Ohio Whistleblower Heads To Trial For Theft Of Own Vehicle

Desperate Measures

Has anybody heard of this case? It's amazing.

"Can you be arrested and jailed for stealing your own corporate vehicle?

Can a judge impose a probation condition that you can't enter a courthouse, a public building, for the purpose of using the public law library?

Can you be threatened by police with physical harm, pursued and arrested on the basis of an invalid warrant?

Can police stop, search and arrest you without probable cause?

The constitutional issues continue to abound in northern Ohio involving disbarred attorney and judicial whistleblower Elsebeth Baumgartner, already embroiled in a First Amendment case for being criminally charged for criticizing and allegedly intimidating a judge"

I think it's a tad complex an issue for NS General. Try saying the owner of the vehicle was a Muslim trying to use it as a bomb. That should gain more than enough attention.

You are right it is amazing … so many fuckups on the part of our government in this case is sort of amazing. Each one of those issues should be enough to raise eyebrows all over, with this list of idiocy it is surprising I have not heard it before

That's one of the worst-written stories I've come across--the narrative is jumbled all to hell, and you need a flow-chart to keep all the people straight. Based on what I've read, my first impression is that this is a case where the defendant has become, for whatever reason, such a pain in the ass that the local authorities just don't care about following the rules anymore. But the article is written with such a leaning toward the defendant that it's hard to tell just how over the top the local authorities have gone.

OR:

* Palestinian terrorist trying to use it as a bomb, thus Palestinians ought to be shot.
* Heroic Israelis steal car so Palestinians can't have it.
* Homosexuals found driving cars.
* Car burns down abrtion clinic.
* Car has a USian bumber sticker.
* Anti-American found driving a car in Europe.
* George Bush found with Car.

That's all you need for a successful thread in NS general.

Ugh.

So convoluted it's impossibly hard to read.

I know a guy who lives in the area, you call him in and he'll solve everyone's problems by pissing on everything.

It's a local paper in Ohio. Cut them a little slack.

Edit: Oh no wait, it's some paper in upstate NY. Well, cut slack anyway.

Here's the Wiki:

Dr. Elsebeth Baumgartner (born May 12, 1955) is a former attorney and current CEO of Cleveland Genomics, Inc. (which provides DNA sequencing services), and has doctorate degrees both in law and in pharmacy. Dr. Baumgartner graduated first in her entering class from the University of Toledo College of Law. She is a Christian and the mother of two adult daughters by her husband, pharmacist Joseph Baumgartner. She is currently facing criminal charges in the U.S. state of Ohio carrying maximum prison sentences of 66 years and 6 months in one case, and 42 years and 6 months in another case. Currently she is free on bail.[1][2]

The specific criminal charges against Dr. Baumgartner are intimidation, retaliation, falsification and possession of a criminal tool (the criminal tool being a laptop computer) for her criticizing Ohio government officials and accusing them of corruption, such as against retired Judge Richard Markus. [3] Note that Dr. Baumgartner isn't being accused of making threats to aggress against anyone, but that the intimidation and retaliation charges directly refer to her accusations of corruption on the part of Ohio government officials.

Dr. Baumgartner previously had served 231 days in jail on the charge of falsification for accusing Ohio government officials of corruption at a Port Clinton City Commissioner's meeting (i.e., a city council meeting). [4] Ten of those days were spent being held incommunicado, having been denied access to legal counsel, visitors, clergy, the opportunity to make a phone call, and not allowed to send mail out or receive mail. [5]

In 2003, Dr. Baumgartner was permanently disbarred as an attorney for accusing Ohio government officials of corruption in a hearing where she was not allowed to be present and where the sole evidence against her was those who had been accused of corruption denying the charges. [6] In December 2005, Dr. Baumgartner was committed against her will for 39 days to the North Coast Hospital under court order for a mental evaluation, even though Ohio state law requires that a person released on bond, as Dr. Baumgartner is, be evaluated on an out-patient basis. She was found competent. Two times previously she had been psychologically evaluated, and each time found competent. [7]

The bitch deserves it. What a pain in the ass...people like this are disgusting, because they keep the justice system tied up with bullshit and cost resources that could be used to work on real crimes.

112 years in prison for being a bitch?

She's wasting taxpayer money (that I pay), costing the state and local authorities in multiple states a considerable amount of time and resource, tying down an already strained justice system and diverting the state's legal resources away from more useful purposes, causing people emotional stress and costing them money, perpetuating cruel and unfounded smear campaigns and libel against imagined "enemies", resisting arrest, vandalizing property, and repeatedly acting in contempt of court. I don't even think I covered all of it, just the ones that stood out.

If anything, 112 years is minor for the damage she has caused with her nutjob bullshit. She is committing acts of thievery, emotional damage, vandalism and assault! She's not better than any criminal and is even worse because of her blatant abuse of the justice system and disregard for others...she's so cold and heartless it's disgusting. This "woman" is nothing more than a calculating psychopath whose only redeeming merit is the fact that she didn't murder anyone.

I live in Ohio, and the last thing I want is the system to be abused by some nutjob when we've already got enough problems to last us 1,120 years let alone 112.

She'd be much easier to defend if she wasn't such a frightening bitch. It still seems like it's the fault of the court system itself that she can take this much advantage. I think if I were anywhere near her, I wouldn't cry if she was sent to jail forever but it still somehow seems wrong.

You know, it's actually quite legal to be a pain in the ass. (See U.S. Constitution, Amendment 1.)

Good thing too - if it was a crime to be a pain in the ass, then the prisons would be even more overcrowded than they already are.
Not bad

112 years in prison for being a bitch?

There are varying degrees of bitchiness. The punishment should match. This might be a fair sentence
