The Protection of the Realm Act

Chapter 1: Preamble

§ 1
As a result of sustained uncertainty concerning Cottish foreign relations and defense measures, the Realm has found it necessary to maintain a set of rules concerning Cottish foreign relations and protection. This is found necessary due to the fluidity of the Balance of Power arrangement and the ever changing geopolitical landscape of the Earth.
This set of rules will be constantly up to date and coherent with the ever changing Earth.
§ 2
This set of rules will be set up by the Council of the King and confirmed by the Storting in session.

Chapter 2: Maritime Regulations

§ 3
The Realm of Cotland shall maintain a maritime boundary of twenty-four (24) nautical miles or fourty-four point fourty-five (44.45) kilometers.
No foreign warship or vessel with affilitation to the Government, whether it be friendly, neutral or hostile is permitted into that zone without prior authorization from the Foreign Ministry and/or the Defense Ministry. This includes all surface or sub-surface vessel, civilian and military.
Any foreign warship entering the maritime boundaries of the Realm without the necessary permissions will be considered hostile and sunk.
The rules of section 2 and 3 shall not apply to surface warships belonging to member states of the October Alliance
§ 4
Any foreign vessel caught in the act of, or under suspicion of espionage against the Realm inside its maritime boundaries will immediately be boarded and inspected, regardless of its actions.
Refusal of inspection will lead to the vessel in question being considered hostile and captured, sunk or both.
Any vessel outside of the Realms maritime boundaries suspected of espionage against the Realm will be monitored and subject to inspection.
The Realm reserves the right to act in self-defense against any belligerent foreign vessel.
§ 5
The presence of hostile or belligerent submarines, particularly those capable of tactical or strategic weapon deployment inside the Realms maritime boundaries will be sunk upon detection.
§ 6
The use of civilian vessels for military duty or espionage will be considered hostile.
All civilian vessels passing through the maritime boundaries of the Realm are subject to random inspections of the defense force of the Realm.
§ 7
In cases where the maritime boundaries of the Realm violate the maritime boundaries of other sovereign states, especially in terms of proximity, the Realm shall take the distance between the beginning of each boundary and allow for a one (1) nautical mile or one point eight-five-two (1.852) kilometer area, at the middle of this distance, whereby no maritime boundary exists. Such waters will be considered international waters.
Any acts of espionage or violations of the aforementioned sections in this narrow passage will not be considered in international waters. These waters are only for civilian use.

Chapter 3: Airspace Regulations

§ 8
The Realm shall maintain an airspace boundary of twenty-four (24) nautical miles or fourty-four point fourty-five (44.45) kilometers.
No foreign military aircraft or aircraft suspected of espionage, whether it be friendly, neutral or hostile is permitted into that zone without prior authorization from the Foreign Ministry and/or the Defense Ministry.
Any such aircraft entering the airspace of the Realm without prior authorization will be considered hostile and destroyed.
This shall however not be in effect if said airspace intrudes on the airspace boundary of another sovereign state, in which case the boundary shall go along the ground border.
The regulations of sections 2, 3 and 4 shall not apply to military aircraft belonging to member states of the October Alliance, as long as their mission do not violate the sovereignty of the Realm
§ 9
All civilian, international flights from foreign countries will be allowed entry to the Realm, provided they do not stray out of the designated civilian air corridors arranged by the Realm.
No civlian aircraft is allowed entry to the airspace of the Realm without filing a flight plan to the appropriate authorities. Any foreign civlian aircraft entering the airspace of the Realm will be considered hostile and dealt with accordingly.
Any foreign civilian aircraft used for non-civilian purposes will be regarded as hostile and dealt with accordingly.
§ 10
Any spy aircraft violating the airspace of the Realm will be shot down accordingly.
Any spy aircraft flying outside of the airspace of the Realm will be intercepted and escorted along its flight path to ensure non-deviance into the airspace of the Realm. Intercepted is defined as visually identified but not engaged. Engagement of foreign aircraft outside of the airspace of the Realm will only occur should it be a clear and present danger to the Realm.

Chapter 4: Ground Regulations

§ 11
The Realm of Cotland maintains a closed border. No person or vehicle may cross the border without presenting legitimation and valid entry visas to officials of the Realm, undergoing a thurrough search of his/her person and belongings and obtaining authorization to enter. Failure to comply will result in denial of entry into the Realm.
The rules above does not apply to border with the Holy Republic of Hawdawg. Here, one wishing to pass over the border needs only to present a valid passport issued by a nation state recognized by the Realm when crossing the border. One is still subject to random customs searches when crossing the border.
No person shall be permitted entry to the Realm unless they are citizens of a nation state recognized by the Realm of Cotland.
§ 12
Any acts of espionage against the Realm on the border will be dealt with accordingly.
Any person arrested when spying against the Realm is subject to the harshest punishment of the laws of the Realm.
§ 13
Any illegal border crossings by foreign nationals or individuals will be dealt with accordingly. Illegal border crossing is a crime under the laws of the Realm and may result in prison sentences or harsh fines, depending on the situation.
In the case of foreign citizens violating the rules in the first section, after punishment has been issued, they will be permanently banned from the Realm.
Any person attempting to enter the Realm illegally after having already been banned from the Realm is subject to the penalty of death.

Chapter 5: International Areas

§ 14
The naval assets of the Realm reserves the right to maintain constant patrols in international waters.
§ 15
Any engagement or attack against any aircraft, unit or vessel belonging to the Realm in an international zone will be regarded as an act of war against the Realm.
§ 16
Any infringement upon the passage of any aircraft, unit, or vessel belonging to the Realm through an international zone will be dealt with accordingly and unfavorably.

Chapter 6: Space

§ 17
The presence of orbital weapons platforms in static orbit over the Realm shall be considered a violation of the safety and security of the Realm. They will be engaged accordingly and if necessary, destroyed.
§ 18
The presence of any static spy satellites or non-civilian satellites in orbit over the Realm will be regarded as a violation of the safety and security of the Realm. They will be engaged accordingly and if necessary, destroyed.
§ 19
The identification of any extraterrestrial body that could cause mass damage or destruction to the planet, the Realm included, shall not be withheld from public notification. Any bodies identified by the Realm will be made public and should they be deemed necessary to destroy, the Realm will put fourth its best efforts in the matter.

Chapter 7: The October Alliance

§ 20
The October Alliance consists of the following members: The Realm of Cotland, The Commonwealth of Hirgizstan, The Insurmountable Empire of Layarteb, The Fourth Reich of North Germania, The Armed Republic of Soviet Bloc, and The Holy Republic of Hawdwag.
§ 21
As per The October Alliance charter, "If one nation is attacked we are all attacked."
Therefore, if any member of The October Alliance is the subject of offensive operations it shall be regarded as an act of war against the Realm.
In the event of an offensive operation against any member of the October Alliance, the Realm shall commit itself to assist in the destruction of the forces attacking its ally in the form of, but not limited to, military, financial and/or diplomatical assistance.
The Realm shall maintain military installations in the member states of the October Alliance, and commits itself to allowing the member states to do the same within the territories of the Realm.
§ 22
Any infringement upon the interstate relations of any members of The October Alliance shall be regarded as an infringement upon the Realm, even if they do not directly include the Realm.

Chapter 8: Terrorism

§ 23
Any acts of terrorism aboard vessels belonging to or registered in the Realm, whether inside or outside of the maritime boundaries of the Realm will not be tolerated.
Should it be found out that these acts were sponsored by a sovereign nation, it will be regarded as an act of war against the Realm.
§ 24
Any acts of terrorism aboard foreign vessels inside of the maritime boundaries of the Realm will be dealt with accordingly by the Realm. Should it be necessary to take action and protect the people and property of the Realm, it shall be done without delay.
Any acts of terrorism aboard foreign vessels inside the airspace of the Realm, sponsored by a sovereign nation, will be considered an act of war against the Empire should it be surmised that the act was directed against the Realm with intention.
§ 25
Any acts of terrorism aboard aircraft belonging to or registered in the Realm, whether inside or outside the airspace of the Realm will not be tolerated.
Should it be found out that these acts were sponsored by a sovereign nation, it will be regarded as an act of war against the Realm.
§ 26
Any acts of terrorism aboard foreign aircraft inside the airspace of the Realm will be dealt with accordingly by the Realm.
Should it be necessary to take action and protect the people and property of the Realm, it shall be done without delay.
Any acts of terrorism aboard foreign aircraft inside the airspace of the Realm, sponsored by a sovereign nation, will be considered an act of war against the Realm should it be surmised that the act was directed against the Realm with intention.
§ 27
Any acts of terrorism directed against the border of the Realm or through the use of vehicles entering the Realm legally will be dealt with accordingly. Should they surmise to be the direction of a sovereign state; it will be regarded as an act of war against the Realm.
§ 28
The Realm of Cotland shall maintain as its principal policy that it shall not negotiate with terrorists.

Chapter 9: Sovereignty

§ 29
The Realm, in order to protect itself from internal attack, retains the right to deport any group(s) of foreign nationals without cause or justification.
§ 30
The Realm considers all actions it undertakes within its borders protected under our sovereignty. No foreign power, whether friendly, neutral, or hostile, is permissible to interfere with internal affairs of the Realm of Cotland, regardless of actions. Any interference will be met with serious repercussions.
§ 31
The Realm reserves the right to remove diplomats as well as foreign nationals without justification.
§ 32
Any foreign, sovereign state found to be aiding and abetting an insurgent group within the Realm or acting against the Realm will be regarded as hostile and these acts shall be regarded as acts of war against the Realm.
§ 33
Any trade by the Realm or with the Realm of a legitimate and legal subject shall not be infringed upon by any foreign, sovereign state.
§ 34
Any acts of piracy will be dealt with accordingly and with the strictest punishments of the laws of the Realm. Any sponsored acts by sovereign states will result in repercussions for said state.
§ 35
The Realm shall maintain a stockpile of Weapons of Mass Destruction for protection of its sovereignty.
Any attack upon the Realm or its October Alliance allies with Weapons of Mass Destructions will be retaliated upon with Cottish Weapons of Mass Destruction.
The Realm of Cotland considers Weapons of Mass Destruction to include, but not be limited to,
Nuclear Weapons
Biological Weapons
Chemical Weapons
Any fallout of Weapons of Mass Destruction landing on Cottish soil will be interpented as an attack upon the Realm with Weapons of Mass Destructions and retaliated upon with Cottish Weapons of Mass Destruction as described in section 2.

Chapter 10: Commerce, Trade and Merchants

§ 36
The Realm shall seek not to infringe upon any civilian traders, merchants, sailors, or citizens that are in international waters moving to and from their destinations.
Trade and commerce shall not be impeded so long as it does not violate the security and/or sovereignty of the Realm.

Chapter 11: Ending Decisions

§ 37
Ammendments must be passed by a majority of 2/3rds of the Council of the King and by at least 3/5ths of the Storting. The rules in this Doctrine will not be in violation of the Constitution of the Realm of Cotland.
The King may veto any ammendments made to this act.
§ 38
This law is in effect as of the 25th of January, 2006.
Ammendments are in effect as of the moment they are passed in the Storting and ratified by the King.

To quell any objections, the Empire will provide its CVBG group in the North Sea as an early warning group for any possible threats. The CVEG group in the Norwegian Sea will also be there to provide help, should it be needed.

The Kingdom will allow Layartebian military vessels and aircraft free passage into Norwegian territorial waters and airspace. Naturally, civilians vessels are allowed passage as well. They are however subject to the rules in this Act, like all other vessels.

Official Response from the P.F.B.

Bjornoya shall respect and support this legislation from the Kigdom of Norway. Hopefully with such clearly defined documents there will be no repetition of such incidents as the one that occured in the Kara Sea.

Update - 19th of May, 2006

The Protection of the Realm Act has been updated, with §§ 11 and 20 being reworded and § 34 added. The layout has also been changed for a better reader experience. The ammendments have been approved in the Storting by 128 versus 37 votes in favor, and by the King in the cabinet meeting. The changes shall come into effect immediately.

Update - 21st of May, 2006

Articles 4 and 34 of the Protection of the Realm Act of 2006 has been reworded and approved in the Storting with a majority vote of 150 - 15. The King has approved of the rewording. The changes will take effect immediately.

Update - 4.2.2007

The Protection of the Realm Act has been reworded completely and reformed, with the addition of the Realm's official policy when dealing with terrorists in article 28. The layout has also been changed for an improved reader experience and to reflect the official colors of the Realm. The Storting has passed the ammendment with only 8 votes against, and the Council of the King has ratified the ammendment in the place of the King, who is currently indisposed due to injuries sustained previously this week. The changes are in effect as of the 4.2.2007.
