I swear officer, I didn't know she was dead!

That's the excuse of a guy charged with Necrophillia. The woman's boyfriend was concerned when he couldn't reach her on his phone, so he asked a friend to check on her. The friend got a little too friendly with the corpse.

"I swear officer, I didn't know she was dead," is not a good excuse in my opinion. Necrophilla is really, really off, but it doesn't directly hurt anyone, unlike rape. He should be punished more if he didn't realise she was dead than if he did.

Why exactly is sex with a dead body illegal? I mean, it's like charging someone after a failed attempted suicide.

it's probably got something to do with health risks of having sex with a decaying body (or being around it anyway)

I have always thought the suicide thing was funny. But, they want to deter people from commiting suicide, so they try to keep them from trying again by locking them up. I always thought the people who fail at suicide are funny, it's just one more thing they suck at. :D

No, it's not rape. Shooting a dead body is not murder. It's just very very creepy. And disturbing for the family.

He didn't need permission. Do you need permission to jack off into a wad of kleenex? A corpse is no more a human being than a Kleenex.

Necrophiles should get very shallow sentences in my opinion, they are disturbing the dead but unless they killed the person, they have harmed nobody physically.

Personally I wouldn't have quite put it like that. If someone is slow to remove the status of human from a dead body I think that's a good thing. I don't want to wake up from a concusion to find a lonely person obtaining satisfaction. "Oh sorry, mate! Thought you were dead."

Technically it's a human body, but it's not a person. One can't be guilty of murdering a corpse, or assaulting a corpse, so one cannot be guilty of raping a corpse. I don't think the law recognizes those things as violence when done to a corpse, only "desecration" or mutilation or something.

Maybe morals are kind of rare around here, but what about respecting the dead? Even if it is a corpse, it is still a human being in my opinion. It's desecration, and disrespect to the dead.

If people could get what they deserved instead of what the criminal justice system can manage to dish out, then I would say that if this person honestly didn't know she was dead, then he deserves a severe beating and/or several well placed kicks to the groin.

If he knew she was dead, then after said beating and/or groin kicks, then get the man some psychiatric treatment.

Because having sex with a incapacitated woman is sickening. Having sex with a corpse is just sick. :p

Reminds me of a joke.

There was this ugly guy, he walks into a bar with a big grin on his face. The bartender sees the guy smiling and asks whats up.

The man replies " Yeah i was walking home along the tracks, when i found this woman with an amazing body. So i took her home and i banged the hell outta her."

The bartender looks at him, smiles and asks "Did you get a blow job from her?"

The man replied "Nope, couldn't find the head."

According to the story, it wasn't the boyfriend who did it, he asked a friend of his to check on his girlfriend for him, and the friend of the boyfriend did it.

That is a disturbing act. Hasn't anyone been around a corpse? There is nobody there, just a body. Like a wax dummy. It must've been cold and dry, ick!

Depending upon a number of factors it might well have been warm. The human body's cooling after death, refered to as algor mortis, can be a slow process especially if the body is fat, wrapped in heavy clothing, or in a warm environment. Death from head trauma can actually cause the body to get warmer before it cools for some reason.

Why? You can no more rape a corpse than you can rape a hole in the wall. And somehow I doubt the dead girl was all that bothered, what with being dead and all.

Where there is a will, there is a way. Depending on what their looking for, working in a funeral parlour or having access to a lonely graveyard could keep one happily engaged for years.
Don't you think he or she might be rather over eager and overlook a faint pulse?
In which case, they've commited rape and should be hit with the full weight of the law.
On the other hand, there is nothing wrong with necrophilia (or cannibalism, for that matter), provided that there is no "hunting" involved, and the lot of you decrying it need to get over the puritan sticks lodged in your asses.
That this man has to make an excuse is a terrible indictment against a society that values the rights of a thing over the (nonharmful) desires of a person. When someone dies, there is nothing more that can be done for them: they're only so much rotting meat, and meat (like any other inanimate object) has no rights.

No. You're right. If he was just using the "I didn't know she was dead" thing as an excuse, then he has commited a civil crime in using the property of the dead girl's family without their knowledge or conscent. If he really didn't know she was dead, this is attempted rape. (After all, it's still attempted murder if you go after someone with a rubber knife if you didn't know it was made of rubber.)

It is sad that our sexually repressed culture has resulted in people pleading to objectively more harmful crimes as a way of not being seen as "perverted".
