You would not be forced to take people in. If you wanted to try them for these crimes, you would be allowed to, but if you didn't, you wouldn't have to.


As to you, Eonopolis, I would like to respectfully ask that you no longer post in this thread. You have made the point quite well that you do not like the treaty, so no more further contributions are nececcary. And by the way, while I am no English major, my command of the English language is quite good, and it is more than likely that any error you may see is probably a typo, as my command of typing is nowhere near what I would like it to be.

Ammendment 1: Extradition Durring Time of War
If two signing nations are at war over issues not relating to the treaty, the treatment of criminals, or the judgement of guilt, the nations may refuse extradition of criminals to the warring nation. If a nation is beleived to be violating the treaty, including statements on the judging and treating of criminals, the nation can be suggested for ejection by placing a resolution on the talk page.

AFter due consideration, The Mondothian People have decided not to sign this treaty. Though we believe strongly in justice persuing criminals over national boundaries and will endeavor to cooperate with the signatories of this treaty in all possible instances, we cannot in good concience agree to extradite any person falling under the protection of the Refugee acts as these people havebeen denied rights as human beings in their home nation and have come to Mondoth in order to escape that persecution. While we do not believe any member of this treaty can or will persecute its people in any way that would make them elgible for Refugee ac protection, the lack of any prequisites in this regard for entering ito this pact is a concern that we cannot ignore.

The PDSRA would like to sign and support this treaty, but sadly we cannot do so, due to a point of detail. Any defendent extradited to Ariddia would not be tried by a jury of his or her peers, because that is not how our judiciary works (http://ns.goobergunch.net/wiki/index.php/Ariddian_government_and_judiciary#The_Judiciary) (see mainly the third paragraph).
