BSO: Man Tries To Rob Food Store, Tells Clerk He's 'Only Kidding'
Familiar Customer Then Pays For Soda, Leaves

POMPANO BEACH, Fla. -- The Broward Sheriff's Office arrested a man they said tried to rob a convenience store and then told the clerk it was just a joke.

BSO investigators said Xavier Florence and another man walked into the Dixieway Food Store on Northwest 15th Street just before 8 a.m. Wednesday carrying a rifle and wearing a bandana over the lower half of his face.

According to investigators, Florence, 20, pointed the rifle at the clerk, Sheryl Walker, told her not to move, then uncovered his bandana to expose his face and told her he was "only kidding."

Apparently, Florence lives near the store and regularly shops there. Walker, 48, recognized Florence, who told her he wanted to make sure she was prepared in case someone ever tried to rob the place, according to the BSO.

Investigators said Florence then walked to the back of the store, took a soda from the cooler, paid for it and left. Walker wasn't hurt.

Florence was arrested and charged with attempted robbery. His alleged accomplice has not been identified.

This is pretty damn funny, but why arrest him? If he was only kidding and he knew the person......unless she didnt find it funny either.

Well, the clerk might have been scared shitless. There's such a thing as taking a joke too far.

Still, throwing his ass in jail for attempted robbery, that's just insane. Why not just fine the wanker, make him apologise & possibly revoke his gun license.

yeah if anything they should have just given him possession of a firearm or something a tad more minor than attempted robbery. i mean they knew each other

It was a rather stupid thing to do, but how can they get him on attempted robbery if he didn't technically try and rob the place? There are probably several firearms charges they could get him on (dangerous use, etc) unless yank gun laws really are that lax that you can just point guns at people randomly..

the question is tho, who brought up the charges? the teller? then it would be assault (physical contact is not needed for assault) or threatening.

however, if it was the store owner (after viewing it on a security tape) then he can have charges pressed against Florence.

If I was a store owner, I would press charges.
1) how do I know that it wasn't an actual robbery, and that the only reason why he didn't go through with it was because he knew the clerk. so what happens when someone else is working.
2) as my employee, Sheryl would be my responsibility. thus anything that threatens my employees I would take action on.
3) anyone stupid enough to point a gun and treat it like a toy needs a lesson in reality.

and being that the charge is Attempted robbery means that success or failure isn't an issue. Even intent doesn't have to play a role.

his intent was noble, but there are ways to go about it properly. Talking with the owner/manager is one way.

I can see how that would be alright if the store was owned by the one person, but it's not. It's rather inappropriate to make jokes like these with an employee of an owner. If you're "tight" with the owner himself, and he happens to be the teller as well (i.e. Apu), then it's all good (as long as he took it as a joke too).

I definitely think the "robber" should be charged & tried in court. Threatening someone with a gun is just not funny, it's very serious. Even if it was only ever intended as a joke, there's no way the cashier could have known that. What if the the cashier accidentally got shot trying to get the gun from the "robber"? Just not funny.
