Some dude has been faking mental retardation since he was eight to get social security checks. His mother claimed that he couldn't read, write, shower or drive. He got caught on video fighting a traffic ticket in court and now he's busted.

That, to me, is "retarded" to the point where he's not responsible for his actions.
If he could get up, go to the kitchen, and make his own sandwich (however slowly), I wouldn't have any problem finding him responsible if there was a criminal matter.
