ANL to adopt new Communist Constitution

The Aztec National League has been a strong supporter of socialism and communism since it's beginning. It's Communist Charter has mandated it's government to opeate in that manner. However, several government officals have accused it of being too vague and non-descript. Therefore, the Soviet Congress has uniaminously voted to create a new consitutition. Government officals are almost done ratifying it and it will be published as soon as it is complete.

Meanwhile, many people of the ANL fear the Premier will be forced to step down from power. The current Premier is very popular among the people with 84% approval ratings. Massive demonstrations are being held outside, demanding the Premier stay in power.

When asked about the Issue, Premier Quetzalcoatl stated "I will support the new Constitution and faithfully implment its policies."

The Soviet Congress has just approved of the new constitution. It is now being sent out to the ANL's 33 states for ratification.

Ratified on: October 2, 2004


Permeable:
The Aztec National League has been a strong supporter of communism. We have tried to our best abilities to form the most perfect communist union possible. While our great nation has had many successes, we have not been able to completely fulfill our goal. Therefore, the Soviet Congress, under Congress Resolution CR-112 (2004), we draft and ratify a new Constitution to abide by.

FIRST AND FOREMOST:

Section 1: Provisional Statements:

1.) The Aztec National League shall sign to and abide by the International Declaration of Human Rights. To enforce compliance, the government shall form a committee to observe the actions of both private and public institutions and take the necessary legislative or legal action.
2.) The ANL’s government’s title shall remain “The Democratic Proletariat Union of Aztec National League.”
3.) The ANL shall remain a representative democracy and no institution, public or private, shall abridge any citizen’s eligibility to vote for any reason.
4.) The ANL government shall allow for some private citizens to take over non-essential industries. In essence, the Union will have limited private enterprise. However, the ANL government will still be in control of all industries.
5.) The ANL government shall consist of three branches of government, the Administrative, the Legislature and the Judicial. The ANL government shall be a unitary federal government.
6.) No state shall legally cede from the Union.

Section 2:

2.1.1: The Administrative Branch:

The Administrative Branch shall consist of the Comrade General (formerly known as Premier.) The Soviet Congress shall appoint one of the candidates (see Section 2.2 for Candidate guidelines) for the position of Comrade General and his tenure shall be indefinite. Only the Soviet Congress can remove the Administrator from office through a simple majority vote.

2.1.2: Candidate Eligibility Guidelines:
Any ANL citizen from the General Public may run for the office of Comrade General. However, they must at least be at least 25 by the ratification of this Constitution. Also, no candidate will be eligible for Comrade General if they have any prior Criminal Record in addition to failing an ethics test.
2.1.3: Responsibilities and powers of the Comrade General:
The Comrade General shall be the Supreme Commander of the entire ANL military. He shall not need consent of the Soviet Congress to use the military for purely defensive purposes. He shall need consent from the Congress for any offensive or pre-emptive action. The Comrade General may create treaties with foreign nations without the consent of the legislature.

The Comrade General has the ability to grant reprieves and pardons without the consent of the Congress, except in impeachment inquiries.

The Comrade General has the power to appoint a council of advisors to advise on policy issues. In addition to that, the Comrade General has the ability to appoint Ambassadors, state officers, officials, deputies and Department Ministers. Appointees need not approval from the Soviet Congress. However, the Comrade General can not remove officers he has appointed.

The Comrade General is mandated to give information regarding the State of the Soviet Union. He shall also have the ability to recommend legislation directly to the legislature. He may also veto any act the legislature approves. However, this veto is defeatable.

Section 2.2: The Legislature:

The Legislature shall create and enact legislation and policy of the Aztec National League. In addition, the Legislature is responsible for both raising funds of the ANL and, in addition, appropriate and allocate funds to the various programs and institutions of government.

The Legislature shall be entirely comprised of one body, the Soviet Congress. The Soviet Congress will be elected directly by the people every 2 years.

The Legislature shall consist of three representatives from the 33 states and three from the Federal District. Therefore, unless if more states are added, the number of Soviet Congressmen shall be raised to 102.

The Legislature is required to assemble at least 4 times a year, once during each season.

2.2.2: Candidate Eligibility Guidelines:

All citizens from the General Public are allowed to run for a position on the Soviet Congress. They must have attained the age of 20 by the time of this constitution’s ratification.

2.2.3: Powers and Responsibility of the Legislature:

The Legislature shall create and enact laws and ANL policy. They are also in charge of all fiscal action by the ANL government. The Legislature may enact any law they wish, but for it to take effect, it must be signed by the Comrade General. The Comrade General may opt to veto any bill he wishes to. However, the Soviet Congress is able to over the veto if the are able to get a simple majority shall overturn the veto.

The ANL Legislature has the responsibility to:

-Distribute money to the citizens of the ANL and take out what it needs in taxes.
-To borrow money
-To appropriate money to all the various programs and institutions of the ANL government
-To regulate all business, commerce and industrial affairs of the nation, both domestic and international
-To produce money
-To deliver punishment to those who counterfeit ANL money
-To Establish communication systems in the form of post offices, telecommunication systems and satellite communication systems
-To promote the research of science and technology
-To create municipalities
-To create lower courts
-To declare offensive or pre-emptive war
-To fund and raise the military of the Aztec National League
-To establish the rules of the military, and in addition, create rules regarding acquisition and capture of land

2.3: The Judicial Branch:
The Judicial Branch shall consist of the Supreme Court and whatever inferior court the Legislature decides to create. They shall declare the legality of laws enacted by the legislature and actions taken by the Comrade General. If the judged of the inferior or superior courts find a particular action illegal, they may declare it null and void.

The Supreme Court may only act if:
-A lawsuit is brought up to nullify any law or administrative action
-A conflict between the various states of the Union arises
-A person is accused of treason
-Due to possible vacuity of the laws, legal action is required to define the law or set up a precedence to follow

The Supreme Court shall be the only court to facilitate impeachment trials for any Central government official.

The Inferior Courts have the right to overturn laws as well; however, the matter will ultimately be resolved by the Supreme Court. Inferior courts shall handle all powers not explicitly given to the Supreme Court.

Section 3: Amendments:

This constitution shall be amenable if the legislature finds it necessary. The legislature may propose an amendment and should it pass with a 2/3 vote, it shall be sent to the various state legislatures. If it passes a majority of legislatures, it shall be amended to the Constitution. If it fails to get a majority of state legislatures, the Comrade General may either pass it or the legislature may unanimously approve it. If it does not get the required amount of support within the proposals built in statues of limitations, then it shall not take effect.

After a proposal is approved, it will be reviewed by the Supreme Court to judge it’s constitutional legality. If the court approves it, it shall be made law. If it does not, it will go back to the legislature for unanimous approval. Then it must be approved by the Comrade General to take effect.

Section 4: Ratification:

This Constitution shall take effect when at least a simple majority of states approve of this document. In addition, a simple majority of representatives shall be needed for ratification. Finally, the support of the Chief Justice and Premier Quetzalcoatl will be needed to bring the Constitution in effect.

Provisional Bill of Rights:

1.) The right to freedom of religion, speech, press, and creed is hereby acceptable and will go unabridged.
2.) All ANL civilians are entitled to a fair trial of their peers.
3.) All ANL civilians are eligible to participate in the political process.
4.) Military conscription will not exist in the ANL
5.) The state may not use force to put down a peaceful demonstration. Only in civil insurrections is the use of force constitutionally allowed.
6.) No civilian of the ANL will go unemployed. However, no person is to be subjected into involuntary servitude.
7.) All civilians may give input on how they want taxes spent.
8.) All ANL citizens have the right to review all legal government documents except for a limited few that are endorsed by both the legislature and the Judicial as being necessary to keep confidential.
9.) No person shall be discriminated against on the basis of sex, sexual orientation or race shall.
10.) All powers not implied, legislated, inherent to or expressed to the central government is hereby delegated to the state.
11.) No ANL citizen is able to buy or possess any gun or assault rifle. Only active duty police officers and the military can use guns.
12.) Marijuana is hereby legalized. However, all other drugs are not legal unless if needed by doctor’s prescription.
13.) All citizens are entitled to public education, healthcare, social security, welfare and employment by the state at the expense of the state.
14.) The ANL government or any private institutions can no create laws that institutionalize discrimination.
15.) A person can not be executed except for only the most serious crimes. That would entail treason, arson resulting in death, terrorism, and plane hijacking with the intent of murder or terrorism and in special cases, murder.

Several state governors have approved the new constitution despite the relativly short amount of time since it was released. Most notable states to support it was Durango, Jalisco, The Federal District, Chiapas, Guatemala, Honduras, Veracruz, Michócan, Coahuila and Oaxaca. San Luis Posti, Yucatán, Zappatecas and Nayruit are expected to be the next states to approve the Constitution.

In addition, Congressman John Kirkland and the Soviet Republic Party has proposed an emergency referndum calling on the Soviet Congress to appoint a Comrade General (position formerly known as Premier.) The referendum is being supported by many members of the Premier's party, the Democratic Communist Party, which holds the majority. Should the referendum pass, Premier Quetzalcoatl would be banned from running again and would be ousted from power. The referendum blocks the new Constitution from taking place unless a new Comrade General is appointed.

Upon news of this, the demonstrators outside the Grand Union Chambers are demanding the appointment of Premier Quetzalcoatl to the new position and the resigning of Congressman Kirkland. Again, the Aztec people overwhelmingly support Quetzalcoatl with 84% approval ratings.

Premier Quetzalcoatl looked outside of the Grand Union Chambers, looking over the large nubmer of demonstrators. He was glad it wasn't hot outside, as there had to be over 75,000 protestors. He knew he would have to speak to them soon. He would either have to step down from power or refuse. Either choice could cause riots, but something had to be done.

Cheif Majority Congressman Arroyo walked into the Premier's office. He looked tired. Dark circles had formed around his eyes. Quietly, he began to speak.

"Premier, we have recived word, 25 out of 33 states have ratified the consitution. We expect all the states to sign it within the next couple of days. While we have a solid majority, we still need you to and the Cheif Justice to sign it. I must warn you, if you sign it, you will be stepping down from power."

The Premier looked over the crowd still. He said in a exasperated tone, "Yes, I know."

Arroyo continued "Chief Justice Horatio Starling is planning on stalling before he signs it. He supports you in this, many of us do."

All of the sudden, Chief Minority Congressman John Kirkland barged into the office. He knew he had to make this quick, he was not very popular in Tenochitilan these days.

"Premier," Kirkland said, "Are you going to sign this consitution?"

Quietly, Quetzalcoatl said "In time, but Justice Starling must sign it first."

Angry, Kirkland retorted "You know you will have to sign it. You can't stay in power."

Quetzalcoatl looked at him and said "It's not that I want to be automatically appointed to the position, I just want to run like any other man or woman. Tell me, why shouldn't I run?"

Quickly, Kirkland said "It simply isn't fair to anyone else. You have too much support from the people, it would be political suicide to vote against you."

Angry, but calm, Quetzalcoatl said "Is it not fair for democracy, or is it not fair for your politics?'

John Kirkland knew the argument was useless, he then turned away and stormed out.

Quetzalcoatl looked at Arroyo and said "That's it, I'm going out there to speak to the people."

The protestors outside the Grand Union Chambers grew rapidly. They truely did not trust anyone else except the Premier to run the nation. Reports say more protests have broken throughout the nation. They did not want the Premier to step down. People were carrying signs saying "Quetzalcoatl for Comrade General" and "Democracy for the masses, the masses for Quetzalcoatl." In all fairness, there were some opposition there too. However, they were far outnumbered by Quetzalcoatl's followers.

A microphone stand had been set up, and a worker was connecting the microphone to a sound system. The worker gave the ok, and to the crowd's suprise and delight, the Premier walked out of the Chambers and spoke to the crowd.

"I tell you, my Aztec brothers and sisters, we are at a point of great change. This new constitution will be the key to our future sucess, and I whole heartedly endorse it. It will make our Union the most perfect we have been able to achive, and we will maintain our balance of Communism and Democracy.

Now, there are some key Congressmen from both parties that have said I have been in power too long. Well, the only reason why I have been in power is because it is the will of the people. The ANL has had two elections in it's past, and twice I have had the support of the people and remained in power. And it appears, if I were to run again, I would still have that support.

I don't expect to be automatically appointed to the new position of Comrade General. If I am to get it, I am to deserve it first. Tell your Congressmen to allow me to run so I may be able to serve you better.

I might be only 25, yes, I'm young for a world leader by any measure, but I tell you, this just means I have a lot more time to serve my country and my people."

The crowd roared to life and the people cheered loudly. The sound techs had to turn off sound system so it would not blow out form feedback.

Also, the Congressional Switch board was flooded with calls and the Congressmens' telephones rang off the hook.

Your concerns about our government are important. However, while our system is more socialistic then that of Aztec Lands, we, at the same time, do not follow the philosophies of Marx, Ingles, Lenin or Trotsky to the tee. Our system does allow for private enterprise, and we do not prohibit the practice of any religion. While I will admit, our system is radically different then that of Aztec Lands, it has worked well since our nation's founding. We plan on continuing it.

A white haired man, around 63 looked at the document before him. A council of advisors sat infront of him. After reading the document over and over again, Judge Horatio Starling finally said "So is there any possible way that we have a legitimate reason to not sign this and stall the process?"

The Advisors looked at each other, they could not think of any.

After about 15 seconds, Justice Starling looked back down and continued to read the document over-for the 15th time.

He did not get very far, the former Vice-Premeir, Coyotepec spoke up. "Your honor, may I look at the proposed constitution, I might have an idea."

Justice Starling looked up at the gaunt Coyotepec. It was amazing he would be able to help the Chief Justice at all, considering it has only been a month since a car wreak that left him inches from death. He handed the Constitution over to Coyotepec, "There you go."

For the next 30 minutes, the room was silent. Coyotepec read quickly over the constution and the powers it gave to the various branches. He then smiled and said "Ahh, here's a problem."

A wave of relief came over the Justice, "Alright, what's your idea?"

"Well," Coyotepec said slowly, "Under the section about Legislature, it enumerates a group of responsiblities the Legislature must do. This would involve many other responsibilities and needed jobs to take care of the first. So many, it would be impossible to list them all in a document. What many national constitutions and state constitutions do is they have what's called an Elastic Clause, meaning, the legislature may create anything seen as neccisary and proper to fufill the execution of one of the enumerated responsiblities. The only restraint is the new program would have to directly relate to a specific program. Our current and our proposed constitution has no such provision."

Justice Starling was truely interested, "What could be the legal impact from such lack of a clause?"

Coyotepec then said "Catostrophic. Every thing that is not enumerated in the constitution that is undertaken by the Legislature, whether or not it relates to the enumerated responsibilities could be declared unconstitutional."

One of the other aides responded, "Then why do we not have any problems now."

Coyotepec said "In our current constitution, nothing is well-defined. It served ok, but it's wording made it so anything could be done by the legislature."

"Then we shall reject it temporarily on that basis. Eventually, I will sign it, but I will make sure it is re-written with this provision in it."

15 minutes later...

Chief Justice Starling and his council of advisors walked out of the Justice's Chambers to a media blitz. He could hardly ear through the noise. As Justice Starling usually gets people's attention, he begins really loudly,

"EVERYONE, EVERYONE, WE HAve found a fatal flaw in the proposed constitution. There is one certain provision that is not on the proposed document that, in absence, could have catostrophic impacts in the future. Therefore, I can not sign this document and I send it back to the legislature for re-writting. Only once it has this provision on there will I sign the document."

The Congress were called into an special session regarding the new provision for the constitution. Many of them suspected this was a mere political ploy to stop the ratification, but they were open to listening what was to be suggested. They waited patiently for the speaker to come out.

Suddenly, to the suprise of the Congressmen, an familiar and missed person stepped up to the central podium. Former Vice-Premier Coyotepec decided to give the argument for adding the new clause. Before he began, the Congressmen murmered among themselves, shocked of his appearance.

"Congressmen, congressmen, the issue I have come before you today is in regards to our new Constitution. Now, I have read over the document several times and I must say, it is very impressive, much better then what is in place now. However, there is one particular issue with it that could cause disaster, not for what it says, but for what it does not say.

If you look under Article 2, Section 2, Clause 3, you will see a enumerated list of 13 responsiblities of this Congress. Now, these reponsibilities are indeed indepth and must be fufilled by the Congress. But, with these responsibilities, there come countless other responsiblities this congress must undertake that are not explicitly mentioned in this constitution. The question is, even though it is required to fufill an explicit obilgation, is a action that is not explicitly mentioned unconstitutional. The question of constitutionality will slow down and bog down the legislature to a crawl, and our courts will be jamed packed with frivolous arguments and cases.

Therefore, I suggest we add an Elastic Clause, in which it say 'the congress may enact any bill or undertake any responsibility that is neccisary and proper to fufill the expressed responsiblities of the legislature.' Therefore, the question of constitutionality is cleared up, and the congress may take all steps neccisary and proper to fufill its obligations to the people and country."

Chief Congressman Arroyo, the leader of the Congress stood up and said, "Does the Congress hear any objections to this proposition?"

Silence

Arroyo continued, "Then do we agree to add the elastic clause to the proposed constituion under Article 2, Section 2, Clause 3?"

Unaminously, the congress agreed.

The Congressmen, still stunned by Coyotepec's brillant performance gave an standing ovation for him.

The Premier knew he could stall no longer - the document had to be signed. He supported the document, yet he knew it would cost him his job. He had to reach a compromise with his opponets. He pulled a slip of paper out of his desk and began to write on it. He then asked an aide walking by to deliever it to Congressman Kirkland.

30 minutes later...

Congressman John Kirkland walks in almost shyly into the Premier's office. It was dead silence. The only sound that could be heard was the ticking of an old grandfather clock. Quietly, Kirkland pulled up a chair to the Premier's desk. Taking the initiative, Quetzalcoatl began,

"Now, I know you oppose me running again. You have gone so far as to place an injunction to stop me from running again and a mandate that says I must step down if I sign the constitution. I am willing to compromise with you on the situation."

John Kirkland said "Alright, go ahead."

Sighing, Quetzalcoatl said "I am willing to sign the constitution, and step down from power if you are willing to accept two conditions, first, the injunction must be dropped and I be allowed to run again. Second, if I am to step down, the congress as a whole must accept the responsiblities of the executive until the Comrade General is appointed. Until then, congress can not appoint anyone to the executive. If you don't like those terms, then maybe a Executive Council can be formed by both you and Congressman Arroyo and another Congressman, does that sound fair?"

Kirkland played with the idea. It was indeed a compromise, it seemed like the closest thing to what he wanted. Willing, Kirkland said "That sounds reasonable."

Happy, Premier Quetzalcoatl pulled the constitution out of a folder and in earnest signed it. It was done, Premier Quetzalcoatl for the time being, stepped down and the ANL had a new constitution.

Newsflash:

Several shocking events have happened in the Aztec National League in the past 24 hours. The Constitution was signed by Premier Quetzalcoatl. Thus, he has formerly stepped down from power. The Soviet Congress has appointed an Executive Council, consisting of Chief Congressman, Jorge Arroyo of the Democratic Communist Party, John Kirkland, Minority leader of the Soviet Republic Party and Congresswoman Yoltzin of the Confederate Party.

Although Quetzalcoatl stepped down from power, he is planning to run on his Democratic Communist Party's ticket. He said this to the protestors outside the Grand Union Chambers before leaving to his home outside Tenochitilan:

"My people, my people, I tell you this, I will return. I do not plan to stop fighting for you. I have led the ANL since it's creation and I swear I will not abandon it now. I do not regret temporarily stepping down because I did it for the right reason. It was right for this new Constitution to be ratified, and I hope you agree with me on it. But, like I said, I will return!"

There is rumor that Quetzalcoatl will ask to be re-instated in the Jaguar Warrior Military Corps. Although some opponets critize this as a publicity move, he simply replied, "I was part of the JWIs during the Revolution, since I was 15. I am now 25, why shouldn't I rejoin?"

Meanwhile, the last state has ratified the Constitution by the narrowest of votes. The state of Quintana Roo's legislature finally approved the Constitution by a 15-14 vote.
