FISA Warrants?

Most of you have heard the story about how the US spied on Diana and her phone conversations, etc.

has the US denying that they ever did it, or if they did, it was an accident.

More to the point, they were bugging her conversations with this man, a prominent Republican.

Now, if I remember FISA correctly, you need a warrant to conduct any surveillance of any conversation between a US Citizen and a foreign national.

Forstmann is a US Citizen, and Diana was a foreign national.

Was it done with, or without a warrant?

To get a FISA warrant, you have to have probable cause to show that either Forstmann or Diana is an agent of a foreign power, and you would have to show that this was part of an ongoing criminal investigation.

You know, like we figure one of them is a terrorist.

And we have this statement from Gore, back during the Bush attempt to run roughshod over the FISA court:

Both before and after the Foreign Intelligence Surveillance Act was amended in 1995, the Clinton-Gore administration complied fully and completely with the terms of the law.

So, show me the warrant.

Only right wing governments rund roughshod over individual rights. It's a known fact.

Anything that newlab or the democrats do is carefully considered, and with our best interests at heart.

All of this is speculation at this point. NSA is denying doing any spying at all, but even if Diana was a target, there's no requirement for a FISA warrant because she wasn't a US citizen and she wasn't in the US.

But if they broke the law, send their asses to jail.

Yes there is. The conversation was between Diana (a foreign national), and a US Citizen, as I pointed out.

That requires a FISA warrant. I am trying to imagine how you would come up with the probable cause for that one - that either Diana or Forstmann were agents of a hostile enemy of the United States.

If there's proof, send them to jail. So far, there's only been speculation.

I thought you said that you were all for equal enforcement of the law.

Would you call for and support a Congressional and Justice Department investigation into this?

Didn't hear you call for an investigation. Have you called for one on Bush in this forum?

If so, where's your equal use of the law?
