The Doctrine of Authority (Earth II)

The following Doctrine shall cover all of Rome's territorial claims and the bounds of the Empire's soverignty.

Section 1- Definitions

For the purposes of this document, "The Soveriegn" and its equvalents (such as "The State", "The Government", or "The Empire") shall refer to the territories as belonging to the Senatus Populusque Romae (SPQR) (OOC: "The Senate and the People of Rome). The SPQR shall be further defined as "Rome" "Roman Empire" and/or "Roman Government" and its equivalents.

"Roman" will be used to define any citizen of Rome and its institutions, including but not limited to the Army, the Government, Foreign Affairs, Educational System, etc.

The Roman Empire is split into 15 Dominions as defined below. All, excluding Utah and Casara, are Parliamentary Democracies. Utah's leader is the head of the Chuch of Latter Day Saints, while in Casara, the Emperor is the only elected official.

Section 2- Borders

1) The Roman Empire hereby maintains a maritime boundary of 24 nautical miles. All waters and airspace up to and including the border are considered the property of the Empire and any violations- including, but not limited to, illegal trespass, act of terrorism, vandalism, etc.- will be treated as an act of war to which the Empire will respond accordingly.
2) No vehicle or person(s) may pass through the border in any form (including by air and sea) without the prior authorization of the Roman Government. Any unauthorized vehicle will be shot down on sight.
3) The Empire maintains a semi-open border, with civilian goods permitted inside the Empire subject to a tariff of 15%, although individual nations may negotiate a lower tariff. The Roman Government reserves the right, without notice, to increase the tariff and to eject any foreign business, equipment or personnel it believes to be contravening the Roman Government, its territories or its interests.
4) Any business interested in entering the Roman market must apply to the Roman Government. Upon entry into the Roman market, it must maintain a workforce of 75% indigenous Romans, and any foreign nationals brought in to lead the branch must only do so in a "training position" for a Roman to take over within a year of establishment.
5) Any foreign criminal(s) and/or criminal organizations found within Roman borders shall be extradited immediately to their home country.
6) Any act against the property or members of the Roman Government, including, but not limited to, Army vehicles, personnel and equipment, diplomatic envoys and Government officials regardless of whether or not they are in Roman territory shall be viewed as an act of war which will be responded to accordingly.
7) The rights extended to a Roman civilian pertain solely to their dealings within Roman and international territory. The Empire seeks not to impose its rights on other sovereign nations.

Section 3- The Tyrrhenian Sea

The Tyrrhenian Sea will be declared territorial waters of the Empire, and will be treated accordingly.

Section 4- Limits of Authority

1) The Roman Government reserves the right to enact any law it chooses on anyone and anything within its borders without any interference whatsoever from any foreign government. Any interference will be treated as an act of war and will be responded to accordingly.
2) The laws of the Government apply only to Government officials regardless of their location, to any person(s) within Roman boundaries and to any Roman citizen in Roman territory or in international territory. Outside of these provisions Roman law does not apply.

Section 5- Diplomacy and Relations

1) Nations who maintain relations with the Empire are granted an Embassy in the City of Rome. The Embassy is allowed to maintain bodyguards but no military personnel of any kind (except Roman) is allowed at the Embassy.
2) Any diplomatic mission must apply for entry into the Empire. Upon entry, diplomats are subject to the laws of the Empire and its Dominions without exception. This article also applies to any diplomats or other Embassy workers who are already established in the Empire.
3) Embassies are subject to extraterritorial rights that are to be determined by the Empire and the national government in question. Regardless, no Embassy or Embassy official shall be used to or be permitted to be in the act of committing any sort of action against the Empire, and any contravenance of this article will be treated as an act of war.

Section 6- The Empire of Casara

The Casaran Empire is a special case in regards to the Roman Empire. Rome recognizes Casara's complete sovereignty and jurisdiction regarding its own affairs (including that of the military) and foreign relations. Any requests for relations and entry into the Casaran market are to be made to the Casaran government, and are to be upheld at the sole discretion of Casara. However, any attack on Casara will be treated as an act of war against Rome, which will be responded to accordingly.

Section 7- Terms of the Doctrine

The Doctrine of Authority shall remain in effect "as is" as of today (January 30, 2006). The Roman Empire reserves the right to alter the Doctrine at any time and without notice.

The Kingdom has, after careful examination of the doctrine found it to be legally binding, and pledges to fully support and respect the doctrine. We commend the Roman Government on its announcing of its rights.

They are as follows: 2 officers (military attaches) and 12 Royal Marines (protection / honor guard detail). Will they be permitted to remain at the embassy, or will we need to fly them home?

If they are to serve as bodyguards then they are permitted to remain. We just don't want a battalion stationed at the Embassy- there are enough Roman troops to secure the area.

QUERY FROM ELEPHANTI AIR FORCES

We are curious as to how Section 2.2 applies to us, specifically our airfield in Sardinia. As our primary military facility in the eastern Mediterranean (Monaco has no airfield), it recieves a fair amount of traffic. Coordinating every takeoff and landing with the Roman Avis (that is what you call your Air Force, correct?) would be time consuming for us both, particularily if a flight was classified (a plane we don't admit we have, for example) We merely seek clarification to prevent any incidents from occuring in the future.

IC:

"Since we already know what vehicles are present at the base and their function, you are not required to co-ordinate your landing with the Avii. We just wish to be notified of any activity should it involve our airspace."

OOC: Indeed. Traditionally, maritime boundaries were adjusted according to the range of guns, if you can believe it. Somewhere along the line, 12 nautical miles became accepted. Well, I pushed for 24 and met instant criticism way back when from Samtonia and the Caribbean occupants. Others doing the same have only legitimated that push. Good stuff!

OOC: I think it only makes sense. You don't want to look like you're weak, and if you're claiming a smaller border than someone else it looks like you can't project as much power as they can.
