DUI in a Go Kart? (US law question)

Ok, this is a somewhat stupid question, but is it illegal to race Go-Karts (the ones at like a mini-golf place on a track) if you're under the influence? I ask because myself and some friends are planning on getting fucked up tomorrow and heading down to the fun park to race Go-Karts.

I don't know about the legality of racing, but I'm more than willing to bet that the fun park won't allow drunks to drive their go-karts.

You're going to be fucked up, perhaps you're not going to be drunk, but you're going to be 'under the influence', and as far as the fun park is going to be concerned that's too much of a risk.

They'll probably tell you to go to hell or they'll call the police when you show up.

Well, I mean is it like jailtime or something if we get caught.

Honestly couldn't tell you on the DUI matter, but I can say that on various other issues probably.

Not to mention that you'd probably run the risk of a lawsuit from the fun park.

There's kinds of 'fucked up' where you can maintain. Hell, I've maintained on acid and shrums.

But of course, being that kind of fucked up is already illegal, so what you do under that condition is only going to be marginal if you're caught.

I do not believe that you'll get a DUI for operating a fun cart fucked up, but I'm not a lawyer and this should not be construed as legal advice, I'm really just guessing.

I don't think they would bring suit unless you wrecked shop on their karts.

Well, unless they happened to be a lawyer in Georgia they probably wouldn't know since things like this fall under state law.

I'd doubt it as well, but if the owner is uniquely uptight they might go after it.

Suppose it depends on where you operate it ... I am sure there is all kinds of reckless endangerment and such you can be charged with, but your charges will depend on where and who you get caught by

Here, in Victoria, they won't let you drive them if you have any alcohol in your system. I went to a place for a bucks night & we had to do a breath test before we were allowed near the karts.

There would definitely be legal ramifications if you damaged their property or injured someone.

Well, we can maintain fine. We're probably just gunna be fucked up on a low dose of Benzos and maybe a blunt split between 2 or 3 people. I mean, as long as they don't smell liquor on us I think it would be fine getting in there.

I've seen several people (can't think of names off the top of my head) that have claimed to be lawyers in various discussions on this forum.

I don't think there's any specific law against driving drunk in a go-kart, any more than there'd be a specific law against riding a bicycle when drunk. You don't need a license to drive a go-kart in the U.S., they're not permitted on public streets or roads, and honestly, there's not much damage you could do whilst driving one, except possibly to yourself (and the go-kart).

If you were visibly drunk at one of our nation's many wonderful theme parks and wanted to have a go at the go-karts, the staff of the park probably wouldn't let you, and if they did, and you crashed it, you'd likely get done for Drunk & Disorderly Behavior and for damage to the park's property.

Honestly if you're appear fucked up the most they're are likely do is refuse you, if you're driving backwards on the course or something like that, again, they're really just likely to ask you to leave.

If you're a pain in the ass about leaving, then it might get all horrorshow, but most likely they'll just want you to get out of their hair. It's people just above minimum wage at best, they just want to get through their day and go home and do what you're doing, really.

Really? Plenty of people bash their oar in usually claiming some form of law credentials until it is not a hot topic. That wasn't directed to Cat in any case.

While you are here though, you are a car person. SAAB 9-5, or Infiniti G35. I need to replace my current car (don't ask) so which would you go for if any.

Girlfriend wants the G35. I'm not so sure. I had a SAAB and miss it.

I'd have to recluse (I'm usin' terms...) because I have a bias towards the SAAB and against the Infiniti, but this is based on things more personal than anything else. There are people who like the G35, I just hate it, but I don't have sound logical reasons.

I don't like it that much anyway, I think. But it lacks torque steer, which is good, I'm just worried about the longevity.

The 35 is shit fast.

I do dislike front wheel drive. It took abusing a rental before I could get the hang of it. This took me a second because I could have swore that SAAB did have an AWD, but I didn't see it.

The G35 is faster and probably better equipped, but it's basically a Skyline, and I got a hate on for the Skyline.

Ahhh, now we get to the nitty gritty. I have no idea what a skyline is. This is why I come here. Some people know shit and it can help you.

Oh, and jam your foot to the floor with a 9-5 (stick shift) and you will see what I mean.

Great car otherwise though.

I caught the turbo lag pulling out of a turn in a 900 Turbo, I know. I suddenly understood the whole fascination with throwing the backend around. I'll take RWD pretty much all the time.

But then, I live in a pretty temperate climate, I can get away with just about anything. I never see snow.

The Skyline is kind of like the Japanese Corvette, it's their national 'everyman' sports car, but in their case it's a big ass coupe. It's been around forever but not here in the US. I think there are grey market ones in the UK, but I honestly don't know. For all I know they're imported regularly. There is a huge following for them, which is part of where I get my Haterade.

Why do you hate the Skyline? I mean where else do you see a car with the rear view mirrors on the hood?

It's not a public road. So even though I'm not a lawyer and I explicitly tell you that you should not rely on my advice in this matter...I don't think the State has jurisdiction on that.

People can drive a tractor on their land while drunk, can't they?

Oh, and Lacadaemon: Get an Audi A4. Quattro, if you can afford it.

As far as I know, that's the rule--but if you deliberately fuck up the go-karts or whatever, the place renting them to you can hold you liable for the damages and potentially have you arrested for vandalism if they think you had the intent of fucking their stuff up.

YOU are the problem. What you and your friends plan on doing is totally wrong and totally irresponsible.

Take a worse case scenario whereby one of you causes a personal injury or worse to someone else. Although I am not a lawyer, I would assume that you would be liable in the eyes of the law.

The very fact that you are weighing the possibility of going to jail should be a wake up call.

Don't do it. It might not be worth it.

Yes, you can get a DUI if under the influence of alcohol in anything with a motor. You can even be given a DUI for riding a bicycle under the influence of alcohol.

My answer applies to Michigan: It's illegal to operate a motor vehicle with a blood alcohol content of .08 (per 210 ml of breath) or higher on a road or anyplace open to the general public. This includes frozen lakes and parking lots. A go-kart is a vehicle and has a motor. So, the true question is...is the go-kart track open to the general public? I'd say yes, but its arguable.

They say that a journey of a 1000 miles starts with the first step. I am glad to see that you have embarked on that journey. :D

All kidding aside, there are somethings in life that are just common sense, and others that have been learned the hard way. There are somethings that I did in the past and got away with them, but it doesn't mean that I will always get away with them in the future.

Here in Ontario, one can be charged as impaired while operating a motorized vehicle of any description (car, truck, snowmobile, boat, etc.), while riding a bicycle, and even while riding a horse.

I would imagine that if someone was injured or killed as a result, then there would be charges laid. I guess the keyword is IF.
