Did this cop overreact?

I think both parties are in the wrong here. The kid should've stop skateboarding and give the cops a bad attitude (Wow, sass talking the cop doesn't help you, SHOCKING!) However the Cop really didn't need to wrestle the kid to the ground and take his skateboard away since he didn't present any clear threat to the cop's person.

And he was suspended, I believe, so it appears that his superiors also thought eh overreacted.

As when this was brought up before ... yes
He needs to have some anger therapy before being put in charge of keeping people safe again.

I liked the last part, about "because if I find myself on-"

I think if you have to wear those silly shorts and drive that silly car, your sense of self-esteem is way low already.

He went way over the line.

He should be disciplined in my opinion.

EDIT: This was already posted a while ago and IIRC the majority of people said the cop was wrong

Oh, well I agree.

That kind of depends on whether the kids were able to hear the cop at first or not. Assuming this is the video I'm thinking about (fat yellow asshole of a cop) then the kid wasn't really talking back to him. I mean, all he said was that he couldn't hear the cop, and calling him dude--which is, might I add, ingrained in his speech pattern and unlikely to disappear, especially not under stress like that.

DUDE. That cop's a royal twat. I hope he picks on somebody 10 times his size with a rap sheet so long they won't care about beating the living dogshit out of him.

If it were me on my board with that fat fuck, I would have left on the board before it all started.

Kids these days need to relearn the concept of "run". That fat old fuck was clearly in no condition to chase after a kid riding a board.

My opinion: Stupid pig should be charged with assault, stupid 14 year olds should learn to run away.

No it very well could have turned out much worse for the kid and better for the cop if he had run, the kid did the right thing.

This was posted a couple weeks ago.

Also, the cop has no legal right to prevent anyone from speaking, no matter what the age, and also he is a traffic cop and so he is not really empowered, by the law to do much if the person is not resisting. In fact it would have been within the kids right to subdue the cop, if he could, if he felt that his life was threatened and since the cop said something along the line that you are gonna get yourself killed for talking like that it could be understood to be a threat.

It could have been worse, but I'm just one of those types to not take shit.

I've never been arrested in my whole life, and hell knows I've done a lot of illegal shit. I always ran/hid/retreated in time.

Though I guess the kid could have also stayed and faked remorse, that would have been the best outcome.

You're surprised that a police officer abused his/her authority? Cops are like lawyers -- 99% of cops make all the good ones look bad.

He's a petty tyrant who should've been charged with assault. Unfortunately, it's often the case that the people who want the power and authority of a police officer are the ones least able to use it responsibly.

Isn't suspended with pay (http://www.youtube.com/watch?v=qxMpgenFHp4&feature=related) like saying, "Here, have a vacation for being a douche"? Worst punishment ever.

Glad I wasn't there cause I laughed at the cop when he went "I'm not your father, I'm not your father, I'm not your father, SHUT UP!!!" on the kid. That is almost as ridiculous as that silly outfit that looks more like a Star Trek uniform than a cop uniform.

Must be the inner lawyer in me, cause when I saw that video I saw "$$$$" and "big cash settlement" and "assault and battery of a minor." Just me though.

What was most disturbing to me was that this cop was exhibiting signs of losing his temper. That became clear when no matter what the kid said (which, by the way, was not disrespectful) the cop was using it to build up the momentum of his own anger until the point at which he took the skateboard BY FORCE using a chokehold. He lost his temper, plain and simple, over so small an issue that I suspect he was having a bad day and this kid just triggered it by simply being there.

Once, on this forum, somebody said that cops were a cross-section of our society. Some good, some bad, most average people. I will repeat what I said then.

That's not good enough. If people are going to be empowered by the government to make arrests, enforce the law, carry weapons and detain people then those people need to be the best we have. They need to be the most trustworthy, the most balanced, and the best at controlling their tempers. Anything less, and this is the result.

The cop should obviously have lost his job for his display of police brutality. Howver, unfortunately he pretty much dogded a bullet by only getting suspeneded w/ pay.

Someone earlier in the thread said that those kids should have run, let me be clear when i say that in all situations like these, running is the WORST POSSIBLE OPTION.

If these kids had run, the cop would have had probable cause to chase down subdue them like he did, and SEARCH them. Im not saying that the kids did, but if they had weed or some other drugs on them, running would have gotten them cuaght.

In these situations its best to let the cop run his mouth, feel important, and strengthen his pathetic psyche. Doing this will get you out of there as quickly as possible. I know it sucks biting your tongue at an asshole cop, but trust me, its the best way to go.

Seeing as what the cop said "If you call me dude one more time..." can plausibly be interpreted as a threat, and then the cop assaulted the kid, the kids would have been in their right to kick the living shit out of that cop. But this is only true because they had a video camera. If you cant document an unjust act by a cop, it never happened. Kicking the shit out of that cop in that situation would have required balls of steel. Something I certainly could not have done, but it could have taken place.

Actually the idea behind being suspended with pay is that you are under investigation for some possible act that might result in your termination, but it is not certain, so to be fair they are temporarily removing you from your duties but still paying you since they don't know you actually did the possible act.

Basically it's an innocent until proven guilty thing.
