And they took lots of downloads offline after being told the owner wanted to sell the game again. They kept the review online but replaced the download link with one to a vendor that sold those games. I can't see the problem with this?

Hell, abandonware does us all a service by making sure that old titles aren't lost to time.

Abandonia asked for permission before offering programs for download, if there was someone left holding the rights. And they took lots of downloads offline after being told the owner wanted to sell the game again. They kept the review online but replaced the download link with one to a vendor that sold those games. I can't see the problem with this?

And WTF does open source have to do with abandonware? Most Abandonware communities have asbsolutely nothing to do with OSS.

And, actually, there are some real abandonware floating about... Depending on copyright laws licenses to some software have defaulted to countries (and thus public domain) after the companies went belly-up. Also, many games have been released to PD by their owners (Beneath a steel sky comes to mind) In addition to those, many companies have an active policy not to enforce copyright on stuff that is not commercially viable as it is essentially free advertising. It ain't stealing if the owner says it's ok.

That being said, most of the stuff found on abandoware sites is just plain stealing.

I just checked, and it is up and running fine. [removed] I use it to get games that I paid for 10-15 years ago, and then stupidly threw away. Some of the retro games are more fun than the new ones.

Well copyright doesn't give permission if they can't find somebody to ask. This is a common mistake made by abandonware proponents. In many cases, you have to do some digging to find who owns the copyright as they could have changed hands a few times.

Abandonware is not legal.

The copyright is still in force usually. The fact it's no longer supported doesn't give you the right to copy it.

Unless of course you have formal permission.

They do have formal permission, and they often get checked by the ESA for violations of copyright.

Its not going to stop me. I'll play it anyway. Even with copyright if they are not making money off of it then they don't care. Thats why everybody plays SNES and older games on emulators.

Also a good point. I was just playing an old Sega CD game called "the Third World War" on an emulator.

While I may not have the express legal right to copy it; how else would I obtain a legitimate copy of this software? I hardly think any developer has a vested interest in releasing old Sega CD games that nobody has ever heard of. In fact, I don't think i've ever seen a Sega CD console, much less owned one. Furthermore, I hardly think anyone is going to prosecute me for doing so.

It's called copyright. Just because they aren't selling it, doesn't give you the right to copy it and play it.The crime is called "copyright violation". Theft is not an accurate term for describing it. Not any more than (half-arsed analogy following) describing non-lethal assault as murder.

As for me, I don't give a damn whether I violate someone's copyright or not, unless serious consequences would follow. I do not cause any kind of harm or loss, and therefore, I have no reason to.
