I normally abhor Fox News, but yeah, he's right. Whether torture works or not is not the issue. It's an horrible violation of basic human rights, and there is no justifying it in a civilized society, otherwise we become just as bad as the terrorists we're supposedly above morally.

The creepy looking guy! I remember him! He's in the one previous instance of FoxNews coverage that made me not want to kill myself - except I totally can't remember what it was. It wasn't too long ago, so probably during the presidential campaign? Damn, I can't even remember who/what it was about. That'll drive me crazy...

Republicans know torture is illegal, but they believe themselves the arbiters of moral superiority and can thus rule waterboarding isn't torture. Also because right-wing talking heads say it isn't. It's not torture because they say it isn't and thus it isn't illegal. In spite of the fact we executed Japanese for waterboarding troops; court martialed our own troops for waterboarding Filipinos; and the CIA pulled the techniques from the military's training manual on how to resist torture.
