MT. VERNON — A Franklin County man has been charged with criminal transmission of HIV after allegedly biting a Jefferson County deputy during an attempt to arrest him Saturday evening.
Thomas Buckingham, 37, of 209 Fifth St., Royalton, was formally charged Monday in Jefferson County Circuit Court. Judge Terry Gamber set bond at $40,000, according to court documents.
Buckingham is also charged with aggravated battery of a peace officer and criminal trespassing.
Deputy David Bowers found Buckingham at the boat dock at North Avenue/Ken Gray Parkway in Ina, where he had formally been given notice not to enter the property.
While there, Buckingham, “while knowingly being infected with HIV,” bit Bowers’ finger, breaking the skin, according to documents.
The aggravated battery charge alleges Buckingham “knowingly caused bodily harm to Bowers, knowing he was a peace officer,” by biting his finger.
The criminal trespass charge alleges Buckingham entered the property “after having received notice that entry was forbidden.”
Jefferson County Sheriff Roger Mulch wasn’t available for comment this morning.
In court Monday, Buckingham retained local attorney T.J. Parrish as counsel. Buckingham’s arraignment has been set for 1:30 p.m. Feb. 15.
Gamber attached several conditions to the defendant’s bond. If he does post bond, he is not to “go upon the premises of the Ina boat dock” and must undergo a mental health evaluation and follow through on any recommendations.
Bowers, a long-time county deputy, also serves as the department’s accident reconstructionist.
According to the national Centers for Disease Control, there have been other rare reports in medical literature in which HIV appeared to have been transmitted by a bite. However, severe trauma with extensive tissue tearing and damage and presence of blood were reported in each of these instances.
According to the CDC, there have been numerous reports of bites that did not result in HIV infection.
Well i was bored and i thought i'd let everyone know what kinda BS i have to put up with here in S. IL. I mean wtf? Biting a cop to spread AIDS???? I didn't even know anyone down here HAD AIDS...:p.. Well anyways from what i hear, this man might be facing some sort of hardcore felony charges. Really, I hope he does. THis just goes to show ya, we live in a screwed up world.
