Can I sue tagged.com ?

Since you guys and girls are probably awake (or some of ya) and legal places aint right now, does anyone know if I'd be able to sue tagged.com for continuing (despite being made aware of this by several people) to allow a company to try to download viruses to your computer (under the guise of a free 'system checker' which tries to download as soon as you press the 'no' button (or any other button) after it "asks" you if you want to download the 'system checker'? (This happens as soon as you log on, although occasionally it doesn't happen at all)

Notes: I live in England, UK. Tagged.com is based in the USA.

In order to sue someone you need to demonstrate damages. What damages have you suffered as a result of this?

Aww. None, as my pop-up blocker blocked the attempted download (but it managed to download onto a friend's computer and fucked it up). Is it not illegal then to attempt to download a virus if the computer being attacked just happens to have good virus protection? If I can't sue, can I at least have the owners of the site arrested for taking part in criminal activity (by allowing the use of their website for virus downloads)?

P.S. Does me not being able to use tagged.com and speak to friends on there count as damages (as there's the possibility that my virus protection may not block all the viruses that tagged.com tries to throw at the computer)?

you could like not click on pop-ups and like not go to that site. I don't really know what legal recourse you have if all you have is "they might be trying to do something that might be illegal maybe"

I didn't click anything. I simply logged on to the site (it's kinda like myspace but with a chat section) and as soon as I was logged on, there was an attempt at downloading viruses. It's happened many times and to other people and aren't tagged responsible for the content of their website (and isn't downloading viruses illegal so therefore isn't deliberately allowing such downloads on your site illegal?)

take it to the cops if its a virus, they should send an angry letter (since there computers will now be compromised after you show them it in action) or something along those lines...

ah the amount of spam I have from people I thought where sentient with invitations to this site :p
