Mooning deemed "disgusting" but legal

WASHINGTON - Acquitting a Germantown man who exposed his buttocks during an argument with a neighbor, a Montgomery County Circuit Court judge ruled yesterday that mooning, while distasteful, is not illegal in Maryland.

"If exposure of half of the buttock constituted indecent exposure, any woman wearing a thong at the beach at Ocean City would be guilty," Judge John W. Debelius III said after the bench trial, reversing the ruling of a District Court judge.

Debelius made clear his disdain for the defendant, calling the alleged act "disgusting" and "demeaning." The outcome could have been different, he suggested, if the man had been on trial for "being a jerk...."

James Maxwell, one of McNealy's attorneys, said yesterday's ruling should "bring comfort to all beachgoers and plumbers" in the state.

Hahahaha. I say good luck to the guy that did it. Losing an argument? Bring your butt into it. Works every time. They'll be speechless.

Although...seems a bit weird that someone would attempt to sue for being mooned...

Reminds me of a story from Arkansas from, must be at least four, five years ago, about a guy who sued a cop for false arrest because he was arrested for flipping an undercover cop off. The judge said that giving the finger was considered free speech, and was protected by the First Amendment.

Hm. I wouldn't be game to do it to an officer in uniform...especially considering some of the people that become officers.

Probably a safer bet than someone in the army, though.

What the hell does that mean? "I dont think much of you or your opinions, so here is a look at my ass".

I think it would be more appropriate during some type of courting ritual as a sign of affection or interest, rather than aggression or hostility.

Thats just me though. It probably makes perfect sense to those who do it.

And I think if someone mooned me under hostile circumstances, my refelxive action would be to put my foot swiftly into the exposed region. Why would you turn your back and bare your ass to a potential adversary?

The human rump is more comical than anything else. Mooning, in my experience, is usually performed in the spirit of silliness and low-brow humor, probably because most people realize that you can't very well be intimidating or threatening if you're presenting your bared buttocks. Not only does doing so make absolutely no sense in a hostile situation, it also makes you look like a 5 year old who is about to receive a spanking. Neither of these is conducive to a serious confrontation.

I see it as a sign of ridicule and contempt, designed purely to infuriate. But like Bottle said, it isn't usually used in that context. *shrugs*
