Idaho Sen. Larry Craig has lost his latest attempt to withdraw his guilty plea in the Minneapolis airport men's room sex sting that effectively ended his Senate career.

A three-judge panel of the Minnesota Court of Appeals on Tuesday rejected the Republican's bid to toss out his disorderly conduct conviction.

Craig still has the option of appealing to the Minnesota Supreme Court, and he said Tuesday he was considering future options.

Not surprising, but delightful nonetheless.

FWIW, here is a link to the Court of Appeals decision (10p pdf) (http://media.idahostatesman.com/smedia/2008/12/09/10/Craig_ruling_PDF.source.prod_affiliate.36.pdf).

What? I'm impatient for the Supreme Court to also deny his appeal.

Kehehehe, this case was featured on our Criminal Procedure midterm, and we had to explain under what circumstances a judge would allow someone to withdraw a guilty plea.

You can generally withdraw a guilty plea at any time up until sentencing. To do it after, you have to bring up issues of capacity etc...and obviously he was unsuccessful.

From Cat's link:
To be valid, a guilty plea must be “accurate, voluntary and intelligent.” State v. Ecker, 524 N.W.2d 712, 716 (Minn. 1994). For a plea to be accurate, it must be supported by a proper factual basis. Id. Appellant argues that the plea was not accurate because it lacked a full record of supporting facts.
Except it did.

Is it wrong of me to savor his pain?

Only if by labelling it 'wrong' it feels even better.

having sex in a mens restroom is a crime now?

though I'm not into international buggery by anonymous old men I find the thought of such clubs bringing hope for humanity

what is he hoping to get out of another appeal? it wont be forgotten as long as he is appealing it, he is already out of the senate, is anyone going to believe that he wasnt soliciting sex just because he withdraws his guilty plea?

surely its better for his wife and children to let it go.
