the 9th circuit court of appeals ruled that it is illegal for Major League Baseball and the MLB Players Association to keep urine samples and steroid tests confidential, and have ordered both to send the samples (including the names of about 100 people) to investigators.

Its legal, they cannot hold evidence in a case without being charged for it, if they do they are interferring in the jurisdiction of whatever who has requested them and tampering with evidence or withholding evidence is illegal and criminial in nature.

the 'test secrecy' was agreed upon by both MLB and its players association in collective bargaining.

a note: normally when results like this are transferred to investigative hands, they leak soon thereafter to the public.
