The Shildonian Government has formally sued Commuist Louisiana for £10trillion Shildonian Pounds for libel. Due to the extremity of the case, cases in the Shildonia City High Court have been rearranged for this case to be heard swiftly.
The case was brought after the government of Communist Louisiana issued a statement claiming that the Shildonian Government were terrorists. Since we believe this to be untrue, and the allegations would doubtless damage the standing of Shildonia amongst the international community a decision was made to sue for libel.
The case hinges on one simple issue: Is the allegation false? If it is, then the government of Communist Louisiana will be liable to pay the damages. Under statute, terrorism is defined as: "Intentional acts of mass violence against civillians, or the threatened use of mass violence against civillians, usually but not always for political gain".
Exhibit A: This statement by the Government of Communist Louisiana (http://www.nationstates.net/forum/viewtopic.php?p=2852922&highlight=&sid=3239b087fb024302450fab3d6f95cc9b#2852922), which states that:
... you my friend, are a terrorist
Exhibit B: The Shildonian Flying Corps. target selection manual, which states that:
Each target selected for bombing should be referred to a team of lawyers trained in the rules of warfare who will have the power to veto any target deemed illegal.
... illegal targets include areas associated with non-military personell, and military targets which, if attacked may cause significant damage to civillian populations, e.g. dams, or transportation systems used by civillians as well as the military, unless the attack can be timed to ensure that civillian casualties will be minimal
Reasonable efforts must be taken at all stages of the attack process to ensure minimal damage to civillian populations, including by the aircrew. Should the aircrew believe their actions may cause significant damage to civillian populations, they will be able to use the defence outlined under section 23a of the Shildonian Flying Corps. rules of justice
Exhibit C: Section 23a of the Shildonian Flying Corps. Rules of Military Justice:
The following defence may be used against charges of insubordination, dereliction of duty, and failure to carry out orders, or any other appropriate charge:
"The Defendant will be found not guilty if the crime was committed in order to prevent causing significant damage to civillian populations."
As one of the most fundamental tennets of Shildonian justice is that not only must justice be done, but must that it must also be seen to be done, the international community is cordially invited to send representatives to watch the trial.
Likewise, the government of Communist Louisiana is entitled to send legal representatives to attempt to defend themeselves of these allegations.
