And this was a schoolteacher?

I can hardly see how this counts as "rape". I mean, how can someone be so stupid as to believe his story that a doctor told him to apply the medicine in this manner?

It appears to me as though she gave consent to be penetrated.

Stupid, maybe, but I don't see how it can count as deception. She's an educated school teacher, not a barely functional person with Down's Syndrome.

The woman must be slightly retarded and the guy took advantage of a retard. The only sensible thing to do is to sterilize eveyone involved so that they don't end up reproducing.

Some people are niave and trusting. I've noticed people with exceptional inteligence or common sense tend to lack in the other. So to insult the persons inteligence is not the thing to do. The man who did this found an obvious 'sucker' and took advantage of the situation for personal gain. He deserves punishment, and the woman should learn a lesson in trust. Sitting here and making fun of the whole situation is not a solution, nor is it appropriate. It was wrong, it was vulgar, and it was might I dare say 'evil' of him to do. Personally I think he should be punished by being made into a unich and if he ever attempts to scam someone again, they can cut his tongue out and feed it to rabid weasels. All without any kind of anastesia mind you.

Its a preventative measure to insure that he never again attempts such wicked and stupid acts, and will hopefully send him down a 'better' path. The puritans did things similar to that all the time and it was never considered 'evil'. The catholic church killed millions of people who were 'heretics' and 'witches' and not good catholics or catholics at all during the crusades and the inquisition, but it was never at the time branded 'evil'. The Nazi Party killed endless numbers of 'undesirables' but nobody spoke out and called it 'evil' until it was all done and over with. Muslim extremist groups blow up school buses, stores, innocent people, each other, and foreign soldiers alike all over the middle east and in other parts of the world ON A DAILY BASIS and the only people to speak out and call it 'evil' are now rediculed; and Islamists are supposed to be peaceful.
So how can you possibly justify the removal of the testicels and penis of a rapist to prevent further problems as being 'evil'?

Consent is not real if the person is deceived about the identity of the person or the nature and quality of the act. So if she believed it was going to benefit her and it wasn't then the consent wasn't real and the guy is guilty

You would have to argue that the deception was real.

I could argue that it's simply not believable that an educated person would believe such a story - that she knew it was a joke, and let him fuck her anyway.

yeah, even if the story is real i can't see any judge accepting it unless the woman can prove she has a history of gullibility. or if they can find someone the pilot boasted to who's willing to testify.

and in the reverse side... does this mean that a man can sue for rape should the woman insist that "she's safe at this time of the month" or that "she's on the pill" and ends up getting pregnant?

what if the woman the man is with reveals that the's actually a Post Op Transsexual after the sex. would that also fall under deception (lying by omission)?

rape, in all circumstances, is a horrendous action. I do not support rape in any circumstances. This is true regardless, or, perhaps, especially if the individual is of lower intellect.

You don't necessarily have to believe that the woman is telling the truth to see that it is a dangerous thing to take into account somebody's intelligence when it comes to being the victim of a crime. And I'm not saying that that is what you are saying only that is what I feel some people think.

Assuming she isn't lying the man could still argue that he never seriously considered the possibility that she took his story serious, based on her assumed intelligence - reducing the amount of blame one should assign to him.
Though if she really inquired after the name of his "doctor" repeatedly that would be slightly more difficult to maintain.

Well, yeah. I'm not really speculating about whether or not she's telling the truth. I don't know and at this point nobody knows and I'm sure people have good reasons for believing one way or another. I'm not really concerning myself with the case itself. Yes, but are you required to ask your partner for ID if he/she states that (s)he is of age ? After all, the differences between an 8 and an 18 year old are generally obvious, but a 15 year old dressing as 18+ can be very convincing.

So, if the girl says she's 20 - and it turns out she is in fact 15 - is that a mitigating circumstance or not according to the laws in your country ?
