International Trial (open)

Kanami
16-02-2006, 01:43
Long and hostile situations have been going. Under the scope of the pulbic attention Kurona, Stevid, Hiraki, and the Soviet Leaders, became intrapped in a difficult Cold-War. Soon enough it evolved into a hot war, when a Soviet Missile was launhced at a Civilian city in Kurona. A port city, coasting thousands of deaths. At first the situation was blamed on the Government of the Soviet Leaders, but now it has been descoverd that it was the gross negalgence, and malice of an irresponsible Submarine Captian. Now it's time for this Captain to face justice, on the international level. We encourage any one to join the trial, be it a spectator, judge, or press member, many should here this case.

CASE #: Case #:41543817-056NC (KNM COURT #)

The Republic of Kanami, Hitoshi Sharon, The Principality of Kurona, Princess Tomoyo Mikanu, The Country of the Soviet Leaders

vs.

The Soviet Captain

List of charges:

Crimes Against Humanity

Crimes Against Peace

Tresspassing in Territorial Waters

Genocide

War Crimes

Obstruction of Justice

Misprision of felony

Justice Taku Himura IV stood before a swarming press

"Good morning. This trial could be long or could be short. Basically under international law, one is entitled to due process of law. This applies to even the most hanious of crimes. But what this trial is about, is a captain who ruthelessly attacked a nation during peace time. Who bated two nations into war, by commiting acts of forgery to make both belive they we're enemies. This man feels no real guilt for his actions, but it's our job to deliver justice. My intent is to prove that these acts we're committed with malice, and people are suffering as a result. Testimonies, evidence, and witnesses. From the Kuronan Princess, to the Soviet Leaders themeselves. Thank you."

SIN (Stevid International News)

We give you some breaking from Kanami. As many of you veiwers will be aware of the crimes committed by a Soviet Leaders Submarine Captain. For those who are not aware of the situation, this submarine captan was put on trail generally for the mass murder of innocent civilains belonging to the nation of Kurona. A nation that has only just started recovery from one of the most terrible natural disasters in history. The submarine captain launched a missile at a coastal city which was promtly destroyed by the explosion. This, amoung other charges that will be addressed by the court, is why the naval captain is under the hammer of the judge.

But this is only the tip of the ice berg. It seems that the captain was working alone and not under orders from naval command which is deeply distressing to the whole world. That this man knowingly and willfully committed such a bloody act in cold blood.

Stevid has a very important stand in all of this. The submarine on which the naval captain on trail was on, was damaged quite badly by an unknown submarine. Stevid has for the first time in almost fifty years admitted the whereabouts and actions of a particular submarine. The Admiralty claims that one of there nuclear submarines that remained behind after the natural disaster was in the area and engaged in comabat with up to two enemy submarines. The Skipper of Stevid's submarine claim that he forced one submarine to international waters and damaged another one so badly that it was forced to surface. Stevid at the moment is unaware of the identity of the first submarine but the second was defintly a Soveit Leaders submarine, now identified as possibly the one that launched the missile attack.

Bearing this in mind, Stevid has sent the Captain of their Submarine to the court hearing as a witness against the Soviet Submarine Captain.

Also, a member of the Stevid population is said to be in the jury.

We will provide continous coverage of Courst hearing on SIN/24 where over time you will see the court case unfold, we will also give you full coverage on this channel when the Stevid Submarine Captain presents his evidence against the Soviet Leaders Catain to the court......

Please Stay Tuned......

Princess Tomoyo walked in, along side her, a victem of the attack by the soviet submarine. Anya Toma, was bandaged up pretty heavily. Her arm was in a sling, and cast, her left eye had a patch over it, her head was even bandaged. Frightenlly enough she would be first to testify.

Do you solemnly swear that you will tell the truth the whole truth and nothing but the truth, so help you God?

"I do."

Please be seated

She was asked to state her name for the court.

"Anya Chrissie Toma. I lived in Tidal City at the time of the attack."

Please explain the events of that day.

"There is no way I can forget. It was miday, I had sat down to lunch with my parents, when we heard a loud roar. Two thoughts sturck my mind, a twister, or a tsunami. Then a flash. My father I belive dove to protect me, as for my mother I don't know."

When you we're put into care, what we're the extent of your injuries?

"I had burns over 20-30% of my body. Several broken bones, the shock wave threw me, and they say it is possible that I might suffer from Radiation Poisining."

At first did you think this was something narutal?

"Well I don't consider my self a weapons expert, but I know what atomic bombs do. At first I thought it was a tsunami, but I remeber the flash, and the fact that their was no water, would indicate. A lot of debries was on fire, or disintergrated. People we're horibbly burned all over, there was so much confusion and chaos, and i was scared, and alone, I didn't know what to do. It seemed like no one wanted to help. " she began crying

Thank you.

"Would you like to step down?"

"I'm okay."

"Your sure?"

At this time cross examanation is allowed, if no cross, then the witness will step down, and the prosocution will continue.

Would you please state for the court your involvement

"Well when the Kurona made the request to the Kanami Government to aid in watching over the odd activites in Xanadou the assingment was turned to me. Now my job was to send in a RECON air-plane to see who and what was involved in these odd circumstances."

What was descoverd

"Well, we found several countries we're sort of chasing eachother in sort of 'cat and mouse' sub-marine warefare. No one had fired any shots. We we're picking up conversations of several nations, analyzing dialects, intercepting coded messages, and trying to determine who was lurking in the waters. We found several nations we're involved including the soviets and we made a note of it.

did you notice any Subs that we're peculier, or odd?

"There was one, we weren't sure who it belonged to, but it wasn't doing much for a while, then it surfaced, and the red flags went up. We had warnings of SAM's ICBM's, anything that a sub might have poised for combat. The next thing we knew a city was demolished by an attack. We reported it to the PM, and of course he decided to aid Kurona against the Soviets. This was of course before anyone knew it was a stray.

it could of been another sub?"

"The plane was flying at about a crusing altitude less than 10,000 ft. We had several high-frequency, Orbitor Electronic Spy Listening Device or ORESLD's. If you have ever seen thoes tiny dishes and headphones that can allow you to hear things from over 300 ft, they are basically thoes, only 12x more powerful. Now I can't give you a lot of detail, because some of the thigs we do are classifid, but I can tell you, we are experts in not only eaves dropping, but we are also linguest masters. We made out Russian dialects and langues, and we kind of went from there. As to how we singled it out to a Soviet Based sub, we kind of snooped around legally mind you, through national headlines, publiched military reports, to see who might be doing something they are not, or missing something."

"We call to the stand, Dr. Neko Tomoson, he is an expert Health Pysist, in Radiation Contamination. Doctor, when you examine Tidal City, did you dind dangerous amounts of radiation?"

"Yes, they measured to be about 2–3 Sv of Exposure. Now that is Severe radiation poisoning, 35% fatality after 30 days (Lethal Dose 35/30). Nausea is common with 50% risk of vomiting at 2.8 Sv. Symptoms onset at 1 to 6 hours after irradiation and last for 1 to 2 days. After that, there is a 7 to 14 day anastasis, after which the following symptoms appear: loss of hair all over the body (50% probability at 3 Sv), fatigue and general illness. There is a massive loss of leukocytes, greatly increasing the risk of infection. Permanent female sterility is possible. Convalescence takes one to several months."

Could these have very well likely come from a atomic weapon?

"Absolultey. Fall out is a major cause of this. Seeing as Kurona had no nuclear plants, it is unlikely it would come from something like a melt down."

Could this increase over time?

"I can't say for sure, heaven forbid this ever reaches more than 80 Sv >8,000REM, you know almost instant death."

Thank you, no further questions

"I'm concerend about the Captain, if the foold dies, it's unlikely any justice will be served."

"Well he's reported in stable."

"But critical."

"Well if he does survive to take the stand, the cross-examination will be brutal. I wonder when they will call some of their own witnesses."

"I doubt there are any." He chuckled

"Well chances are, they have someone to back them up."

"We'll see."

"We just got a new witness Captain Paul Drake, of the Stevid Fleet. He'll testify."

"Excellent."

“The court will now hear the Captain of the Stevid Nuclear Submarine, Captain Paul Drake, bring forth your evidence before the court.”

The captain stood up from his chair near the front of the court room and straightened is naval uniform and put on his ceremonial cap and walked purposely front towards to the box from which he would be speaking from. He was nervous; it would be the first time in almost twenty- five years that the Admiralty admitted to having a nuclear submarine in one given location on the globe. Stevid’s submarine force was listed as one of the least known forces in the world because of the strict policy of secrecy, especially with nuclear submarines. The submarine captain had been part of the task force sent to aid Kurona during the great Storm however; neither Kurona nor Kanami had been informed of this (seeing as Kanami and Stevid were at each other throats only a month before the incident). Now, Drake had to admit everything that had happened, something he thought he’d never had to do. He had been told by the Admiralty just to disclose information on his submarines movements and actions relevant to the court case- no matter what questions the defence were going to ask.

He now stood before the courtroom in the witness box and removed his hat and placed it on the side. Before the questions were being asked.

“Captain Drake. You confirm that you are the Captain of an actual Stevid Nuclear Submarine?”

The captain twitched slightly at the question but told himself that it was now okay to divulge information that was, only thirty seconds ago, some of the most classified information Stevid had in it’s deck of political cards.

“Yes sir, that is correct- Captain Paul Marcus Drake of a Nuclear Submarine in the Royal Navy of Stevid.”

“I see thank you. But first, slightly going off on a tangent, could you tell the court why now, of all times the Admiralty has decided that you should come forward and give away details that you and your nation have kept secret for decades?”

“The First Sea Lord informed me that since we were in direct combat in Kurona waters and that I saw and partially responsible for allowing the enemy captain to press the “Red Button”, I was thought that I should come forward in the interests of those who died and survived in Kurona.”

“A Noble cause I suppose. So firstly… we have had one witness from Kanamian Air Force Pilot speaking about multiple submarines playing a cat-and-mouse game under water below a stricken submarine on the surface. Can you confirm this? If yes then explain to the court what was really happening down there.”

The captain shifted his position slightly and shunted his memory back trying to recall all that happened that fateful day…. He nodded and began to speak.

“That is true. A Stevid submarine was in the area and we managed to sustain little damage after the eruption of the under water volcano. We raced into Kurona territorial waters in an attempt to meet up with the Stevid frigate HMS Lancaster. We then detected and enemy submarine- I’m sorry but I cannot recall the nationality of the vessel. It was surfaced and over the course of a few hours we sat there just watching the vessel. Before Kurona or Kanami, I cannot remember which- perhaps both, entered the area and circled the surfaced submarine. Uh- after that the senior officers and me had dinner before returning to the bridge. We were about to leave for the HMS Lancaster when we all heard the tone of a SONAR ping bounce off our hull that made one or two of the control room crew jump. We all assumed it came from the surfaced submarine but my first officer wasn’t so sure. We ordered a SONAR ping in return and we got a picture that showed a lump jutting out of the side of the surfaced submarine- that, we concluded, meant that there was a submarine underneath the surfaced one attempting to evade detection.”

He paused and stayed silent in thought before he was asked more questions.

“Okay then Captain, that seems clear, did this continue until one of you withdrew?”

Drake shook his head swiftly. “No sir, no it did not. The pinging continued for about five minutes before the other submarine made a break for it, it became obvious to us that they were not supposed to be there. We pursued them away from the area, continuing to ping them to re-verify their position and ours. We them modified our torpedoes to detonate before impact so that we could damage their submarine enough to make them surface. We fired two torpedoes, they then pulled off some great manoeuvres and took less damage than we anticipated.”

“When did the Soviet Leaders submarines appear Captain Drake?”

“About five minutes after the torpedoes detonated… They opened fire on us- we pinged them before hand before they attacked us.”

“Were you hit?”

“No sir, we evaded the torpedoes they fired before firing modified torpedoes out of the aft tubes- both exploded five metres from the Soviet subs. They surfaced and we continued our pursuit of the first submarine. We eventually lost them as they ventured out of that particular Theatre War, they used Kurona civilian shipping lanes to lose us. We turned back to Kurona waters.”

“What of the Soviet Leaders submarine? Was it there when you returned?”

“No sir. Gone, we assumed they made VERY temporary repairs. We combed the area but found nothing but debris. After which, we sat tight and looked at the surfaced submarine and allied ships on the surface through the submarine scope.”

“Right, so you lost the Soviet vessels?”

“Yes sir, that’s why I feel some what responsible for the deaths of those in Kurona, I could have finished them off- but….well…”

“Did you witness the missile launch?”

“Yes sir- I did…sir… it took place roughly twenty miles away and I saw it in the corner of my scope. I didn’t see the explosion because I didn’t know whether it was nuclear or not- everybody knows that when you look at a nuclear blast- your blinded for life.”

“Thank you Captain- did you know it was a Soviet Submarine?”

“Yes, no doubt about it. We followed all routes they could have taken out of Kurona waters in the time we were away and they were nowhere to be seen. They were nearer Kurona after they made repairs- they had made an attempt to escape- but rather try to get near enough to Kurona to launch missiles- it was a Soviet leaders vessel and no other.”

“Thank very much Captain Paul Drake- very enlightening I guess. Err….no further questions your honour.”

Drake relaxed slightly and breathed a sigh of relief, but it wasn’t over yet- those had been to easy questions- if the defence were going to cross-examine he might yet be put under pressure. The judge nodded in acknowledgement and turned to the defence.

“You may Cross-examine the witness….…”

"Yes we do your honor."

"How many soviet ships were there and why did you lose one or was it you were
looking at the Suface Sub Called the Red October? Was there any werid noise coming from the subs?"
Stevid
26-02-2006, 23:56
The Captain tilted his head back and looked up at the ceiling and closed his eyes in thought, thinking back to what he saw through the Periscope of the HMS Toddington and on the RADAR screen. He looked back at the Soviet Leaders Lawyer and answered his question.

“I can categorically tell you that we could only confirm three enemy submarines. One in front of us- the fleeing one, and two behind us, one of which we forced to surface. The one that was fleeing launched underwater chaff to cloud our SONAR and RADAR. So if I were to give a definite number then I’d be lying to you. We assumed the undamaged submarine, which you have confirmed to be the Red October, launched the ICBM’s. We damaged the other on so significantly that it would be stupid to launch missiles in case something went wrong. We pursued the fleeing sub before heading back towards Tidal City to search for the enemy- the Red October being the only active submarine we hadn’t damaged to be swimming around that we knew of. I levelled the boat to periscope depth and scanned the horizon. There was a vessel on the surface not far from the main land of Kurona. At the time we didn’t know what type of vessel it was, then I saw the missile launch and I knew it was the enemy submarine we were looking for. It was the only sub missing from the list of underwater targets we compiled from the SONAR pings. Now you’ve admitted that it was the Red October the made the launch- I can safely tell you that I saw through my own, and if I may say so- perfect eyes, the Soviet Leaders Nuclear Submarine Red October launch an ICBM at the Kuronian city of Tidal City.”

He paused for a moment and drink some water from the glass provided in the witness box and downed it all. He sighed and put down the glass before continuing.

“As for the submarine we were previously pursuing, all evidence collected by Stevid Military Intelligence Six (MI6) points towards the presence of a Haraki military vessel. They since haven’t confirmed this with Stevid authorities but I won’t get into that, it isn’t relevant to the case. Your question about the noise, the active submarine-I think- must have had some engine difficulty, they were almost totally silent during the engagement, but afterwards, while we were pursuing the other submarine, it was distinctly noisier than before. I’m no expert on your Navy’s submarine fleet and the technology used so I could say why they were noisier. The fact of the matter is than I can confirm that what I saw was that submarine launch the missile that cost the lives of thousands- I regret not giving the order to blow it out of the water with everything I could throw at it- but I agreed with myself that the boat was in Kuronian waters and they had jurisdiction over the submarine, not the Stevid Government or the Royal Navy.

I hope I’ve made myself quite clear, sir.”

Drake looked at the lawyer for half a minute before turning away and looking up at the judge who, now reading consciously that the speech from Drake had finished continued with the case.

“Do the Soviet Leaders defence have any more questions to put to Captain Paul Drake and/or the court?”

"Please state your name for the record."

"Princess Tomoyo Mikanu, of the Principality of Kurona. I am the current ruler."

"Now Your Highness, could you please state your involvement in the situation that began 6 months ago."

"Well I was informed that a Soviet Sub had been beached on our shores. Now Kurona is not a military powerful nation, and the fact of a nuclear submarine washing on our shores, frightend me. Xanadou it's self is also very isloated, and we don't have much in the ways of international military activite. So as would be custom to any trespassing, we detained the sub captain. Little did we know it several other nations we're getting involved in sub-marine warfare."

"Now you we're aware the nation of Stevid was helping you, correct?"

"Yes, we had recently joined the Empire, as a sign of our grattitude, and hopes for more relations in the world. Now they told us they would help get ot the bottom of this, but they didn't tell us how, they just told us, and I trusted them."

"Now when did Kanami come into play?"

"Kanami is also an ally to us. As far as I'm concerned they have one of the finest intle unit. I wanted them as a thrid party, and to possibly aid if it came to war."

"Now what we're your ships doing?"

"The H.M.S. Raven was attempting to capture a stranded sub from another nation. At this point we didn't care who was who, if you we're in our waters, you we're under aresst. We couldn't afford a hostile attack against us, as we we're still recovering from our worst natural dissaster, in our history, and possibly in the history of the world. Now we had word a hostile sub was ready to attack our ships, so they moved into battle position, but a shot wasn't fired."

"No shots fired, so no reason for the sub commander to attack you."

"Not that I can see. Especially with an Atomic Bomb."

"Now with the Kanami intel provided to you what was descoverd?"

"All these subs we're doing something underwater. I had a hard time understanding it my self, I had to advise my Military Commander."
