It had been a busy day so far in The People’s Republic. Preparations had begun to host a criminal tribunal in the case of the “supposed” genocide in Neoma. The streets in the capital city were bustling. Crews were assigned to plant new trees, clean up the general area, and quietly remove any bums in the vicinity of the city. With this tribunal hopefully an influx of capital due to tourism could be expected to occur. Ironically the mood in the capital building was anything but tense. All that was expected from them was a few words and appearances compared to everything else.
High Councilman Mĕane was relaxing in his office. The oaken walls glistened with their new furnish. “It’s good to get something out of this,” he thought “I’d been meaning to get that damn wall painted for too long.” Of course he realized he had more important things to attend to, but what the hell one can not be too serious in life or you’ll never get out of it alive, or at least that’s what he told his staff.
Harold Yonk had just been called into the High Councilman’s office. He didn’t know what for but god damn the walls looked horrible. “You called me in here sir?” he asked, all the while attempting to avoid eye contact with the walls.
“Yes, it has come to our attention that no one has asked to host this tribunal, I believe it would be a boon to our nation if we grab that honor as soon as possible. I want it achieved before the day is done, do you understand me Harold?”
“Clear as crystal sir.” Harold replied wondering to himself why he even took the job of foreign minister.

COMMUNIQUE TO ALL NATIONS INVOLVED
Rilloras will be represented by Field Marshal Terim. He will be accompanied by two bodyguards from the elite Imperial High-Guard. He will be arriving in New Sans shorty for the proceedings.
The N Y C delegation quietly boarded the awaiting AIR N Y C Starglider 200. They were bound for the nation of New Sans, a quite long interoceanic flight. The conflict in Neoma was still simmering, but they felt it was important to let the world know the atrocities going on there. It might, they feared, be a little difficult; SLI Sector had been doing their best to convince nations that the coalition was at fault just to draw attention away from their own despotic government...hippocrites.
In their briefcases were file upon file of testimony just taken from peacekeepers on the ground, as well as sattalite data, intelligence analises and, they hoped, the key to bringing the Neoman Government to justice.

The run way was a mess, due to the fact that a big operation was going to be under way in a couple of hours. Joshua "The Nine Lives" Derrit and Grand Ruler Varlens son Varlen II were selected to represent Neomas case to this un lawful tribunal.
Varlen II looked at Joshua "Do you think this will take long?"
Joshua sighed Little and shrugged "These warmongers are really relentless in there attempts,"
Varlen II Looked be hind them, The documents presenting the Neoman case were being loaded. "I dont trust them Joshua,"
Joshua smiled at Varlen II "Me neither, We must go now sir,"
Joshua and Valren boarded the C-130 and began there take off procedures.

As the day went past, the Habardian delegation it would not get there in time. Trouble in the Capital had delayed them and the airplane pilot did not seem to be in a hurry to arrive anywhere.
Just as the Master Lawman Sir Charles Abbey, Second Viscount Whitfield, was losing his patience, however, the co-pilot arrived at the cabin to announce them of their arrival.
Thus the designated Judge from Habardia arrived at the trial. He had been studying the case, and although he had an idea of what had happened, he was determined not to make up his mind until due time.
After all, he was no rookie in the War Courts, having been the presiding jusdge in the case of the alleged Njorrian crimes-of-war against the Celtic Chieftaindoms. The reason he was sent to this trial was precisely because the Duke had full trust in him and was sure Sir Charles would not fail to act according to justice.

Assatru Foreign Ministry to Tribunal council:
We request that the two representative from Neoma be under watch because of their nation's violation of the DMZ and peace treaty and believed intentions of committing more genocide, and at the very lease starting up the war between the coalition and the Neoman forces.
Threatening peacekeepers is a dangerous offence, and if any peacekeepers are killed we would like charges against Neoma brought up after it has been decided that they have committed genocide or not.

As for what I am concerned, said Sir Charles, Neoma has not been convicted of anything, and placing an unequal burden on their emissaries would be a violation of the neutrality of this Court.
Tribunal Member: Lady Justice Galdria
I agree with my learned colleague, neither Neoma's current political actions nor their alleged violations of peace treaties are concerns of this tribunal, but are outside our jurisdiction. The only thing that may concern us are claims of atrocities and genocide, and as for those they have as yet been unproven.
Furthermore, it is not the purpose of this tribunal to convict anyone of anything, but merely to gather information on the conduct of the war. Therefore, the Neoman representatives may not be put under watch.

Apparently the N Y C delegation had arrived. Their escort happened to be a few moments late due to a lapse in communication. The black limousine pulled up to the runway. It rolled to a stop a few feet away from the N Y C delegation and a sharply dressed middle aged man stepped out of the side door.
“Hello, my name is Jonathan and I am your guide to the tribunal. If you would please step into the limousine we can head to the tribunal and begin.”

"Oh, sorry sire, I was distracted". The boy did not want to admit that it was the strange dress and speech of the woman which surprised him. He had bragged to all the children in his master's castle of how much he knew about other nations, and that he got to travel with the judge. Finding himself shocked at foreign people was like a slap to his dignity.
After a bit of shuffling about and exchanging of luggage from hand to hand, the Habardian delegacy entered the limo and was finally on its way to the trial. To the old judge this was the eginning of a period of hard labour; for the page it was the holiday of his life.

Several limousines pulled up to the former senate building of the New Sans government. After it had been abandoned due to an unfortunate accident due to a water heater, and a fondue pot the building had seen better days. Luckily having seen the need for a spacious site for this tribunal it had been restored, and was now looking even better then its glory days.
Renard Swazt stepped from his limousine, and approached the front steps of the building as several armed Sansian gaurds emerged from the building. “Welcome all, I am Judge Renard Swazt, representative of The People’s Republic, and organizer of this event. Some members of this tribunal have already arrived and unfortunately we are still waiting on a few members, but hopefully they will arrive soon. Until that time we will show you all to your accommodations while we wait for the remaining members.

A young man watching the moniters noticed a tiny blip on the radar. It appeared to be a plane most likely from one of the other nations comming to the tribunal.
"This is New Sans Aircontrol, you are cleared to enter Sansian airspace, head to Sansia airport for pickup."
This is your Captain Speaking, we have been cleared to land. Please put all trays in the upright position and buckle all seatbelts. Thank you for flying Delta Airlines and have a nice day.

A small group of five people approached the limo. A large man in a buisness suit adressed the driver.
"Thank you for providing the transportation to the area where we will be staying" said Justice Raimes. "These four men will be acting as my bodyguards while I am in this country and I hope this is acceptable" said Raimes pointing to 4 armed men in black suits and dark sunglasses. "Also I have a list of provisions I will be requiring so my private chef will be able to prepare my meals." "I hope you can accomidate me on this request" Raimes blurts out as he takes a bite into an apple he was carrying.

It appeared things would be getting underway very shortly. The delegation from Economic Assosiates had arrived and the provisions he requested would be met in regards to his chef, and he had arrived safely at the tribunal's location.
Renard Swazt walked up to the security checkpoint and pressed a small button connected to the intercom system, "Esteemed guests, if you would be kind enough to head to the main chamber we can begin this matter. I ask all of you with guards to have them turn over their weapons to the security checkpoints at the enterance to the chamber." He looked at one of the four guards manning the checkpoint and gave a quick nod to the man dressed in military attire.
With this done he let out a small sigh and headed through the pine doors and into the chamber. Taking a seat he looked around for a moment and examining the other guards holding their weapons, while thinking to himself that it was to bad they would have to start without a few nations, but if they had intended to take this event seriously they probably would have been here already.
Two Van Guard walked threw the door, They took a quick look around and sent for Varlen II and Joshua.
Valren II and Joshua walked into the room accompanied by four other van guard.
Valren II and Joshua noticed that Renard Swazt was already sitting.
Valren II and Joshua sat down, and Joshua pulled two cigars from his coat pocket, he put one in his mouth and lit it he also held the other one up looking at Renard Swazt who had seemed to enjoy the cigar before.

Trisha took her seat, and let out a slight wince as she shifted in the awkward chair. Before her, in the military clad uniform stood a man of unique stature. She was sure that before her was the long and ardious offensive upon an innocent or guilty man. She now hoped that her colleagues would put down personal vendettas and vendiction, and that justice would be served to those responsible.
Lady Justice Galdria sighed, readjusting her glasses as she looking over the packed room. 'Very well, it seems that we are indeed finally ready to begin with these proceedings. The bench calls on the Coalition to produce its evidence to this tribunal,' Lady Galdria said.
The Justice rearranged some papers in front of her, waiting to see what the Coalition had to offer.

Since the trial is held up, trying to decide who or what happened, there is no real conclusion of genocide really did happen or not.
Plus, the Colation that attacked your nation withdrawn, deciding to wait until after the trial is concluded.
Since the trial proceddings will never finish, your nation has surivied this attempt at getting taken over. The crime of killing civilans has not been avenged. Your nation is no longer destroyed. The dog pile has disappered. This trial was my plan in the first place, by having the trial be tied up, waiting for others to arrive, the war ended.

This is damning evidence, I'd say. Here SLI Sector is actively accusing Neoma of killing civilians, even if he doesn't mean to.

Lady Justice Galdria’s eyes narrowed with annoyance as she looked over the silent people in the packed courtroom. ‘If the Coalition has no evidence to back its claim of alleged genocide perpetrated by the Neomans then this tribunal will be forced to rule that there is no indication that Neoma has done anything wrong,’ she said calmly. ‘In that case we can move right along to the claim of Coalition warcrimes.
'Be warned, however,’ and at her voice took a dangerous tone, ‘do not waste any more of this tribunal’s time. I do not think that I would be incorrect in stating that the patience of my learned colleagues and I grows thin.’
The N Y C lawyer, the eminent Francisco al-Mandhir, approached the judges. "My apologies, we were having some trouble getting our files to download. I am now ready to proceed.
Esteemed ladies and gentlemen, this is the truth, no matter how much Neoma can twist it: Mass genocide was perpetrated in their nation. The government archeives of N Y C are filled to bursting with evidence. We have spy photos, audio intercepts and, prehaps most damning of all, a survivor of these atrocities. For, we have been unable to return the injured girl we found on the beach to her parents and, if allowed, we would like her to testify. Mark my words: justice will prevail.

OOC I'm guessing this is the opening statements?
Varlen sighed lightly and stood and faced the judges.
"This is awkward, First off we have the coalition -Raises his hand to the Coalition members that were present- We also have the Evil men of Neoma -Points to him self and Joshua-. In the same room, not killing one another." He gave a cold evil star at the coalition members.
"Now, Neoma a country that is massive compared to these individual nations, and Neoma and her allies could have walked all over this so called Coalition, but we didn't. Yes, Neomas Grand Ruler, My father did find it necessary to snuff out the lives of many individuals on that day, but we are going to show you that his actions were necessary even if they were extreme. we are going to show that the war! Was started by the Warmongering coalition not Neoma! Thank You,"
Varlen turned walked back to his seat and took a cigar from Joshua he lit it and puffed slowly letting the tobacco out through his nose.
ooc okay, why is it that i feel I'm the only one taking this thing seriously...
Varlen II sat quietly for what felt like forever.
Suddenly Joshua pounded his fist on the desk and stood up.
"I'm a high ranking military officer! I'm trained to bring death to the enemy, not sitting here waiting for some cross eyed lawyer to have the balls to get up and say something!"
Varlen II stood and faced Joshua "Sit down Admiral, you are out of line."
Joshua looked down and sighed, he sat down and looked away.
Varlen II looked at the judges, "I'm not going to waste my time anymore, if this trail doesn't proceed in 30 minutes I'm going to walk out of here. And I'm going to tell my father of the insolence that took place here, You never know..." Varlen II looks at the lawyer from N Y C "He might even see it as an insult and continue the war."

OOC: Meh it's not like the tribunal can do much without the coalition of "good" side presenting their case first.
The Coalition laywer approached the stand, laden with charts, diagrams, and pictures. For the next 45 minutes, he showed the jury picture after disturbing picture: Bedraggled, hollow-eyed victims, concentration camps photographed by spy sattelite, injuries sustained by the rescued little girl...the list went on.
Next he presented documantation of the destruction that had occured; several photographs of houses of worship being lit ablaze. He also played videotape of the Neoman army threatening to kill all the peacekeepers, and moments later actually occupying the beach the peacekeepers had just escaped with their lives. It was almost unbarable to observe the lawer meticulously describing each bit of evidence, each horrifying photograph.
Finally, he was ready to call his only witness of the day, the little nameless girl who had seen everything, the key to bringing the Neoman government to justice, once and for all.
"I call the Neoman child in coalition custody to the stand"
OOC: Should I RP her response, or should someone else do it?
"I call the Neoman child in coalition custody to the stand"
'Very well, I wish to also interrogate the witness personally,' said Lady Justice Galdria in a stern voice, there had been a vast amount of information to take in today. 'As this is not a court of law, but a fact-finding tribunal, it is appropriate that my esteemed colleagues and I adopt a more inquisitorial role, though I admit that such a system is unfamiliar to a Common Law judge such as myself,’ said Lady Justice Galdria.
‘Bring the child forward.’
[OCC: Feel free to rp the witness. To clarify, I'm not saying that the Coalition lawyers shouldn't of course question the witness as well, it's just that my judge ask questions also]

Renard was a tiny bit annoyed. The coalition hadn't been exactly expedient in their presentation of evidence, and now he was having the Neoman delegate voice his disaproval. However the proceding had finally managed to get underway, and the N Y C delegate finally gotten to the point. He presented evidence no doubt, but that evidences credibility was still a whole other matter. Now apparently there was a small child being from Neoma being called to testify.
"I have just one question before we hear her side of this. What if any verification do you have that this girl is indeed from the nation of Neoma?"
"The girl is definiely Neoman. She was found by peacekeepers on a Neoman beach and speaks perfect Neoman and nothing else. So, if I may continue?"
The girl was brought forward, looking better than she had previously. Her injuries was mostly healed, although there were still slight bruises on her arms and cheeks, and she had the slightest of limps. Her eyes, twin amber pools, pierced everyone she glanced at. Her face was vacant, as if dreaming, and as she ambled up to the stand Francisco wondered if she knew the importance of her testimony.
Disregarding the thought, the lawyer began his questioning once an oath was taken. A translator was called up, and he made a point of notifying everyone the translator was not associated with any nation involved in the conflict.
"Sweetheart, could you tell the court your name"
"Isabel" came the translated answer.
"And your nationality?"
" Neoman" the girl said clearly enough, her voice cracking.
"Dear, could you please tell the court exactly why you were lying hungy and injured on a beach seperated from your parents?"
The girl's answer came in pieces as she struggle to fight back the enormous tears welling in her eyes.
"When all the yelling and shooting began, my family was in the church praying. The soldiers, they came in and started destroying everything and shot my father. My mother ran with me towards the back door, but she screamed and fell down and I kept running. I looked back and the church was in flames, and the soldiers were yelling about the government wanting them to destroy the non-coordist scum. I hid inside an abandoned building, but I knew I wasn't safe. Some rubble fell on me and bruised my body. I ran to the beach, because I heard there were ships there to save us. I got hurt again because I tripped on bodies in the street, so it took me a long time, but I got there. I saw bombs explode out to sea but didn't see anyone. I hid in the grass of a sandune for a while and then I heard someone calling out in Neoman they were there to help. The person had a bad accent, so I knew it couldn't be soldiers. I was really confused and weak and bloody but I got up and walked towards them. I went to a medical tent and they started helping me and gave me some medicine and when I woke up I was aboard a ship and, and, my mommy, wasn't there and..." She couldn't hold any more, and started bawling.
"Thanks honey, that's it. So, esteemed ladies and gentlemen, there you have it. This innocent child had seen her entire community killed and destroyed by the horrible actions of the Neoman government. I turn her over to you Lady Justice Galdria."

"Wait one moment, you expect us to believe that the only verification we need to tell this girl is Neoman is that you say the peacekeepers found her, and that she speaks the language? I at least expect some more credible verification to believe that this girl's testimony." Renard said.
'The tribunal will wish to interview the Coalition soldiers that recovered the witness and those that processed her, of course. We will also expect you to hand over the original documents pertaining to her capture. That should go some way to determining the veracity of the witness' testimony,’ Lady Justice Galdria said to the Coalition lawyer, her voice losing none of its sternness.
‘Okay, Isabel,’ she continued, turning to the child, her voice suddenly softening, ‘I’m going to ask you several questions. You’ve nothing to fear from either me or anyone else on this bench,’ she said, gesturing to the others next to her.
The Xirniumite jurist asked the girl’s name and age, preliminary questions aimed at putting her at ease. ‘Are you aware of the distinction between truth and lies, Isabel?’ the Justice asked.
‘Yes, ma’am,’ said the child.
‘Splendid, and which one will you tell?’ asked the Justice, ignoring the fact that she had not been addressed as “my Lady”. She is, after all, only a child.
Isabel’s answered, ‘the truth, ma’am.’
‘Very well. I’d like you to focus on the moment when the soldiers entered the church,' explained the Lady Justice. 'I’d like you to think very hard and tell me exactly what was said, what they did. Had your family ever been harassed by government personnel before this date?’
Varlen II stood quietly "My lady, The Neoman Delegation wishes to dismiss this witness and the pictures." Varlen II licked his lips and continued. "We wish the witness to be dismissed because she has been in the coalition hands for some time now, How are we to know if they have contaminated the witness with what they want her to say. Also with a child this young we wish to point out that studies have show that they are easily corrupted because there mind does not have the capability yet to fully decide on events, thus it can be easily tampered with."
Varlen II looked at a piece of paper and moved on.
"Like i said i want the pictures to be dismissed. The prosecution has not disclosed any of these pictures to us and have surprised us with this information, and if memories serves my correct they cannot do that. Thank you, Sorry for interrupting you."
The N Y C lawer abruptly stood. "This girl has been in the care of a third party caretaker hired by our government's department of human services. Are you suggesting, sir," his eyes narrowing, "that our government brainwashes children in our care? You who don't want us to show any pictures that display the grisly reality? You'd like that, wouldn't you? But this trial was set up to and WILL display the truth, wether your despot likes it or not!"

You'd like that, wouldn't you? But this trial was set up to and WILL display the truth, wether your despot likes it or not!"
"One question, how can you say this girl was in a third party caretaker when your government was the one to hire them? Surely an international agency or another nation who wasn't involved could be considered a third party, but to be the ones to hire someone to do it doesn't seem to say third party. How can we know the party hired by you doesn't have a vested interest in this. Surely you wouldn't have needed to hire someone for this?"
The prosecution has not disclosed any of these pictures to us and have surprised us with this information, and if memories serves my correct they cannot do that.
‘In a Court of law that would be correct,' answered the Xirniumite jurist, readjusting her glasses, 'but this is not a Court of any description, rather it is a fact-finding tribunal. As such, the tribunal has certain non-juridical powers and traditional evidentiary procedures can be relaxed in ways they could not in a typical litigation. One might perhaps argue that with the softening of procedural guidelines there is a danger that natural justice may be denied, but then again we aren’t looking for "justice", are we, we are looking for the truth. I will suggest to my learned colleagues that we admit the evidence in question, noting, of course, your valid objections towards it,’ she said, nodding to the Neoman counsel.
‘Your objections to the child’s testimony are also duly noted, and I must reiterate my request that the Coalition provide the relevant documents to the tribunal regarding her capture and holding in Coalition custody. They will be considered in evaluating the credibility of the witness. I suggest that the Neoman party be allowed to cross-examine the witness,’ the Lady Justice continued.
You'd like that, wouldn't you? But this trial was set up to and WILL display the truth, wether your despot likes it or not!
‘That is quite enough, Mr al-Mandhir,’ Lady Justice Galdria said, evidently displeased at the momentary outburst. ‘Let me remind you that this is not a trial of any description, and let me warn you to moderate your conduct before this august tribunal. Antics will not be tolerated here.’
‘Now, so far, you have expended considerably energy aimed at proving the physical component of the crime of genocide, the actus reas. International law defines this as act as either killing members of a national, ethnic, racial or religious group, causing serious bodily or mental harm to members of that group, deliberately inflicting on that group's conditions of life calculated to bring about its physical destruction in whole or in part, imposing measures intended to prevent births within that group or forcibly transferring children of the group to another group. Your party has voiced that there is sufficient evidence to suggest, beyond reasonable doubt, that the actus reas for genocide was satisfied by the occurance of both the first and second examples, and it is up to this tribunal to determine if that was indeed the case,’ the Lady Justice explained.
‘What you have not yet done, however' Lady Justice Galdria continued, 'is argue the mens rea, the “guilty mind”. Like all major crimes, genocide requires a certain intention, a certain "moral culpability" brought about by intentionally commiting the act. What is the mens rea for genocide? You need to show that the the Neoman government had the intention to destroy, in whole or in part, a national, ethnic, racial or religious group.’
‘Where is this evidence, Mr al-Mandhir? Where are the documents, the orders, the speeches, the reports? Surely something as systematic as the extermination of all non-Coordists in Neoma must leave a paper trail. Where is it? The alternative is to infer intention from the act, and that is never easy,’ said the Lady Justice sagely.
