Assault and battery with a dodgeball

A schoolgirl is being charged with assault and battery for playing a game of dodgeball. She allegedly gave a boy a fat lip by striking him with the ball. How the hell does one justify charging a kid with assault and battery for playing dodgeball? Generations of American kids have been playing this game in school gym classes.

So one kid got a fat lip. What's the big deal. It's not a disfiguring or crippling injury. It's hardly an injury at all. His parents, who complained about the incident and started this crap, ought to be punished for reckless prosecution or something.

In Britain we call it the American Compensation disease.

You might want to call it political correctness/ cultural sensitivity.

CollegeHumor pretty much did that. I really hope that girl doesn't get charged with anything. That is ridiculous to charge a girl with battery for hitting a kid with a ball in a game where your suppose to hit them with a ball. A Quarter back doesn't charge who ever sacks him with battery when he gets tackled.

You know what I think is happening? All those pussy kids who were picked last, got their asses kicked in sports & life are now pussy parents with their pussy kids and suing schools because their pussy son/daughter got hurt, made fun of, etc. As george carlin calls it "The Pussification of America".
And this is a great example.

He needs to learn to play if he got a fat lip from dodgeball. Don't charge her with assault & battery, charge him with inability to play dodgeball. Loser.

We had dangerous games of dodgeball when I was in elementary school. There were no rules because we were allowed to play whatever game we wanted, so we went up to another area and tried to kill each other with crappy balls. If you get a fat lip, your dumbass is too slow to play dodgeball. Go sit on the beaches with the rest of the pansies.

games used to me so dangerous when we were little and no one complained.
games like

"Hey! Whos on Fire?" and good old "Knife Toss", and lets not forget "Cross Traffic Relay" That one was my personal favorite

I don't think they're suing the school. That might actually make more sense, because they could make a case that the kids shouldn't have been playing dodgeball in the first place. Still ridiculous, but possibly more credible.

There was also, "chicken on the 8 foot monkey bars," "try to knock the other kid off the see-saw by letting it drop from 5 feet in the air," and "I bet I can't jump farther from the swing than you."

If the parents of the slow kid take the non-pansy parents of the girl to court, their family should sue them to pay for court costs.

The biggest pussies in all of this? The parents of the other children charged who capitulated.

thats another thing that irritates my butt hole, the parents who are trying to get rid of dodgeball in school because its demeaning to some kids. I wasn't ever a winner in dodgeball, but I never gave a damn. It's only a game. Should track be banned because not everyone is fast enough or has enough endurance to run a mile???

Great now you have to be nervous whenever you play a game with other kids. They might get hurt and then you might be arrested! Parents should worry that their kid might get railroaded on some bullshit charge like this. Those parents who let their kids plea are obviously spineless. They'd just let their kids be screwed over like that?

Man, I've been playing rugby for the best part of 10 years (I'm English, as you may have guessed).

I played this Saturday, and broke my nose for the second time, cut my lip open and got my shins and kness covered in grazes, cuts and bruises.
I walked in the door, looking like I'd done a round with Joe Calzaghe, and my mum said 'Well done, did you win?'

I guess what I'm trying to say is...

It's not all of us. It's a small number of very loud and somewhat wealthy assholes who have embraced the idea that violence of any type has absolutely no place in society and that aggressive competition is somehow bad. Way to deny human nature and leave your kids defenseless when someone tries to intimidate them.

You're not denying human nature, the suburban housewives who bring lawsuits and stuff to protect their "precious little babies" are.

It's human nature to compete aggressively and to engage in some types of socially sanctioned violence such as sports and minor schoolyard scuffles when you're a kid.

It should be noted that the issue is that they acted outside of the rules. They aren't saying they shouldn't be allowed to play dodgeball. They said that they 'attacked' the kid not within the game.

That said, I still think charging these kids is just plain ridiculous.

On a more important note, my dodgeball team is 23-2.

David Hidalgo, supervising deputy district attorney for San Bernardino County, told NBC4 that although it is illegal for his office to discuss specific cases, he notes that there is always the option of community service or a letter of apology to resolve a case.

"When parents refuse to cooperate under those circumstances and they refuse to hold a minor accountable for their criminal conduct and insist they go to court to refute the allegations, then we have no choice," Hidalgo said.
That just proves lawyers are immortal demons who never had a childhood.
Criminal conduct? What bullshit. If that is "criminal conduct," the amount of "criminal conduct" going on in schools must be an attorney's wet dream.

The district attorney, probation and sheriff's departments agreed with the school that the boy was repeatedly and unnecessarily hit with the ball and they filed charges against the students.

Once again it helps to read the story.

It doesn't seem as though it's just one crazy lawyer or administrator causing all this, and it's certainly not just the kid's mom. They essentially beat him up; definately not within the rules of the game. Though charging kids with assault and battery seems a bit ridiculous. Maybe just suspend them from school for a week or something.

Okay, first off I have to say that I feel sorry for the fat lip kid. It would be my guess that as big of a loser as he is, his parents making a big stink over nothing is making it worse. He will never have a date for the rest of his school life. I think He's being a wuss if he's agreeing with his parents, but I would guess that his parents are anal jackasses who think their son is a precious prince and he hates it. If not well then he's a flaming asshole.

Now I am going to probably start a new nasty debate.

I think it is important for kids to get PE to up their awareness. I think games like Red Rover, British Builldog, What time is it Mr. Wolf, and Dodge Ball are great games to have in school. I wasn't the best player in them ever, but I had a hell of a time playing them. They were fun.
However, while I think all kids should be taught the basic rules and how to play games like soccer, football, basketball...ect ect. I don't think it shopuld be the onl;y form of PE there is.

I can't run worth a damn. Never could, even before I tore the ligaments in my ankles. I was never good at track or any of the other sports. I had fun playing them when I was in elementry school, but by the time I was in junior high/high school I was sick of being forced to make a fool of myself. I knew I was never going to be a good athlete, I didn't need to be reminded of it every day I went to school. Now I'm not saying get rid of PE in Jr. High. Kids reallly need the physical activity. But sports are not the only way to stay fit.

I wish there had been an exercise class, or yoga, or just a basic gym class that showed us how to do proper sit ups, push ups, streches and such. You still get a break from classes and are exercising, but your not being reminded how much you suck. Let the kids who have established themseles as athletes do the sports. et's face it though. Only 4 or 5 kids you went to highschool with ever did anything in sports past highschool. Maybe 1 or two went professional. All the sports knowledge I got went down the drain. Most people will use sit ups, yoga, streches, jogging.....ect. for the rest of their lives, so why not teach them how to do it properly so they won't hurt themselves?

Any takers on that idea?

The question I would have is: was the boy who got the fat lip actually playing?

If he was not playing, and was hit repeatedly with the ball, including the hit that got him a fat lip, then yes, Brittany and anyone else who was involved should be punished.

If he was playing, that's known as "taking a risk", and they should all go home.

If the other players turned on him and singled him out trying to hurt him, they should all be punished.

There really is not enough info here to judge what's gone on.

There isn't enough information here, but the article does seem to gloss over a point that indicates the students were not just playing the game. It's typical. Pointing out that the student was actually victimized makes the article less scandalous, so they skirt a part of the story that is germaine. It's irresponsibile regardless of which of these issues it is.
