Man faces second-degree murder charge in Flint officer's death

INDEPENDENCE TWP. -- As second shift Flint police officers donned "mourning bans" in honor of one of their own killed in a traffic crash Sunday, a Brandon Township man was charged in the case.

Warrants for Ramon Felix Pineda, 25, of Brandon Township were sworn out this afternoon before Clarkston District Judge Kelley Kostin. Pineda was expected to be arraigned this afternoon.

In swearing out the warrant, Oakland County Sheriff's Department Lt. James Ahearn told Kostin that Pineda admitted he drank seven beers before the accident Sunday night that killed off-duty officer Vincent D'Anna.

Pineda also admitted sneaking into the country from Mexico 10 years ago and using a false identification when arrested, Ahearn told the judge.

Pineda faces charges of second-degree murder, operating while intoxicated causing death, leaving the scene of an accident causing death and driving while license suspended.

The second-degree murder charge carries a maximum life term.

In an e-mail press release, Oakland County Undersheriff Mike McCabe said Immigration and Customs Enforcement have been notified about Pineda.

D'Anna, 26, of Goodrich, died after his motorcycle was struck from behind by a car on Sashabaw Road outside the DTE Energy Music Theatre about 8 p.m.

The off-duty officer was pinned under the car and dragged about 70 feet before the driver allegedly jumped out and tried to run from the scene.

Witnesses stopped and restrained the driver of the car until Oakland County Sheriff's deputies arrived.

Family and friends of Flint police Officer Vincent D'Anna watched grimly as Ramon Felix Pineda, 25, of Brandon Township was arraigned before Clarkston District Judge Kelley Kostin about 4 p.m. today.

Pineda faces charges of second-degree murder, operating while intoxicated causing death, leaving the scene of an accident causing death and driving while license suspended.

Despite a plea from Clarkston attorney Arthur Greenstone for bond in the case, Kostin ordered Pineda held without bond. Oakland County Assistant Prosecutor Kelly Chard argued against any bond, noting that Pineda was an illegal alien, a citizen of Mexico who gave numerous aliases and a number of addresses.

A preliminary exam will be set within 14 days, the judge said.

Greenstone told the judge that Pineda had worked as a cook for five years for the Old Village Cafe in Clarkston and that he and a woman, alternately described as his wife or girlfriend, have a 19-month-old son.

Also in the courtroom during the arraignment was Flint Acting Police Chief Gary Hagler, who said he is satisfied with how the case is being handled.

The second-degree murder charge carries a maximum life term.

First and foremost, I do not want this to turn into a debate over illegal aliens in America. That can be in another thread (someone else may start it, if they'd like).

It just infuriates me that people can do this. Perhaps I'm naiive, but I'll never understand what makes this guy think that trying to race off, without a care of the person in front of him, will do him any good.

Vincent D'Anna is my boyfriend's brother. I've been with Elliott (his brother) for the last two months, supporting him through everything. The preliminary court case finally ended (I came to the last one, where he was binded with his charges), and he received a second degree murder charge. Thank God. I hope he goes to prison for life, without parole.

The defendant's attorney used the argument "If you have a log stuck under your car, you're going to want to speed up and get it out from under you". Well guess what. A human is not a log, ass.

The actual trial starts in January, and I'll be there through everything.
