You're doing something very wrong if your biscuits are flat. Anyhoo, if they taste good with sausage gravy slathered all over them then they're biscuits.

the hints in the name.

Its a worldwide conspiracy, each yeay the chocolate layer gets thinner, as does the cake and jam, soon they will start selling empty tubes.

What's a jaffa cake?

I think they are sold as "pims" in the US.

Little sponge cake with orange jam and chocolate.

Biscuits (crackers) go soft when stale, cakes go hard. Simple as that.

I sense a long night debating what different words mean in English and American English again.

Like Ho Ho's? But instead of jam Ho Ho's have sweet cream inside. Personally I prefer hamwinkies. Twinkies wrapped in smoked ham. Actually I haven't tried them, but the guy who hosts the soup seems to think highly of them. http://www.twinkies.com/hohos.asp

Seems in the UK they're cakes for the purposes of taxation but biscuits for the purposes of marketing. Wiki (http://en.wikipedia.org/wiki/Jaffa_Cake) has a nice article.

Oh! Yummy. :) I'd call them cookies, so if that's what you mean by "biscuit", then I'll go with that.

This is exactly right. The defination was established in an English court arfter the govt. tried to charge VAT on Jaffa Cakes.

In the UK you have to pay VAT on a biscuit the contains chocolate but not on a cake that contains chocolate so McVities fought them and won.

And this would only happen in a decadent, bourgeoise society like England! When the Revolution comes, Jaffa Cakes will be provided to each according to his or her need! :p
