Atchetchyun
03-10-2004, 20:48
The newly founded direct democracy of atchetchyun has for the last two moths debated the advantages and disadvanteges a membership in the NSUN would bring.
To this end we have taken a close look at the resolutions that have been passed. To see what we would have to comply with, and to get an idea of what probably is yet to come.
We have reluctantly decided that there is no way we are going to comply with all of these resolutions. Which already implies that we will not apply for NSUN membership.
This being said, we do recognize the advanteges a legal framework brings in many international affairs.
The course of action that has been decided upon by the citizens of atchetchyun is this:
1. That an ambassador be send to the NSUN headquarters.
2. That a list be published of the resolutions atchetchyun does and does not comply with.
You are currently reading this list. The state of the single resolutions follows. Followed resolutions are printed in bold, resolutions thought to be without substance, or superseeded by a resolution that we follow, are printed normal, resolutions we do not follow are printed cursive.
One more note worth mentioning: This list does not concern itself with whether it makes sense to regulate something on an internetional level at all. Just whether our laws are in compliance with the resolution or not.
1. Fight the Axis of Evil
We find it astounding this resolution is still in effect. It seens to make a mockery of the need to compy with NSUN resolutions to us.
2. Scientific Freedom
3. Education For All
superseeded by 27.
4. UN taxation ban
5. DVD region removal
A business is free to offer inferior products. We won't restrict that right.
6. End slavery
We follow points 1, 2 and 5. We do not follow point 3, as land owners have the right to disallow entering of their property.
We do not follow point 4, as persons signing a contract have the right to allow to be bodily harmed. However, they are free to quit that contract at any time, and without repercussions.
7. Sexual Freedom
8. Citizen Rule Required
9. Keep The World Disease-Free!
There are only "shoulds" in this resolution. Nothing is binding. If it were, we would disagree with the resolution.
10. Stop privacy intrusion
We will not wait for judiciary approval. As fast as somebody presses the emergency button, our police gets every available video feed, to be able to respond immediately and correctly. Furthermore governmental supervision of state roads is legal in atchetchyun.
11. Ban Single-Hulled Tankers
see 1)
12. Gay Rights
A company is free to choose whether it wants to offer its services to everybody, or only to certain classes of people.
Discrimination by law is forbidden by our constitution, gay marriages are legal.
13. MANDATORY RECYCLING
see 1)
14. CHILD LABOR
A child is free to work outside of school time. But there is not much time left, and there won't ever be a material need to do so.
15. Protect Historical Sites
Contains nothing binding.
16. Elimination of Bio Weapons
17. Required Basic Healthcare
no longer enforced
18. Hydrogen Powered Vehicles
Nothing binding, only "should". If it were binding, we would disagree. There are very close to no cars in our land, so it would be quite wastefull to develop hydrogen cars on our own. Besides, research isn't a task for our government anyway.
19. Religious Tolerance
20. 'RBH' Replacement
The only binding part is taking back resolution 17. For the rest: Health care is private. Healthcare of children is ensured.
21. Fair trial
22. Outlaw Pedophilia
23. Replanting Trees
see 1)
24. Metric System
We will not restrict civil rights in this way. Schooling and government however, do use the metric system solely.
25. The Child Protection Act
25. The Universal Bill of Rights
With exceptions: Articals 2 and 3 are restricted both for children, and for prisoners.
Further small exceptions for reasons of property rights (Article 3), blackmail, libel, agitation to break the law, information gained by breaking a law (Article 2)
26. Due Process
quote: "nor shall private property be taken for public use, without just compensation." We DO have taxes.
27. Free education
28. The IRCO
Resolution isn't a matter of law.
29. Common Sense Act II
30. Wolfish Convention on POW
31. Global AIDS Initiative
First point: citizens of atchetchyun are free to direct money to the UNEC to help here.
Second point: see 1)
Third point: We think money used to buy AIDS medication for the poor could be used in more effective manner, in view of current market prices.
Fourth point: Health care is private.
32. No Embargoes on Medicine
Sadly, this resolution does not contain anything binding. We think it should, and adhere to each proposal.
33. Oceanic Waste Dumping
superseeded by 34.
34. Stop dumping - Start Cleaning
see 1)
35. Freedom of Humor
superseeded by 25. (Article 2), as far as speech/writing are concerned. As for actions: We won't restrict civil rights of property owners.
36. World Heritage List
37. The Rights of Labor Unions
We won't restrict the right of free contract in this way.
38. Alternative Fuels
We don't have any automotive manufacturers in the first place.
And if we had, we certainly would not dictate them how to use their money.
39. Banning the use of Landmines
40. END BARBARIC PUNISHMENTS
superseeded by 25. (Article 5)
41. Increased Access to Medicine
42. Legalise Euthanasia
43. Fair Treatment of Mentally-Ill
There is only one sentence that is not superseeded by resolution 25: "Basic services should be offered to all citizens who are mentally-ill."
While this does apply to most citizens of atchetchyun, it does not apply to all. We do have Organizations who care for those on a voluntary basis.
44. UCPL
We are afraid that our intellectual property system is completely foreign to those concepts. What we do is to mark outgoing information that does not voluntarilly comply with international copyright law as set forth by the International Copyright Organization. So other nations are free to decide whether they let that information into their country or not.
45. Legalize prostitution
46. Definition of 'Fair Trial'
47. Save the forests of the World
Contains nothing binding. See 1) anyway.
48. Rights and Duties of UN States
We can not comply with section III, since we do not adhere with all of "international law" (all resolutions of the NSUN).
We do comply with sections I and II.
However, we want it to be understood that our right of free speech remains untouched by section I, Article 3
49. UN Space Consortium
Resolution isn't a matter of law.
Furthermore we don't think research is an obligation of our government, and neither is space exploration.
We are sure some of our universities will take a close look at the U.N.S.C. If it shares its technological advantsments, it is well possible that they would band together to buy shares.
50. Children in War
51. Ballast Water
52. Universal Freedom of Choice
53. UN Educational Committee
Resolution isn't a matter of law.
Citizens of atchetchyun are free to direct money to the UNEC to help.
54. World Blood Bank
Resolution isn't a matter of law.
Citizens of atchetchyun are free to direct money to the World Blood Bank to help.
55. BioRights Declaration
superseeded by 25. (Article 4)
56. Reduce Black Market Arms Sales
57. SPCC Regulation Act
This resolution lies. It is weaker than 11.
58. The 40 Hour Workweek
Our citizens are free to sign contracts for work condictions of their choosing.
59. Public Domain
60. Abortion Rights
Our constitution defines a person as a being capable of conscious thought. Every person has the right not to be bodily harmed.
From that follows, that the right to abortion ceases at the point the not yet born baby gains the ability of conscious thought.
Until research provides us with results that are more exact, this point of time has been specified as being the end of the 6. month of pregnancy.
61. Female Genital Mutilation
Adults have the right to harm themself, or to allow others to harm them.
Young children do not have that right yet. If a young child comes to harm trough negligance or intent of the parents, the parents are hold responsible.
62. Freedom of Press
63. Tracking Near Earth Objects
64. Refugee Protection Act
65. Illegal Logging
Businesses are free to decide whether they want to get a stamp or not, especially if it adds a cost for them (the checks). Keeping citizens within the law is a national matter.
66. Needle Sharing Prevention
67. Ban Trafficking in Persons
hard to tell whether that is completely superseeded by other resolutions or not.
68. The Sexes Rights Law
69. Banning whaling
see 1)
70. Sustainable Energy Sources
71. Reduction of greenhouse gases
72. Habeas Corpus
73. The Law of the Sea
We view our territory to reach out according to the old measure: 200nm=370km. We are cheering for Sophista in the dodge ball games.
74. The Nuclear Terrorism Act
1) If a person or corporation wants to commit an action that endangers the property of other persons, corporations, or the state, he needs to be able to cover the costs of the worst case, or he acts illegally. These costs are calculated as: damage done to property (=cost to restore the previous state or better) divided by probability that the responsible person became known. And if necessary, they will be determined by court.
For citizens of atchetchyun, the government can declare something as property that does fall neither into its own jurisdiction, nor into the jurisdiction of other states (e.g. whales in international waters).
The right to endanger the health of persons has to be gained on the basis of agreement. Nondiscriminatory endangering may or may not be allowed by the law. If it is allowed, risk dependent fees have to be paid to the government.
Hopefully this list will be a help for other states, as well as the public opinion, to determine what to think about the politic of atchetchyun. And hopefully it will help to simplify international matters as much as possible.
This list will be held current.
If you have questions, the NSUN ambassedor of atchetchyun will be glad to answer them.
Sincerelly, NSUN ambassador of atchetchyun

I would have prefered to post this in the "The United Nations" forum, but am not allowed to start a thread there
