Crime Agreement for all countries (UN and non-UN)

The Multiland Leadership, in trying to prevent people from evading punishment for their crimes, proposes the following formal agreement:

MULTILAND: PROPOSAL FOR EXTRADITION AGREEMENT

Naturally, it is necessary that citizens of Multiland are not able to escape prosecution by leaving the country, just as it is necessary that citizens of other nations are not able to escape prosecution by entering Multiland. Of course this means that a formal agreement is beneficial to both Multiland and other nations.

I therefore propose the following draft:

1. Multiland will enter into law that any person in Multiland who is wanted in connection with a serious crime committed in your country shall be extradited, at the request of your government (unless they are also wanted by Multiland officials in connection with a crime, in which case negotiations are to take place if your government requests this).

2. In return, it would be entered into your law that any person in your country who is wanted in connection with a serious crime committed in Multiland shall be extradited, at the request of the Multiland Leadership (unless they are also wanted by your country's officials in connection with a crime, in which case negotiations are to take place if the Multiland Leadership requests this).

3. Noting that extradition proceedings can be costly and that officials may not want to use resources prosecuting minor crimes when a person has left the country, extradition proceedings or extradition negotiations will only begin if a specific request is made.

This is only a first draft version, feel free to either agree to it "as is" or to amend it as you feel necessary and post the revised draft. Once Multiland and another country have agreed on a general draft, both countries can then enter their draft into law. Of course, the draft between Multiland and another country may be slightly different, because some crimes may be classed as serious crimes in the other country, but not in Multiland, or vice versa. The country would extradite the person based on what the country requiring extradition considers a serious crime.

The activities considered serious crimes in Multiland are:

ALL unconsented-to sexual acitivities
Sexual activities between a person under the age of 16 and a person who is older than that person by more than 3 years
Sexual harassment
Murder
Importing non-vegan products without consent, except where this is specifically allowed by law
Importing non-vegetarian products, except where this is specifically allowed by law


Note: For the purpose of Multiland Law, where applicable, animals are treated in the same way as humans and therefore have the same rights and responsibilities, where applicable.

We would agree to this, but your laws are silly. No vegan products? Are you mad? If anything, we'd defend them from that kind of charge!

The Imperial Shogunate of Pschycotic Pschycos finds this to be a grand idea and shall willing take part in such an agreement with one exception. Any person seeking refuge in our nation for violation of your reform laws shall not be handed over to your government. Instead, he or she will be flown to a nation that allows immigration and shall be allowed to start a new life there.

Pschycotic Pschycos, erm... not much of an agreement really is it? :confused: Your kind of "agreement" would of course mean that we would also be unable to send back any person fleeing from your country after breaking your laws, even where those laws relate to serious crimes.

Pythogria, the two importation restrictions referred to are because in Multiland, animals are considered to be as important as humans. Therefore, importing products that are a result of harm to animals is to take part in cruelty to animals - something which is not allowed in Multiland unless absolutely necessary. That is why we do not want anyone to import any products into the country that are NOT vegan, of course ALL vegan products are allowed.

We would therefore request that you reconsider, however, if you are unable to, we would request an agreement that does not include the restriction on importing non-vegan goods.

Findan, we are somewhat bewildered. Multiland has never imported animal products (except vegetarian products, even when those products are not vegan, in specific circumstances). How would asking you to return people who break those two importation laws hurt you?

I will back you and stand by you on your agreement, i believe a nation should be able to punish their own criminals and a nation should stand strong in there beliefs.

Thank you Talimakaka. If you list the crimes considered serious in your country (or considered serious enough for you to expect them to be returned if they escape your country), the Multiland Leadership shall decide whether we are willing to return your citizens for such crimes and the agreement will be completed. :)

Attorney General Jonathan Cochrane didn't get much in the way of post from other countries except the occasional demand from countries most civilised nations considered tinpot dictatorships that demanded extradition of someone for committing "crimes" that were anything but in Sarzonia. His usual practice was to send those nations a letter telling them that the Incorporated Sarzonian Government had granted exile to said "criminals," not giving those nations much ground to stand upon.

This, however, was different. He opened the letter and read the contents of the extradition agreement carefully. The part about importation or exportation of non vegetarian products seemed strange to Cochrane, even for a man who was used to dealing with the vagaries of international laws that rarely made sense.

"Hmm, these people don't seem like butchers," he said out loud. He corralled Lieutenant President Nicole Lewis and asked her opinion on the measure.

"We don't have extradition agreements in place with anyone, do we," she asked.

"We have unofficial rules in place with certain allied nations," he said. Everyone knew what that meant. A Praetonian escaping prosecution in his Imperium would not be making a wise move trying to escape to Sarzonia. Nor would a recalcitrant Isselmerian-Nielander subject. However, other allied nations with similar laws to Sarzonia's would have their criminals extradited as a matter of course unless the person involved committed a crime in Sarzonia or its territories.

"Do you think it'd be a good idea to sign this," Lewis asked.

"I think it'd make sense for us to, though I'm not sure about the issue with non-vegetarian products. The sexual harrassment rule seems a bit severe considering how minor some forms of it can be," he offered.

"I suggest opening up an avenue to negotiate with Multiland," she said. "This sort of agreement would make things easier for us to decide on what basis to accept or reject extraditions."

"Very well, Madame Lieutenant President."

Cochrane then sent a letter to Multiland's leader.

Greetings from the Incorporated Sarzonian Government,

We have read through your extradition agreement and, while we find the document to hold much promise, we are concerned with two of the provisions. Namely, the provision involving the importation or exportation of non-vegetarian goods and the provision relating to sexual harrassment.

The Incorporated Sarzonian Government abhors sexual harrassment and chooses to prosecute it to the fullest extent of the law, often resulting in required reparations being made to victims of such harrassment. However, to label a person who pinches another's buttocks with the same sort of stigma attached to a statutory rapist or a murder seems to our government to be rather cruel and unusual punishment, to quote an arcane document.

We would agree to the remainder of the document, though we would appreciate a response to the areas in which we have concerns. Looking forward to your reply,

Sarzonia, the Multiland Leaderhip are currently considering your concerns and will reply shortly.

Tokaleu, we are happy to enter into an agreement with you if you list the laws which would require extradition, so long as we do not object to them (for example, we would object to certain laws against freedom).

Dear Mr. Cochrane.

We have received your letter and understand your concerns. However, we would like to make it clear that there is a SEPARATE offence for crimes such as rape and sexual assault, therefore a person who had committed the crime of Sexual Harassment would not automatically be labelled a rapist.

In addition, the Sexual Harassment Act covers only actions that are carried out after the victim has asked the perpetrator to stop due to the action being previously carried out and the victim not wanting it. Therefore, it is continuous sexual harassment or serious sexual harassment (for example, harassment that is severely upsetting) that is covered by this Act, not a one-off pinch on the buttocks. A pinch on the buttocks is dealt with separately in another Act.

Sexual Harassment, when continued after a request to stop, or when it happens on a regular basis or very often, can destroy a person’s life almost as much (or even as much) as a forced sex act can. The Sexual Harassment Act deals with this, but does not criminalise a person for pinching someone on the buttocks as a one-off.

We can not allow the importation of non-vegetarian products as to us, this would be the same as bringing dead humans into the country, as we value human and animal lives equally. To import non-vegetarian items would be as much of an upset to us as bringing a dead human to eat would be to many other countries.
