Idaho judge rejects plea change for Craig

Though he vowed to resign if this were to happen, don't expect anything on that anytime soon.

Judge denies Craig's request to withdraw guilty plea, says claim was 'illogical' (http://www.idahostatesman.com/newsupdates/story/175263.html)

Now, what interesting here is that the Democrat running for the seat is becoming more viable the longer this drags out. A Democrat senator from IDAHO?? Who'da thunk it...

EDIT: Sorry not an Idaho judge, the judge was in Minnesota, where the crime took place. Pardon...

Good. There was no sound legal reason to withdraw that plea.

but its not FAIR!

poor mr craig only pled guilty so that no one would know that he had been soliciting gay sex. now that everyone knows he should be able to try to weasel out of it some other way.

or in other words

Exactly. This is the correct result.

Now we get to see if Craig will engage in further gymnastics or will resign as he "intended."

who knows. As ashmoria said, this whole thing was a calculated political move. He pled because he didn't want it public. Now that it became public anyway, he tried to withdraw his plea because it no longer served his political purpose.

Do we trust this kind of man to stay true to his word? Doubtful. Hopefully he doesn't. Democrats already have the majority in the senate, and if he continues this line he gaurentees a dem senate replacement next election.

Good for the judge. It's simple, if you are not guilty you don't plead guilty. Let's all hope Craig does the honorable thing and resign like he said he would.

God it's so cute you think a politician would do something honorable. I love naiveté.

and Craig issues a statement saying he...will NOT be resigning (http://www.cnn.com/2007/POLITICS/10/04/craig.arrest/index.html)

actually, its not always that simple in the real world. see, the point of pleading guilty is almost always to get a lesser punishment than if you go to trial and are found guilty anyways. so if you are promised a small punishment for a guilty plea and a large punishment if you lose at trial, the decision doesn't wind up depending entirely on your actual guilt or innocence, but rather on how much you are willing to bet that other people will believe you. and, for example, when you can't afford a good lawyer, that lesser charge might start looking awfully tempting compared to the alternative you risk.

Exactly. Craig was afraid to take any risk. If he lost and went to jail, he might be on the receiving end of some unsolicited gay sex. To avoid hot gay prison sex at all costs, he had to plead guilty to wanting hot gay public restroom sex.
