There's a lot of debate over what message the writers are trying to convey with this. I have two theories: Either they're commenting on the state of American civil rights in regards to the patriot act, wiretapping, and Guantanamo et al, or this is a ploy to get more people to buy the comic.

good point, I definitely believe they are commenting on the state of America's civil rights. Capt. America was created in 1941 when we declared war on the Axis powers, he was a symbol for America as a nation killing Capt. America can really mean only one thing: the death of America.

if he is dead. for all we know, Cap could be playing possum (he's done it before)
this is all during the Civil War timeline. where super powered beings are being forced to Reveal their identities and register with the Government.
so it's more of a commentary of Civil Rights than anything else. Not Guantanimo, not Wiretapping, just the right to privacy and responsiblity. (the situation started out when a Group of Heroes are killed during a "reality show" taping of them taking out some super-powered villians. The collateral damage included the neighborhood and a nearby Elementary school.)

Except that Captain America did die. He was sucked into a space rift or some such and transported into an alternate dimension, never to be seen again. I think he was killed off more because his particular brand of patriotism didn't make much sense after Vietnam and the JFK assassination. Although he did end up confronting some surprisingly human issues toward the end of WWII, such as conditions in POW camps.

I haven't read the comic but as I understand it in the civil war going on between the superheroes, Captain America was on the side fighting the government and iits attack on civil rights. Sounds like his death was a plus for the government and its aims so I suppose it could be saying that the attacks on our rights are succeeding.
