Declaration of Statehood, State & Individual Rights in the
Democratic Republic of Nottinghamshire State
Preamble
We the People of the Democratic Republic of Nottinghamshire State, striving to develop and enhance our lives and the lives of our national family, do hereby establish this document outlining the basic rights and structures of our Democratic Republic, in order to further the course of promoting liberty, justice, wellbeing and social inclusion for all citizens.
Article 1: The Legislative Branch
1) The Democratic Republic of Nottinghamshire State shall vest its legislative powers in two seperate legislative bodies, to be known as the National Parliament and the National Senate individually, and as the National Assembly when referred to collectively.
Section 1: The National Parliament
1-1A) The National Parliament shall comprise the lower house of the National Assembly, and shall be the first legislative body through which legislation shall be proposed, debated and voted upon.
1-1B) The National Parliament shall be comprised of Representatives from each District with the Democratic Republic, and shall be known as Members of Parliament (MPs).
1-1C) MPs shall propose and debate legislature and ammendments to legislature within the National Parliament, and vote upon proposed legislature as to whether to pass said proposal to the next level of the legislative body.
1-1D) MPs shall be elected every five years as part of the democratic representative election process of the Democratic Republic.
Section 2: The National Senate
1-2A) The National Senate shall comprise the Upper House of the National Assembly, and shall be the second legislative body through which proposed legislation shall be debated and voted upon.
1-2B) The National Senate shall comprise Representatives of each State in the Democratic Republic, and shall be known as Members of Senate (MS).
1-2C) MS's shall debate and vote upon proposed legislation and ammendments to proposed legislation passed to the National Senate from the National Parliament.
1-2D) In the event of the National Senate voting in a majority against the proposed legislation, or voting in favour of ammendments to the legislation, the proposed legislation shall be passed back down to the National Parliament in order to be debated again.
1-2D) MS's shall be elected every five years as part of the democratic representative election process of the Democratic Republic.
Section 3: Legislative Checks of the Executive
1-3A) The National Assembly will be empowered with the ability to propose and vote upon a motion of impeachment against the Executive Branch as a single body rather than two seperate houses of Legislature.
1-3B) The National Assembly shall have the power through this motion of impeachment to authorise the investigation of the Executive Branch's actions through the use of the Judicial Branch.
Section 4: Legislative Checks of the Judiciary
1-4A) The National Assembly shall be empowered to overturn Judiciary decisions upon constitutional matters if a motion is passed by popular vote and the Executive Branch signs its accent to the motion.
Article 2: The Executive Branch
2) The Democratic Republic of Nottinghamshire State shall vest its Executive Powers in a President of the Democratic Republic.
Section 1: Powers of the President
2-1A) The President of the Democratic Republic shall be elected in seperate elections from the National Assembly, with these elections to take place every five years.
2-1B) The President of the Democratic Republic shall provide the Executive Assent for Legislation passed by the National Assembly by either signing the Legislature into law or vetoing the Legislature.
2-1C) When the President of the Democratic Republic vetos Legislature and sends it back to the Senate, it may be overturned and passed into Law by a two-thirds majority vote in favour of the Legislature.
2-1D) The President of the Democratic Republic will be empowered with the authority to declare war on foreign nations and organisations.
2-1E) The President of the Democratic Republic will be empowered with the authority to exercise the use of special weapons, defined as Nuclear, Biological and Chemical weapons.
2-1F) The President of the Democratic Republic shall be empowered to accept or deny the credentials of Foreign Diplomats, and to appoint Diplomats of the Democratic Republic to foreign nations and organisations.
2-1G) The President of the Democratic Republic shall by the Commander-In-Chief of the Armed Forces and the final authority on military matters.
Section 2: Executive Checks of the Legislature
2-2A) The President of the Democratic Republic shall have the power to dismiss the National Assembly if both a motion of Dimissal passes the National Assembly and the Judiciary agrees upon the legality of this Dismissal.
2-2B) The President may request the Judiciary to impeach and investigate any member of the National Assembly due to unconstitutional actions.
Section 3: Executive Checks of the Judiciary
2-3A) The President shall appoint five people to the Judiciary in order to examine the actions of the two other branches.
2-3B) The President shall be entitled to dismiss the Judiciary if the majority of the Judiciary agree and the National Assembly passes a vote agreeing with this move.
Article 3: The Judicial Branch
3) A Judicial Branch of the Government shall be appointed to oversee the Constitutional legality of activities by the Legislative and Executive Branches, and shall be known as the Supreme Court.
Section 1: Powers of the Judiciary
3-1A) The Judiciary will be empowered to investigate upon request the constitutional activities of the Executive Branch and the Legislative Branch, either in whole or as individuals.
3-1B) The Judiciary shall rule upon laws passed by the National Assembly and the President as to whether the laws are Constitutional or not.
3-1C) The Judiciary may rule that laws are Unconstitutional and send the Legislature back to the Upper House for further ammendment and debate.
3-1D) The Judiciary shall comprise five Supreme Court Judges appointed by the Executive Branch and approved by the National Assembly in a majority vote.
Section 2: Judicial Checks on the Executive
3-2A) The Judiciary shall be entitled to impeach, investigate and dismiss the President at the request of the National Assembly passing a motion of Impeachment regarding the President's constitutional activities.
Section 3: Judicial Checks on the Legislative
3-3A) The Judiciary shall be entitled to impeach, investigate and dismiss the National Assembly or members of the National Assembly at the request of the President and deemed legal by the Judiciary itself.
