The couple is charged with violating a noise code aimed at "the shouting and crying of peddlers, hawkers and vendors which disturbs the peace and quiet of the neighborhood.

theres a big difference between children playing and street vendors.....if you are that big of an asshole you deserve to have a UPS shipping plant AND and international airport built in your back and front yards

Thrown out. The judge recognized it was too stupid to prosecute, esp. since the law they cited was one used to keep vendors, peddler and other commercial folks from being too loud -- not preteens.

This is actually a little hard to judge without more information. We don't know how loud the kids were, and I can definitely imagine kids that are out of control and loud enough to warrant a fine.

Depends how loud they were, just because they're kids doesn't give them carte blanche to be as noisy as they like.

On a side note, it's nothing compared to a legal case in the UK.

A man was successful on appeal in having his sentence reduced from murder to manslaughter after court of appeal decided trial judge should not have told the jury that the crying of a 17 day old baby could not constitute provocation to murder.

Not as sensational as it first appears, since the judge should have told them to think how the reasonable man would have reacted. But in theory anything can constitute provocation to murder.

Agreed. I used to play out and probably made a bit of noise in the street. The trouble is that now kids seem to be out later and be noisier than ever.

Where I used to live it was the norm to be kept awake by 'chav kids' at all hours.

Kids need safe clean areas to play. Parents need to keep them from upsetting everybody else.

Large stereotype coming - the parents of the kids out late probably didn't want them in the house disturbing 'adult time' and did not have to get up at 7am after a broken night sleep, but had the luxury of sleeping all day. In some areas these people are virtually nocturnal.

Kids like that belong in boot camp learning to be responsible adults, not in pools playing like little heathens.

The parents should not have been charged. The kids should have. Someone has to teach the little bastards some respect for authority. Kids have too much freedom and too much "oh, just let them be kids" bullshit going on. The world's too big, complicated, and hard to let kids be kids. Kids who don't go out and do something responsible with their time, like go pick up trash on the side of the road or wash people's cars, deserve everything bad that happens to them.

Bravo to those who pressed charges. May the charges be re-pressed against the kids.

Nope. Not joking. I flat-out hate kids. And I'm not trolling. Maybe ranting like a grumpy old man, but not joking or trolling. I just plain don't like kids. And I'm not making up the bit about my MIL's obnoxious neighbors, either.

I don't have any kids. But when I do, I expect to have them as fully-functional adults by age 10, though I guess I'll settle for 12.

Usually there is a "silent zone" around when people use to sleep, where barely any sound should be heard, and for the rest of the day there's a quite high threshold.

If You're not able to educate Your children not to disturb the others, then You shouldn't have any.

This should be plain clear to anyone who wants to sleep at night, or read a newspaper in a sunday afternoon.

What seems to slip to most here, is how hellish and loud some untaught children can be.

In all fairness, if I came home from a 12 hour shift to noisy kids next door, I'd be peeved too.

I must confess there are days when I want nothing more than to repeatedly kick children who make excessive noise, all day, every day, for six weeks. Firstly, they have no right to be noisy before midday; nobody should, when off school, be in any state to do anything before then. Secondly, there is a difference between noise and screaming; the latter, from 9 until 9, is frankly vexing. Thirdly, I don't have a choice about living in the suburbs. I'm 18, I don't leave for university until October, and I cannot be held to account if my father lacks the ambition to take a sodding promotion.

However, sueing does seem excessive; a simple letter, or, indeed, a visit, ought to have sufficed.
