ABC News has confirmed that Adam Gadahn, the American who converted to Islam and joined al Qaeda, has been charged in a sealed indictment with providing material support to terrorism.

Gadahn recently appeared with al Qaeda's No. 2 in command Ayman Zawahiri exhorting Americans to convert to Islam. Gadahn, in addition to helping al Qaeda with propaganda and communications, is also suspected of helping al Qaeda with English translations and understanding U.S. culture and vulnerabilities. Charges may be announced in the next week. Officials have also considered charging Gadahn with treason.

Considering this video, I don't think there will be much trouble finding the witnesses to the act of treason. If Lord Haw Haw is any precedent, he'll be doing Danny Deever after a fair trial.

The same crime that Lord Haw Haw was hung for by the UK. And Tokyo Rose nearly hung for by the US.

If you're the enemy's official mouthpiece, encouraging surrender, it's a hanging offense.

That's kinda stupid. It's fair enough if they're from your side like Haw Haw or Gadahn, but not, say, a German preaching for the Nazis in 1940.

That's why Haw Haw got it in the neck and Rose got off. Lord Haw Haw was shown to still have British Citizenship, which made what he did treason, while Tokyo Rose's citizenship was more questionable. I believe she spent a few years in prison though.

Lord Haw Haw was a classic. As was Hanoi Hannah. Tokyo Rose is too cute. Azzam the American is dull as can be.

It's one thing for an individual to say it. It's another for someone to be the official al-Qaeda spokesman on several videos.

Plenty of historical and legal precedent. The definition of treason is very narrowly defined, and he just stepped right into it.

What I find puzzling is how 'enemies' is defined wrt treason. Now, if you have a declared official war, its pretty easy to tell who counts as an enemy, but in situations like the cold war or the war on terror it is all something of a grey area.

I remember seeing photos of Wehrmacht deserters caught by SS field police.

They were hung in batches from trees, and found only hours later by US troops.

There were signs around their necks, but I couldn't make out what they said.

Seems pretty clear to me, no "grey area" here. 1, 4, 5, and 8 seem to apply in all cases mentioned above.
