Phony crack scheme results in arrest

DURHAM - Durham police arrested a man Sunday on suspicion of trying to pass hard candy off as crack cocaine, according to an arrest warrant.

James Christopher Davis, 22, of 1412 E. Hill St., Apt. 14, Graham, was charged with possession with intend to sell or deliver counterfeit crack cocaine, and cocaine possession.

According to an arrest warrant, Davis was trying to sell Lemonhead candy that had been cut into pieces to resemble crack cocaine.

Davis was released from Durham County jail on $5,000 bail.
Man, these po-lice are some strict mofos. Wonder what the bail would have been for genuine crack Lemonheads?

Just think how strict the punishment would have been if some of the swindled crackheads had found him. :)

IIRC, look alike substances are just as illegal. I don't know why though.

I doubt it would have been "strict". More like "fatal" or "cruel and unusual".

I don't get why it's illegal. I've never actually sold fake drugs, but I've tricked junkies into thinking X substance was junk plenty of times for laughs. I wonder if that's illegal as well?

i dont' know why its illegal to pretend to sell drugs either. If I want to sell some dumb kid a bag of oregano I should be allowed to, imo

I suppose the reasoning that it would be illegal to do this is that if people get away with selling look alike materials, people selling real drugs can just claim they're selling false drugs. If it weren't illegal, they could probably just keep some fake stuff, lose the real stuff, and get away with being caught in the act, since all that can be proven would be that they were selling fake drugs.
