These really piss me off. Today I'm watching TV and an advert for one of these comes on. A woman received £10000 for falling over on a pavement. I mean wtf?! Who sues for falling over a pavement. Is it just me or are these claims so damn stupid. There my mini rant over

Hey, I could fall over on a pavement, easy!

I'm glad to see the US isn't the only place these idiotic suits happen. My favorite is the woman who spilled her coffee on herself and claimed in her suit that they should have warned her it was hot enough to scald. It's these suits that cause the absurd warnings on things like "Sticking this knife in your ear may cause brain damage." Personally, I don't think there should be warnings, let these people remove themselves from the gene pool.

I think the general idea is you only sue if you trip on something outside of what would normally be acceptable.

They were building new appartments on the main road where I lived, and I accidently tripped on the broken pavement because they hadn't fenced it off properly from the public. THAT kind of thing you can sue over, but I didnt cuz I couldnt be bothered.

It's like you can sue if you have a car accident, you can sue the road authority for it for not providing safer roads.

I could sue the man sitting opposite me right now because he looked at me and winked. Harrassment.

It's silly.

To be fair, I'm pretty sure coffee isn't supposed to cause third degree burns and require skin grafting to repair the injuries...

True, but then again one ought not put a cup of hot coffee between one's thighs and drive off down the road, which is what I heard happened.

She wasn't driving (http://www.answers.com/topic/liebeck-v-mcdonald-s-corp). She was in the passenger seat, while the car wasn't moving. She was attempting to remove the lid of the coffee so she could add sugar and cream.

While I'm still not entirely sure what to make of the case, it isn't as clear cut as most people seem to think.

Hey thanks for that link! This case is ALWAYS quoted as an example of a 'frivolous' lawsuit....I find the details very interesting, and will enjoy introducing them the next time I come accross this example:)

After having visited the UK for a few months, I really had the idea that they weren't as lawsuit happy as the US.

It was certainly nice of them to paint "LOOK RIGHT" on the pavement, so that ignorant tourists would not be killed crossing the road (I believe the signs are intended for people who are used to cars driving on the other side of the road).

But in general, there was an appalling (by US standards) lack of safety equipment in public.

Most public cliffs in parks in the US are well protected by railings, and large signs imploring you to be careful and stay away from the edge. In some places, the park ranger will be there to shoo you away from the edge.

I went on a coastal walk in Dover - self-guided. And if you're fucking stupid enough to play at the edge, no one is going to stop you, and there isn't a sign in sight anywhere.

I am sometimes inclined to think that certain dangerous sites should be left unguarded, so that the stupid among us will perish.

As lawyer for myself for No Apparent Court Case At Present (see here http://forums.jolt.co.uk/showthread.php?p=11483303), I've decided to make two points. They are against the spirit of National Pointless Day, but I don't care :P

1. If I trip over a pavement cus I'm clumsy, I wouldn't sue. If I trip over a pavement because a big chunk of paving stone is sticking right up out of the ground, I have every right to sue. People are paying their taxes for pavements and roads to be kept in a reasonable state of repair.

2. As for ridiculous lawsuits, try the McDonalds one (about it causing overweightness) here (england). Or try suing someone for accidentally breaking a rib when they did CPR on you that saved your life. Go on. Ah dare ya :P

P.S. If you try point 2, look forward to losing a lot of money.

That, my friend, in it's rare occurences (it isn't on that many roads in comparison with the amount of roads in the UK) is for roads where it may not be clear (due to severeal lanes and severeal traffis islands for example) which way the traffic is going to come from

That's cus hardly anyone ever gets sued over it here. In England anyway, not sure about the rest of the UK. Scotland has some majorly different rules on some stuff (eg. slapping kids is illegal there). :)
