Joseph Smith killed an eleven year old girl. His rap sheet was 12 pages long, with violent acts extending back many years. Smith had been on drugs for several years. A Judge released him from a previous violent offense.

What's wrong with this picture?

Smith, in tearful testimony at his murder trial blamed all his problems on drugs. So? The jury has recommended the death sentance. IMHO, if you choose to take drugs, then commit a violent offense, you deserve the maximum sentance ... period.

Agreed he deserves the 'maximum sentence'. Not too sure about the death penalty though. Blaming it on drugs is a stupid thing to do. I hate that.

Something doesn't sound right as I thought most states have manditory sentancing guidelines for drug use and/or murder.

I think most drugs should be legalised but people who take them should be totally responsible for their own actions whilst under the influence.

Aristotle talks about this when he distinguishes between voluntary, non-voluntary and involuntary action I believe. He says that people who drink alchohol are responsible for the way they act whilst drunk, because at some point a choice was made whilst perfectly sober to drink alchohol.

Great another thing to give drugs a bad name, as if the Olympics and the Tour de France weren't enough.

I think the Death Penalty is too easy. Let him rot in jail and please send me any pot that he may have had. He probably had none because violent acts and pot don't typically go together.
