At the moment no. But they can chip away at it.

They need to replace ginsburg and or stevens to do that.

I already have 5 pages of debate. The only thing being debated here, is you and me arguing over thread rights.

You made the threads to have debates (as it would turn into). I already have a thread that people are debating in on his confirmation.

Yes I agree. I hated Alito in the begining. Then after the terrible treatment of him that made his wife cry I support him and HATE those terrible democrats in congress. EXAMPLE: CHARLES KENNEDY, CHUCK SHUMER< HILARY CLINTON,

The main problem about that the list of democrats you just mentioned and more will vote against the most highly trained person just as long as bush proposes him. I dont think any of them are fit to be in congress.

I remember when the Bork hearings were held years ago, and Kennedy did the same crap to Bork that he's done to every Republican nominee ever since.

Unfortunately for Kennedy, Bork made Kennedy look like a failed law school student who hadn't studied and was now facing an oral exam. You could tell that having Bork point out how stupid he was really steamed him.

Kennedy, Schumer, and even Specter (yes, I know he's a Republican) all are pretty stupid, and it's a wonder that they have enough brain cells to maintain their breathing.

I'm glad the filibuster was shot down the way it was. It shows that some democrats are actually sane, unlike Kerry/Clinton.

I'm not sure if I'd call it debate, it mainly consists of you and Stone Bridges claiming that the father should have a say in abortion and then, when asked how it should be enforced, either whining about lawsuits or dodging the question entirely.

Oh, even if we completely leave Roe v Wade out, we just opened the door to the submission of individual rights to corporate rights.

If you don't like the way that the Supreme Court interprets the Constitution and the law, then change the Constitution.

That's what you have a Congress for, eh? Of course, they don't have the balls to do anything - they want to legislate through the judiciary so that if anything becomes unpopular, they can disavow their actions.

That's why I also believe that even Democrats secretly crave a strong executive, so that they can disavow themselves from the actions of the President if it turns out to be unpopular.

The man's too conservative for my taste, but he seems well-versed in the law and perfectly able to carry out his duties, so I can't think of any reason not to confirm him beyond "I don't agree with his personal views." I vote yes. Let the man do the job.

Which is no doubt why Chief Justice Roberts squeaked through on a 55-45 party line vote. Oh wait. . .

The simple fact is that there are three main categories that anybody looks for in a Supreme Court Justice: judicial temperment (are they emotionally suited for the role), knowledge of the law (how well-versed are they in the stuff they are going to be doing), and how they interpret the law. Justice Alito clearly had the judicial temperment and knowledge of the law requisite of a Supreme Court justice. But I agree with Democrats that his interpretations of the law often left a great deal to be desired, and his questioning revealed how perfectly opaque he was by revealing absolutely nothing. Let me be more elaborate.

As a candidate for a job in the Reagan administration, he explicitly wrote that he was proud of his attempts to whittle away at Roe v. Wade, and that he felt that it was good to do so. If so, then asking a person if he still feels that way is not asking him to pre-judge a case: clearly, he has already pre-judged it. Yet Alito dodged the question. As a federal judge, he showed repeated extreme deference to the executive, such as allowing federal wiretaps that had not recieved a search warrant. His rulings were repeatedly overturned by higher federal court authorities as being unreasonable interpretations of the law and ignoring precedent. Yet he dodged questions about those as well. His hearings seemed to reveal precisely nothing, which leads me to ask how the Senate can possibly give advice and consent on the matter.

Put simply, Alito was non-committal to the point of being dishonest, and as an honest man, I don't like and don't trust people who say and do things like that. While I'm hardly a fan of stare decisis (imagine if Plessy v. Ferguson had remaind law), at least I'm willing to say it out loud. Even more, I strongly disagree with the positions that he comes to. The fact that his poor wife cried during the hearings does not suddenly make him more qualified for the Supreme Court, but the fact that he will not allow the Senate a fair read of him to give their advice and consent does make him less qualified in my opinion.

To be honest, I just hope the Republicans reap what they sow with this nomination, because either way in the long term it will be devastating for the Republican Party. If Alito does strike down Roe v. Wade, it will put the Republicans in a permanent minority position for a decade. If Alito doesn't strike down Roe v. Wade, then you'll have a hard sell trying to get those cultural conservatives back under the tent. They deserve it for their brinksmanship with women's rights.

Study the US from when it was actually a conservative country in the 1870s, 80s, and 90s.

Unfortunately, Alito's record with firearms scares the hell out of me.

He LIKES the idea of gun registration and strict controlls on firearms. Definitely NOT a standard conservative standpoint--more like a dictatorial standpoint. He scares me.
