Could I have done better?

I was at McDonalds yesterday, and had one of their processed chicken sandwiches, and found I was chewing on something a bit too hard. I pulled it out of my mouth... and there was a chicken bone in my sandwich!

I didn't care a whole lot, but I decided I might as well complain, get a refund, and a free new sandwhich (different kind).

It wasn't the fault of the kids working there- they just took the patty that got delivered along with all the rest and put it on my sandwich none the wiser.. so it was the supplier that let this happen.

But what if I swallowed it? What if there was a young kind who got it and choked? Isn't that liable ground for suing? Or at least more than just one new sandwich? What would you have done?

That seemed like a reasonable reaction. Suing would have been overboard unless you suffered some kind of harm.

you got more than you deserved. they gave you a refund and a free sandwich because of not not wanting to be dicks, not for any overriding legal reason

nothing bad happened to you. no you dont have any case for suing them.

you got more than you deserved. they gave you a refund and a free sandwich because of not not wanting to be dicks, not for any overriding legal reason

McDonalds did not give the costumer the product he paid for; therefor they were obligated to replace it. Extra compensation is customer service, suing for non-existent damages would be silly.

well now, he paid for a chicken sandwich and he got a chicken sandwich. it was properly cooked. that it had enough actual chicken in it to have a bone is quite surprising but not out of the question in "real food". im not sure that they even SAY its boneless.

in any case i think he said he got a replacement AND a refund. that was more than was necessary.

im not sure that they even SAY its boneless. However that can be reasonably expected. Around here consumer protection is such that if you can reasonably expect a product to be some way, your complaint is valid when it isn't.
On the other hand, if it were to get to a court case, you shouldn't expect to get much over a refund, and a sad sad look for bringing it to court.

I think they say it's only breast meat in every chicken product except the Chicken burger, which is listed, simply, as a "McChicken Patty".

Moral of the story? Don't eat the chicken burgers.

And it's better than the woman who ordered the Chicken Whopper from BK and got a chicken claw in her sandwich.

I was once in a pretty nice restaurant with my wife. While eating, I noticed a glint of metal in my plate and found it to be what looked like a shard of stainless steel. I didnt eat it by accident, it was never in my mouth, but I was concerned that someone else wouldnt be as lucky. I'll describe it as what looked like someone may have had to drill through a stainless steel hood in the kitchen and somehow a piece got onto my plate.
The waitress returned at one point to ask how everything was and I very quietly showed her what I found. My main concern was someone else getting the same and breaking a tooth on it, choking on it, or swallowing it and getting internal damage. The next thing I know, the manager and then the owner came over, all in an uproar, appologising and drawing tremendous attention from every one else there. They refused to let me pay for my meal or my wife's (with appetizer,drinks it was over $150.00) and kept saying they didnt know how it happened. I thanked them and assured them I wasnt looking for a free meal or to get any attention at all, just to show it to them as the owner or manager might be aware of what caused it and be able to prevent it. I'm not a litigious person and had no interest in getting a free meal or anything else. It wasnt something that hurt or disgusted me.
I guess I would have felt differently if my wife was injured by it. But I can understand how something like this can happen. I suffered no loss and felt guilty walking out wthout paying. Even felt like they might have suspected I did it on purpose to get out of paying.
