A Brooklyn police officer testified Monday in a police-brutality trial that he saw a colleague jab a retractable baton between a suspect’s buttocks until more than half an inch of it disappeared from his view.
The testifying officer, Kevin Maloney, said that he heard what could have been a moan from the civilian, Michael Mineo, and then a question: Why, Mr. Mineo asked, had someone “stuck that walkie-talkie” into his buttocks.
Officer Maloney offered what appeared to be the strongest corroboration yet of accusations that Mr. Mineo brought in October 2008: that as he was being arrested by police officers for smoking marijuana, an officer named Richard Kern sodomized him with a hard object inside a Brooklyn subway station.
Officer Kern is on trial on charges of sexual abuse. Two other officers, Alex Cruz and Andrew Morales, are charged with covering up Officer Kern’s actions in the trial at State Supreme Court in Brooklyn.
The testimony came as the trial of the three officers entered its third week, amid the conflicting recollections of witnesses, including another police officer, and Mr. Mineo himself.
Officer Maloney was the first witness to testify that he saw Officer Kern hold the baton and then jab Mr. Mineo with it. He said he did not tell anyone what he had seen for several days, and finally came forward after hearing that investigators were focusing on Officer Cruz as the perpetrator instead of Officer Kern.
A prosecutor, Charles Guria, questioned Officer Maloney, 27, for much of the morning. Officer Maloney said he was one of four officers who chased Mr. Mineo, a tattoo artist, then 24 years old, in the Prospect Park subway station until they finally subdued him next to a tollbooth.
Officer Maloney showed the jury the way Officer Kern held the retractable baton, saying he had dragged it across Mr. Mineo’s buttocks before jabbing it between them.
He also recalled Officer Kern saying shortly afterward that Mr. Mineo was an “E.D.P.,” police jargon for an emotionally disturbed person.
After Mr. Mineo was handcuffed and placed in a patrol car, he showed several police officers his hand, which had blood on it, Officer Maloney said, adding that one of the police officers reacted by closing the car door.
Prosecutors were expected to call DNA experts Monday afternoon.
