YouTube battling 'Porn Day' campaign
by Elinor Mills
Updated 4:40 p.m. PDT with Google comment.
YouTube was busy deleting porn videos on Wednesday after users of forums at a rival site and an imageboard site declared a "Porn Day" campaign against the popular video service.
How the hell could we've missed this?! We could've put some really disgusting and revolting porn on there.
The forums at video site eBaum's World and 4chan organized the mass porn "carpet bombing" on YouTube, according to Ars Technica.
Gotta love Anon. and /b/.
YouTube has been removing the videos as fast as it can, but even videos that are removed are still showing up in search results with explicit images in the thumbnails, the report said.
It could take a couple of days for all the explicit results to be removed from the search results, Google spokesman Scott Rubin told Ars Technica.
They still won't get the softcore stuff.
In a phone interview with CNET News late on Wednesday, Rubin said that in addition to the porn videos were removed as soon as community members alert YouTube to them, certain channels where the posters were bragging about the campaign and listing the videos were being disabled.
Even on the internet you have goody two shoes and tattle tellers.
"This group of pranksters thought it would be funny to load a bunch of porn to YouTube," he said. "This is an unfortunate, and I think poorly directed, prank. I think our systems are doing really well at removing content that violates the guidelines."

yeah, I'm sure they'll be laughing real hard once Google sends them the bill for the cost of taking it all down.

meanwhile, insert typical "hey guys, look at how weird I can be! Is anyone paying attention to me yet?" post.
The big question being...why the fuck would we want to?

Why would Youtube do that? Youtube does make money through stocks (since it's owned by Google) and stuff like Youtube Live and advertisement, but Youtube isn't a subscription service.
That's like saying Jolt would send me a bill for taking down Spam threads if I decide to spam all of NS's forums with Spam.
It just doesn't make sense unless you think people who work on Youtube is actually going to track down however many people took part in this and fine them, and this is assuming that they didn't use a proxy.

Um, why would they? Well, let's see. You know those whole bunch of words you have to agree to when you post a video on youtube? That's what we call the "terms of service". It's a fancy way of saying "contract". And when you do something that you agree you won't do in the contract, that's call "breach of contract". And when you breach a contact and cause the non breaching party to suffer a cost? Guess what, you're liable.
For funies.
No thanks. I grew out of that kind of "funny" about 20 years ago. I have no need to debase myself by acting like a pre-teen loser.

You still fail to link fines to this. There's nothing in YouTube ToS about fines.

The ToS says nothing about fines. In reality land when someone violates the ToS of a website and service provided by a company like Google or YouTube, there is a warning, mostly one or two, and then a ban and removal of content. Fines almost never comes into the picture.
I now return you to your regularly scheduled program.

Posting porn on a site intended or a fairly universal audience (and thus, without any kind of rating system) erally is the sort of thing only pre-teen losers would do.
I don't see how that's a flame bait.

I don't think you know what "liable" means.

And no, sorry to tell you, but in "reality land", when someone breaches a contract, they tend to get sued. The TOS is a contract. Like any contract, if you breach it, and your breach causes the injured party to suffer costs, you are liable for those costs. Fines have nothing to do with it.
Google had to expend considerable effort to remove illicit videos that were posted in direct violation of the contract with their users. Guess what? That's a breach of contract! Guess what? The breachers are liable for costs.
Unless you want to try and tell me how things work in the "real world" of contract law.

7. Account Termination Policy
1. YouTube will terminate a User's access to its Website if, under appropriate circumstances, they are determined to be a repeat infringer.
2. YouTube reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. YouTube may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.
Since I know this is going to come up. Let's skip right to Copyright infringement.
If a counter-notice is received by the Copyright Agent, YouTube may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at YouTube's sole discretion.
There's nothing in YouTube TOS about court action being taken BY YouTube itself.

Oy. OK. Let's see if I can explain this in very simple terms. Because if this fails...i dunno what else will work. Puppets, maybe. Here we go.
The. TOS. Is. A. Contract.
Contracts. Are. Legally. Binding.
A contract doesn't have to say "and by the way we can take you to court if you break this". Of course it doesn't. That very concept is inherent in the idea of a contract. That's what a contract is. A legally enforceable document given with consideration on both sides, which allows an injured party to recover damages in the event of a breach.
A contract need not say that it does what a contract does, because it's a contract, and thus does what a contract does, by definition of law. Arguing that a contract needs to say "by the way, this contract? Yeah, it really is a contract, and does everything a contract does" is, from a legal standpoint, about as stupidly redundant as fine print on the bottle of Poland Springs going "this is water. You drink it, dumbass".

Your original premise of YouTube sending the bill to the attackers was still a stupid one.
It won't happen. YouTube will delete the videos, delete & ban the accounts, and move on their merry ways.

That's pretty much fines or bills. So you said it.
fine =/= bill.
A 'bill' is a statement of monies owed for services or goods provided. In this case, the cost for Youtube to go through their system and remove all the porn.
A 'fine' is a puntative penalty imposed for damage caused due to an offense or dereliction. A parking fine is not a bill for eg.
Thus, a court could find someone guilty of an offense, let's say refusing to pay for a service rendered, and demand they pay the bill outstanding for said service and, in addition, a fine on top to penalise them for having not paid.
I'm surprised I have to tell you this. Even I know this!
Your original premise of YouTube sending the bill to the attackers was still a stupid one.
I'm sorry to tell you but "yeah, well? you're a poopy head!" is not the respectable response. Just admit you were wrong and move on.

I was wrong on what could happen in the violation of a contact, I will admit that.
However, the original debate was what will happen, and my stance is still that Youtube will do nothing more than delete the videos and accounts.

Not too shabby a prank really, but a bit uncreative and lacking a deeper level of disruption.
Now if people posted thousands of video clips that are against the rules of Youtube for senseless reasons or due to the greet of companes like Viacom and NBC, I think I'd approve of it both for the entertainment value(thousands of Family Guy, Simpsons and SNL videos) and the social commentary.

Have you been under the crazy impression all this time that I'm not a fan of the penis? Because the penis and I are close personal friends.
In porn, it's usually the male genitalia I'm looking at, because I don't watch straight porn, and it's hard to find lesbian porn that isn't full of nasty-looking bleach blondes, which only leaves one option.
