Mmm... I don't really agree. No... and yes.
If you look at the charges the article links to, it only specifically charges Franklin and Co. for violating the oath they took.
Rationally, I don't think it could be expanded to encompass the entire population.
Then again, it could easily be interpreted otherwise: judicial activism and whatnot. It wouldn't be the first time a judge attempted to use past precedent to get what they wanted; we even have judges who rely on their own biases to render judgments!

I want that car-jacker flambeing flameout undercarriage feature! it's only legal in South aFrica so far.
As well I want the electrocurion feature, you know, I''m in the car, some idiot I don't like touches the car,I hit a button on the dash and zzzzzap!
And one of those duhikijs that tells me if some one is following me so I can make their life interesting by driving the wrong way on a one way street or something.
