Rotovian National News Break

Today in what is perhaps the most controversial case heard in the Rotovian Supreme Court Justice Neil Carthage ruled that the Elven population of Rotovia did not meet the requirements to be regeistered as sentient beings under the Rotovian Sentient Beings Act.

The case had been inciated two years ago by one Mr Il'dora Salvorun who wished to enrol to vote after he saw last years landmark amendment to The Decree of Rotovian Rights. The decree had it's deifnintion extended to cover all sentient beings which was later defined specifically in the Sentient Beings Act.

Justice Carthage declared that "The act was termed specifically and clearly with no room for broad interpretation. It has even gone as far as to provide genitic requirements to be deemed members of the two recognised as sentient, Humans and Nekos. There is no denying Elves are not members of these two groups.

Holding that there is no denying that the Decree of Rotovian Rights grants a vast aray a rights to all sentient beings, there is also no denying the absolute definition of sentient provided by the Sentient Rights Act. Failing a change in federal legislation this court lacks the authority to grant such a request."

This decision has sparked much controvesy amoung Rotovians, espceially after the election of Rotovia's first Nekos Senator, Senator Anita Veliant. The President was unavailable for comment, we will bring you more as it happens.

OOC: Actually I wanted to "test the waters" if you will before I consider taking a new approach to my nation in the future. I thought it might be intresting to place Rotovia in a moral quandry (spelling?). Let's see how this plays out. :)

When Presdident CeleKorn herd of this he was obviously very upset to say the least.
In an address herd throughout the world he said
"How can in one country the whole population be made of Elves and in another they are denied rights. This is an outrage against Elves everywhere and demands immediate action."
To this was also his responce to the question.

"Though we understand the point you are attempting to effect upon us, you must remember that the Senate cannot over ride the oreder of the Supreme Court, just as the Supreme Court can only reach their rulings based upon the acts of the Senate.

As it currently stands there is not a sufficant backing in the Senate for an amedment to the Sentient Rights Act, this is a situation I hope will one day change.

But for now, we will act within the law of land and offer our thanks for your nations opinion on what I am sure was a difficult decision for all to make."

"We ask El Vid to define 'alive' for us. The Sentient Rights Act provides Rotovia with the definition in relation to rights, and we do not see fit to grant rights to anything 'alive', for if we did so everything from algae to ebola would be granted said rights.

I furthur remind your nation that the Supreme Court of Rotovia has no juristiction over your nation, nor your nation of the Supreme Court and your rejection is quite irrelivant."

Clearly the definition is a legal one and it is therefore your right to define it whatever way you wish. The definition in our country is however very different.
With that in mind We would like to extend the hand of frendship to all elves in your land, and offer them citizenship within our borders with the full rights and so forth afforded by that title.

The finest of good fortune to your land!

"Your offer is very kind however the Elven populace donot hold the nessacary papers to travel outside our borders. We are also ceratin amny will be awaiting the next Seante Session where the Sentient Rights Act will no doubt be brought up."

International Press Release

Mr Il'dora Salvorun, famous of late for his landmark case in the Supreme Court, filed for and was denied an appeal to the High Court. High Court Justice Hon. Cathlene Thatcher stated "There is no legal basis to grant such an appeal. Protocol was follwed, law was cited and justice was denied. Though the decision made by the Supreme Court sickens me to my stomach, there is nothing I can do within the law, and it is by the law I am bound. For if not for the law than we have anarchy and chaos..".

It is believed the Mr Salvorun will seek a final appeal to the High Court of Appeals and if need be the Areopagus Council, a tribunal of select Judges who may here matters dealing directly with Decrees passed before the Rotovian Consituation was created.

We ask the nations of the world to remember we make no appology for our actions nor are we proud of them. Unfortunately change takes time, and no system is perfect and no man is without blame.
